का.आ. 4744(अ).—सेवाओं या फायदा या सहायिकियों के परिदान के लिए एक पहचान दस्तावेज के रूप में आधार का उपयोग सरकारी परिदान प्रक्रियाओं का सरलीकरण करता है, पारदशिता और दक्षता लाता है और हिताधिकारियों को सुविधाजनक और निर्बाध रीति में उनकी हकदारियों को सीधे प्राप्त करने में समर्थ बनाता है और किसी व्यक्ति की पहचान को साबित करने के लिए विभिन्न दस्तावेज प्रस्तुत करने की आवश्यकता को समाप्त करता है;
और खाद्य प्रसंस्करण उद्योग मंत्रालय (जिसे इसमें इसके पश्चात मंत्रालय कहा गया है) प्रधान मंत्री सूक्ष्म खाद्य उद्यमों औपचारिककरण (प्रधानमंत्री एफएमई स्कीम) का के न्द्रीय रूप से प्रायोजित स्कीम (जिन्हें इसमें इसके पश्चात स्कीम कहा गया है) का प्रशासन कर रहा है। स्कीम का उद्देश्य खाद्य प्रसंस्करण उद्योग के असंगठित क्षेत्र में व्यक्तिगत सूक्ष्म उद्यमों की प्रतिस्पर्धात्मकता में अभिवृद्धि करना और क्षेत्र की औपचारिकता को प्रोत्साहन देना है। साथ ही किसान उत्पादक संगठनों (एफपीओ), स्वयं सहायता समूहों (एसएचजी), उत्पादकों सहकारी समितियों और सहकारी समितियों को अपनी संपूर्ण मूल्य श्रृ ंखला के साथ समर्थन करने के लिए स्कीम प्रस्तावित है। यह स्कीम राज्य सरकारों और विभिन्न बैंकों (वित्तीय संस्थानों) (जिसे इसमें इसके पश्चात एक साथ कार्यान्वयन अभिकरण कहा गया है) के सहयोग से खाद्य प्रसंस्करण उद्योग मंत्रालय के अधीन विभिन्न संस्थानों के माध्यम से कार्यान्वित की जाती है।
और स्कीम के अधीन, पात्र परिस्कीम लागत के 35% की दर से क्रे डिट लिक्ड सब्सिडी जिसकी अधिकतम सीमा 10,00,000 रुपये प्रति आवेदक है (जिसे इसमें इसके पश्चात फायदा कहा गया है) को अलग-अलग आवेदकों को विद्यमान स्कीम के दिशानिर्देशों के अनुसार दिया जाता है, जो इस असंगठित खाद्य प्रसंस्करण क्षेत्र का भाग है और प्रायः रजिस्ट्री और अनौपचारिक हैं (जिसमें इसमें इसके पश्चात हिताधिकारी कहा गया है)। इस प्रकार के उद्यमी 74% रोज़गार (जिनमें एक तिहाई महिलाएँ हैं), 12% आउटपुट और 27% मूल्य वधित खाद्य प्रसंस्करण क्षेत्र में योगदान करते हैं। इन विनिर्माण इकाइयों में से लगभग 66% ग्रामीण क्षेत्रों में स्थित हैं और उनमें से लगभग 80% परिवार आधारित उद्यम हैं;

अतः अब, कें द्रीय सरकार आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (2016 का 18) (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है), की धारा 7 के उपबंधों के अनुसरण में निम्नलिखित अधिसूचित करती है, अर्थात्-
1. (1) स्कीम के अधीन लाभ लेने के इच्छु क प्रत्येक पात्र व्यक्ति से अपेक्षा की जाती है कि वह आधार संख्या रखने का सबूत प्रस्तुत करे या आधार अधिप्रमाणन कराएः
(2) स्कीम के अधीन लाभ लेने के इच्छु क प्रत्येक ऐसा व्यक्ति जो आधार संख्या नहीं रखता है या जिसने आधार के लिए अभी तक नामांकन नहीं किया है, उसे स्कीम के लिए रजिस्ट्रीकरण करने से पहले आधार नामांकन के लिए आवेदन करना होगा, परंतु वह उक्त अधिनियम की धारा 3 के उपबंधों के अनुसार आधार प्राप्त करने के हकदार हैं और ऐसे व्यक्ति आधार नामांकन के लिए किसी भी आधार नामांकन कें द्र (कें द्रों की सूची यूआईडीएआई की वेबसाइट www.uidai.gov.in पर उपलब्ध है) का दौरा कर सकें गे।
(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियमन 12 के अनुसार कार्यान्वयन अभिकरणों के माध्यम से मंत्रालय हिताधिकारियों के लिए जो अभी आधार हेतु नामांकित नहीं हुए हैं, उनके आधार नामांकन सुविधाओं की व्यवस्था करना अपेक्षित है और यदि संबंधित ब्लॉक या तालुका या तहसील में आधार नामांकन कें द्र स्थित नहीं हो तो कार्यान्वयन अभिकरणों के माध्यम से विभाग यूआईडीएआई के विद्यमान रजिस्ट्रार के सहयोग से या स्वतः यूआईडीएआई रजिस्ट्रार बनते हुए सुविधाजनक स्थान पर आधार नामांकन सुविधाएं उपलब्ध कराएगाः
परंतु स्कीम के अधीन किसी व्यक्ति की आधार सौंप दिए जाने तक ऐसे व्यक्ति को निम्नलिखित दस्तावेजों को प्रस्तुत करने की शर्त पर लाभ दिए जाएंगे, अर्थातः-
(क) यदि वह नामांकित हो गया हो, उसके पास आधार नामांकन प्रमाणीकरण की पर्ची होः और
(ख) निम्नलिखित दस्तावेजों में से कोई एक हो, अर्थात्
i. फोटो के साथ बैंक या पोस्ट ऑफिस की पासबुकः या
ii. स्थायी खाता संख्या (पैन) कार्ड; या
iii. पासपोर्ट; या
iv. राशन कार्ड; या
v. मतदाता पहचान पत्र; या
vi. मनरेगा कार्ड; या
vii. किसान फोटो पासबुक; या
viii. मोटर वाहन अधिनियम, 1988 (1988 का 59) के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी चालन अनुज्ञति; या
ix. किसी राजपत्रित अधिकारी या किसी तहसीलदार या किसी कार्यालय के अधिकारिक शीर्षपत्र पर जारी किसी ऐसे व्यक्ति का फोटो सहित पहचान प्रमाणपत्र; या
x. मंत्रालय द्वारा विनिदिष्ट कोई अन्य दस्तावेजः
परंतु यह और कि उपयु र्क्त दस्तावेज को विशेष रूप से इस उद्देश्य के लिए मंत्रालय द्वारा नामनिदिष्ट एक अधिकारी द्वारा जांचा जाएगा।
2. स्कीम के अधीन हिताधिकारियों को लाभ प्रदान करने के लिए, मंत्रालय अपनी कार्यान्वयन अभिकरणों के माध्यम से, यह सुनिश्चित करने के लिए सभी अपेक्षित व्यवस्थाएं करेगा जिससे स्कीम के अधीन आधार की अपेक्षाओं के प्रति हिताधिकारियों को जागरूक बनाने के लिए मीडिया के माध्यम से व्यापक प्रचार किया जाएगा। 3. उन सभी मामलों में, जहां आधार अधिप्रमाणन हिताधिकारियों के खराब बायोमैट्रिक्स के कारण या किसी अन्य कारण से असफल रहता है, वहां निम्नलिखित उपचारात्मक तंत्र अपनाया जाएगा, अर्थातः-[भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण 3 (क) खराब अंगुलीछाप गुणवत्ता के मामले में, अधिप्रमाणन के लिए आईरिस स्कै न या चेहरा अधिप्रमाणन सुविधा अपनाई जाएगी, जिससे मंत्रालय अपनी कार्यान्वयन एजेंसियों के माध्यम से, आईरिस स्कै नर्स या चेहरा अधिप्रमाणन के साथ अंगुलीछाप अधिप्रमाणन के लिए प्रावधान करेगी जिससे निर्बाध रीति से लाभ प्राप्त हो सके ;
(ख) अंगुली छाप के माध्यम से बायोमैट्रिक्स अधिप्रमाणन या आईआरआईएस या चेहरा अधिप्रमाणन के सफल न होने की दशा में, जहां कहीं साक्ष्य और ग्राहय हो, वहां, यथास्थिति, सीमित समय वैधता वाले आधार वन टाइम पासवर्ड (ओटीपी) या समय आधारित वन टाइम पासवर्ड द्वारा अधिप्रमाणन प्रदान किया जाएगा;
(ग) अन्य सभी मामलों में जहां बायोमैट्रिक्स या आधार वन टाइम पासवर्ड या टाइम-आधारित वन- टाइम पासवर्ड अधिप्रमाणन संभव नहीं है वहां स्कीम के अधीन लाभों को भौतिक आधार पत्र के आधार पर दिए जा सकते हैं, जिनकी अधिप्रामाणिकता आधार पत्र पर मुद्रित कोड से त्वरित प्रतिक्रिया (क्यूआर) के माध्यम से सत्यापित की जा सकती है और त्वरित प्रतिक्रिया कोड रीडर का आवश्यक प्रबंध अपनी कार्यान्वयन अभिकरणों के माध्यम से मंत्रालय द्वारा सुविधाजनक स्थान पर उपलब्ध कराया जाएगा;
4. यह सुनिश्चित करने के लिए कि स्कीम के अधीन कोई भी हिताधिकारी अपने देय लाभों से वंचित नहीं है, मंत्रालय अपने कार्यान्वयन अभिकरण के माध्यम से प्रत्यक्ष लाभ हस्तांतरण मिशन, मंत्रिमंडल सचिवालय, भारत सरकार के दिनांक 19 दिसम्बर, 2017 के कार्यालय ज्ञापन संख्या डी 26011/04/2017-डीबीटी (https://dbtbharat.gov.in ) में विनिदिष्ट अपवाद संचालन क्रियाविधि का पालन करेगा।
5. यह अधिसूचना राजपत्र में इसके प्रकाशन की तारीख से असम और मेघालय राज्यों के सिवाए अन्य सभी राज्यों और संघ राज्य क्षेत्रों में प्रवृत्त होगी।

NOTIFICATION
New Delhi, the 22nd December, 2020
S.O. 4744(E).—Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;
And whereas, the Ministry of Food Processing Industries (hereinafter referred to as the Ministry), is administering Centrally Sponsored Scheme of Pradhan Mantri Formalisation of Micro Food Enterprises (PM FME Scheme) (hereinafter referred to as the Scheme). The Scheme aims to enhance the competitiveness of individual micro-enterprises in the unorganised segment of the food processing industry and promote formalisation of the sector. Also, the Scheme is proposed to support Farmer Producer Organizations (FPOs), Self Help Groups (SHGs), Producers Cooperatives and Cooperative Societies along their entire value chain. The Scheme is implemented through various institutions under the Ministry of Food Processing Industries, in collaboration with the State Governments and various Banks (Financial Institutions) (hereinafter together referred to as the Implementing Agencies);
And whereas, under the Scheme, credit linked subsidy at the rate of 35% of the eligible project cost with a maximum ceiling of Rs. 10,00,000 per applicant (hereinafter referred to as the benefit) is given to the individual applicants as per the extant Scheme guidelines, who are part of the unorganised food processing sector and are usually unregistered and informal (hereinafter referred to as the beneficiaries). These kinds of entrepreneurs contribute to 74% of employment (a third of which are women), 12% of output and 27% of the value addition in the food processing sector. Nearly 66% of these manufacturing units are located in rural areas and about 80% of them are family-based enterprises;

Now, therefore, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Central Government hereby notifies the following, namely:-
1. (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.
(2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitled to obtain Aadhaar as per section 3 of the said Act, and such individual shall visit any Aadhaar enrolment centre (list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhaar.
(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Ministry through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Ministry through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:
Provided that till the time Aadhaar is assigned to the individual, benefits under the Scheme shall be given to such individual, subject to the production of the following documents, namely :– (a) if he has enrolled, his Aadhaar Enrolment Identification slip; and
(b) any one of the following documents, namely :-
(i) Bank or Post office Passbook with Photo; or
(ii) Permanent Account Number (PAN) Card; or
(iii) Passport; or
(iv) Ration Card; or
(v) Voter Identity Card; or
(vi) MGNREGA card; or
(vii) Kisan Photo passbook; or
(viii) Driving license issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or
(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or
(x) any other document as specified by the Ministry:
Provided further that the above documents may be checked by an officer specifically designated by the Ministry for that purpose.
2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Ministry through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through the media shall be given to the beneficiaries to make them aware of the requirement of Aadhaar under the Scheme.
3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:-
(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, and the Ministry through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;
[भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण 5(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;
(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One-Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response (QR) code printed on the Aadhaar letter and the necessary arrangement of QR code reader shall be provided at the convenient locations by the Ministry through its Implementing Agency.
4. In order to ensure that no bona fide beneficiary under the Scheme is deprived of his due benefits, the Ministry through its Implementing Agency shall follow the exception handling mechanism as specified in the Office Memorandum of Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India no. D-26011/04/2017-DBT, dated the 19th December 2017 (available on https://dbtbharat.gov.in/).
5. This notification shall come into effect on the date of its publication in the Official Gazette in all the States and Union territories, except the States of Assam and Meghalaya.
