सं. एडी-06/1/2018-प्रशा.—राष्ट्रपति, कार्मिक एवं प्रशिक्षण विभाग के आदेश संख्या 5/10/2020-सीएस.।(यू) दिनांक 21.12.2020 के क्रम में, निम्नलिखित अनुभाग अधिकारियों को उनके नाम के सामने उल्लिखित तारीख से कें द्रीय सचिवालय सेवा के ग्रेड-। (अवरसचिव) में पूर्णत: तदर्थ आधार पर वेतन मेट्रिक्स के स्तर-11 (रु. 67,700-2,08,700) में 30.06.2021 तक की अवधि के लिए अथवा इन पदों के नियमित आधार पर भरे जाने तक अथवा अगले आदेश होने तक, जो भी पहले हो, पदोन्नति प्रदान करते हैं :—

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 2] 2. उपरोक्त तदर्थ पदोन्नति, निम्नलिखित शर्तों के अध्यधीन होगी :—
i. तदर्थ पदोन्नति, निम्नलिखित न्यायालयी मामले में निर्णय के अध्यधीन होगी : —
(क) सिविल रिट याचिका (सीडब्ल्यूपी) सं. 13218/2009 में माननीय पंजाब एवं हरियाणा उच्च न्यायालय द्वारा पारित अंतिम निर्णय एवं आदेश दिनांक 15.07.2011 के परिणामस्वरूप दायर एसएलपी (सि) सं. 30621/2011 तथा माननीय सर्वोच्च न्यायालय में अन्य संबंधित मामले।
(ख) अखिल भारतीय समता मंच एवं अन्य बनाम भारत संघ एवं अन्य द्वारा दायर रिट याचिका (सि) सं. 3490/2010 में माननीय उच्च न्यायालय, दिल्ली द्वारा दिए गए निर्णय दिनांक 23.08.2017 के परिणामस्वरूप एसएलपी (सि) सं. 31288/2017
(ग) उच्च न्यायालय, दिल्ली द्वारा दिए गए निर्णय दिनांक 12.11.2018 के विरुद्ध एस.एन. जसरा एवं राज कु मार के संबंध में एसएलपी सं. 5724-5725/2019
(घ) कोई अन्य संबंधित न्यायालयी मामला।
ii. यह तदर्थ पदोन्नति, नियुक्त अधिकारियों को अनिश्चित अवधि तक अवरसचिव के ग्रेड में बने रहने अथवा उक्त ग्रेड में नियमित पदोन्नति के लिए चयन सूची में शामिल होने अथवा उक्त ग्रेड में वरिष्ठता का दावा करने के लिए कोई अधिकार प्रदान नहीं करती।
iii. तदर्थ आधार पर पदोन्नति की यह अवधि आरंभ में 30.06.2021 तक अथवा अगले आदेशों तक, जो भी पहले हो, होगी।
iv. तदर्थ आधार पर प्रदान की गई यह पदोन्नति, बिना कोई कारण बताए किसी भी समय समाप्त की जा सकती है।

No. AD-06/1/2018-Admin.—In pursuance of Department of Personnel and Training's Order No. 5/10/2020- CS.I(U) dated 21.12.2020, the President is pleased to promote following Section Officers to the Grade-I (Under Secretary) of CSS in the Pay Matrix level-11 (Rs. 67,700-2,08,700) purely on ad-hoc basis for a period up to 30.06.2021 or till the posts are filled up on regular basis or until further orders whichever is earlierw.e.f. the date shown against their names:—

2. The above 'ad-hoc' promotion is subject to the following conditions:—
i. The ad hoc promotion will remain subject to the outcome of the following Court Cases:
(a) The SLP (C) No.30621/2011 arising out of final judgement and order dated 15.07.2011 in CWP No.13218/2009 passed by the Hon'ble High Court of Punjab & Haryana and other tagged cases before the Hon'ble Supreme Court;

(b) The SLP (C) No.31288/2017 arising out of Hon'ble Delhi High Court Judgement dated 23.08.2017 in WP(C) No.3490/2010 filed by the All India Equality Forum & Others vs. UoI&Ors.
(c) The SLP Nos.5724-5725/2019 in respect of S.N. Jasra & Raj Kumar against Delhi High Court's judgement dated 12.11.2018.
(d) Any other connected court matter
ii. The ad hoc promotions shall not confer any right on the officers to continue in the grade of Under Secretary indefinitely or for inclusion in the Select List for regular promotion to the grade or to claim seniority in the grade.
iii. The ad hoc promotions shall be initially for a period upto 30.06.2021 or until further orders, whichever is earlier.
iv. The ad hoc promotions may be terminated at any point of time without giving any reason therefor.
