का.आ. 63(अ).-- यतः के न्द्रीय सरकार ने राष्ट्रीय राजमार्ग अधिनियम 1956 (1956 का 48) की धारा 5 के अधीन भारत सरकार के सड़क परिवहन एवं राजमार्ग मंत्रालय द्वारा जारी सूचना सं का आ, 394 (अ) तारीख 28 मई 1999 के द्वारा उत्तर प्रदेश में राजस्थान में पिडंवारा के निकट रा. रा. सं. 14 के साथ अपने संधि स्थल से प्रारंभ होकर उदयपुर, मांगरवाड, चितौडगढ, कोटा (रा. रा. सं. 12), शिवपुरी (रा. रा. सं. 3), झांसी (रा. रा. सं. 25), महोबा, बांदा, करवी, मउ, होते हुए उत्तर प्रदेश में इलाहाबाद के रा. रा. सं. 27 के साथ अपने संधि स्थल पर समाप्त होने वाला राजमार्ग को नया राष्ट्रीय राजमार्ग संख्या 76 घोषित करते हुए उत्तर प्रदेश राज्य का भाग उत्तर प्रदेश राज्य सरकार को सौपा है। अतः अब राष्ट्रीय राजमार्ग (दरों का अवधारण एवं संग्रहण) नियम, 2008 (जिसे इसमें पश्चात् नियम कहा गया है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कें द्रीय सरकार, एतद्द्वारा उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 76 डिजाइन कि.मी. 92.025 से 133.500 (वतर्मान कि.मी. 89.600 से 133.520) (हरपालपुर-सुगिरा रोड सेक्शन) तक के खंड के प्रयोग के लिए निम्नलिखित तालिका 1 के कालम (1) में विनिर्दिष्ट वाहनों के प्रकार पर 41.256 कि0मी0 दो लेन/पेव्ड शोल्डर सहित निवल सड़क खण्ड लम्बाई तथा स्ट्रेक्चर की समुतल्य लम्बाई 2.19 कि.मी. (0.219 किमी0 की संरचना जिसकी लम्बाई 60 मी0 से 94 GI/2021

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अधिक है) के लिए तालिका 1 के कालम (2) में विनिर्दिष्ट आधार दर के लिए 60% की दर पर यांत्रिक वाहन से फ़ीस उदगृहीत करती है तथा भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को उसके अधिकारियों अथवा किसी ठेके दार के माध्यम से उक्त फ़ीस के संग्रहण के लिए प्राधिकृ त करती है, अर्थात्:-

1. इसके अंतर्गत उदगृहीत और संग्रहीत की जाने वाली फ़ीस ऐसे पथकर प्लाजा के लिए विनिर्दिष्ट सड़क लंबाई हेतु पथकर प्लाजा पर देय और संदेह होगी, अर्थात:-

2. उपयुक्त के अतरिक्त, निम्नलिखित टोल प्लाजा (प्लाजाओं) पर 60 मीटर से अधिक लंबाई वाली अवसंरचनाओ के उपयोग के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओ की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओ की लंबाई को परिवर्तित करके निम्नलिखित फ़ीस भी देय और संदेय होगी:-

संरचनाओ (>60 मीटर लंबाई) का ब्यौरा निम्नानुसार है:-

3. जिस व्यक्ति का अपना यांत्रिक वाहन गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त हुआ हो और वह टोल प्लाजा से 20 कि0मी0 तक की दूरी में ही रहता हो, उसके लिए वर्ष 2020-21 के लिए मासिक पास की दर 275.00 रुपये (दो सौ पचहत्तर रुपए मात्र) होगी और यह नियमावली के अनुसार प्रत्येक वर्ष संशोधन किया जायेगा।

4. राजमार्ग खंड पर बहुयात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्

5. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृ त वाणिज्यक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए विनिर्दिष्ट शुल्क का 50 प्रतिशत होगा, बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड या वैकल्पिक सड़क उपलब्ध न हों।

6. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक अथवा मालिक अथवा प्रभारी व्यक्ति को ऐसे अधिक भार लदे हुए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संग्रहण एजेंसी को नियम - 10 के उपनियम 1 ए में विनिर्दिष्ट के अनुसार शुल्क का भुकतान करना होगा और उसे राजमार्ग खण्ड का उपयोग करने की तक तक अनुमति नहीं होगी, जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा नहीं दिया जायें।

7. यांत्रिक वाहनों की श्रेणी, उनके लिए निर्धारित अनुज्ञेय भार छू ट प्राप्त वाहनों की श्रेणी, सर्विस रोड़ वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होगी।

8. उक्त नियमों के नियम - 12 के अनुसार उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जायेगा।

9. ऊपर सारिणी - 1 में यथा उल्लिखित आधार वर्ष 2007-2008 के लिए प्रति कि0मी0 शुल्क की आधार दर के आधार दर पर यांत्रिक वाहनों से लिए जाने वाले वास्तविक शुल्क और छू ट की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खण्ड की पूरी कर ली गई लम्बाई के आधार पर की जायेगी, उक्त नियमों के नियम-5 के अनुसार वार्षिक तौर पर संशोधन किया जायेगा तथा उसे तदनुसार अंग्रेजी और स्थानीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित करवाया जायेगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 10. परियोजना की अनुमानित पू

ंजीगत लागत रु. 208.50 करोड़ है। पू

ंजीगत लागत में परिवर्तन हो सकता है क्योंकि भूमि अर्जन, जनयोगिता सेवाओं का स्थान बदलने, पेड़ों की कटाई आदि जैसे क्रियाकलाप अभी पूरे किये जाने है। अंतिम पू ंजीगत लागत अलग से अधिसूचित की जायेगी। भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा वसूल किये गये प्रयोक्ताशुल्क के जरिये पू ंजीगत लागत की वसूली का रिकार्ड रखा जायेगा। और पू ंजीगत लागत की वसूली के बाद लगाये जाने शुल्क की दरों को 40 प्रतिशत कर दिया जायेगा और उक्त नियमों के अनुसार इसमे वार्षिक तौर पर संशोधन किया जायेगा।

NOTIFICATION

New Delhi, the 6th January, 2021

S.O. 63(E)—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 394 (E), the 28th May, 1999, issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has declared the stretch of the highway starting from its junction with NH No. 14 near Pindwara in Rajasthan and connecting Udaipur, Mangarwar, Chittaurgarh, Kota (NH No. 12), Shivpuri (NH No. 3), Jhansi (NH No.25), Mahoba, Banda, Karwi, Mau and terminating at its junction with NH No. 27 near Allahabad in Uttar Pradesh as NH-76 and entrusted the Uttar Pradesh portion of NH-76 to the State Government of Uttar Pradesh.

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "Rules"), the Central Government hereby levies the fee on mechanical vehicles at 60% of the base rate specified in column (2) of the Table 1 for net road section length of 41.256 km and for equivalent structure length (having length more than 60m) of 2.19 Km (having length of Major Bridges 0.219 km) on the type of vehicles specified in column (1) of Table 1 below of two lane with paved shoulders Harpalpur-Sugira section from design Km 92.025 to 133.500 (existing km 89.600 to 133.520) on the National Highways No. 76 in the state of Uttar Pradesh and authorizes the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plazas for the net road length specified for such Fee Plaza, namely :-

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza, by converting the length of the structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10 at the base rate mentioned in Table-1 above: -

The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 275.00 (Rupees two hundred & seventy five only) for the year 2020-21, and is subject to revision every year as per the provisions of the said rules.

4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:-

5. Fee for commercial vehicle (excluding vehicles plying under National permits) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highways section unless the excess load has been removed from such mechanical vehicle.

7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rules.

8. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said rules.

9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.

10. The estimated capital cost of the project is Rs. 208.50 Cr. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed and the final capital cost will be notified separately.] The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee livable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
