भारतीय प्रतिभूति और विनिमय बोर्ड
[विनिधान (निवेश) सलाहकार] (संशोधन) विनियम, 2021
सं. सेबी/एल.ए.डी.-एन.आर.ओ./जी.एन./2021/04.—बोर्ड, भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 (1992 का 15) की धारा 11 की उप-धारा (2) के खंड (ख) के साथ पठित धारा 30 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतद्द्वारा भारतीय प्रतिभूति और विनिमय बोर्ड [विनिधान (निवेश) सलाहकार] विनियम, 2013 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात्,-
1. इन विनियमों को भारतीय प्रतिभूति और विनिमय बोर्ड [विनिधान (निवेश) सलाहकार] (संशोधन) विनियम, 2021 कहा जा सके गा ।
2. वे राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त (लागू) होंगे ।
3. भारतीय प्रतिभूति और विनिमय बोर्ड [विनिधान (निवेश) सलाहकार] विनियम, 2013 में,-
I. विनियम 6 के खंड (ड) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्, - "(ढ) क्या आवेदक विनियम 14 के तहत यथा निर्धारित मान्यताप्राप्त निकाय (बॉडी) या निगमित निकाय (बॉडी कारपोरेट) का सदस्य है:

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु यह कि मौजूदा निवेश सलाहकार इस खंड के तहत दी हुई अपेक्षा का उसी प्रकार पालन करेंगे जैसा बोर्ड द्वारा निर्धारित किया जाए ।"
II. दूसरी अनुसूची में, -
i. खंड 1 में,
क. उप-खंड (क) निम्नलिखित से प्रतिस्थापित हो जाएगा, अर्थात्, -
"एकल (इंडविजुअल) की श्रेणी में आने वालों तथा फर्मों हेतु : ` 2,000"
ख. उप-खंड (ख) निम्नलिखित से प्रतिस्थापित हो जाएगा, अर्थात्, -
"निगमित निकाय (बॉडी कारपोरेट) [जिसमें सीमित दायित्व भागीदारियाँ (लिमिटेड लायबिलिटी पार्टनरशिप) शामिल हैं] हेतु : ` 10,000"
ii. खंड 2 निम्नलिखित से प्रतिस्थापित हो जाएगा, अर्थात्,-
"2. प्रत्येक आवेदक बोर्ड द्वारा प्रमाणपत्र प्रदान किए जाने के समय रजिस्ट्रीकरण फीस निम्नानुसार अदा करेगा:
क. एकल (इंडविजुअल) की श्रेणी में आने वालों तथा फर्मों हेतु : ` 3,000 ख. निगमित निकाय (बॉडी कारपोरेट) [जिसमें सीमित दायित्व भागीदारियाँ (लिमिटेड लायबिलिटी पार्टनरशिप) शामिल हैं] हेतु : ` 15,000"
iii. खंड 3 निम्नलिखित से प्रतिस्थापित हो जाएगा, अर्थात्, –
"3. जिस निवेश सलाहकार को रजिस्ट्रीकरण प्रमाणपत्र प्रदान किया गया हो, वह अपना रजिस्ट्रीकरण प्रवृत्त (लागू) रखने के लिए, यथास्थिति, रजिस्ट्रीकरण प्रमाणपत्र प्रदान किए जाने की तारीख से या भारतीय प्रतिभूति और विनिमय बोर्ड [कुछ मध्यवतियों (इंटरमीडियरीज़) के रजिस्ट्रीकरण की शर्तों में परिवर्तन] (संशोधन) विनियम, 2016 के प्रारंभ से पूर्व प्रदान किए गए रजिस्ट्रीकरण प्रमाणपत्र की तारीख से, प्रत्येक पांच वर्षों हेतु निम्नानुसार निर्धारित फीस उस अवधि के समाप्त होने से पूर्व तीन महीनों के भीतर अदा करेगा, जिस अवधि के लिए फीस अदा की जा चुकी हो :
(क) एकल (इंडविजुअल) की श्रेणी में आने वालों तथा फर्मों हेतु : ` 1,000 (ख) निगमित निकाय (बॉडी कारपोरेट) [जिसमें सीमित दायित्व भागीदारियाँ (लिमिटेड लायबिलिटी पार्टनरशिप) शामिल हैं] हेतु : ` 5,000"

(2) 8 दिसम्बर, 2016 को भारतीय प्रतिभूति और विनिमय बोर्ड [कु छ मध्यवतियों (इंटरमीडियरीज़) के रजिस्ट्रीकरण की शर्तों में परिवर्तन] (संशोधन) विनियम 2016, सं. सेबी/एल.ए.डी.-एन.आर.ओ./जी.एन./2016-17/023, द्वारा [भाग III—खण्ड 4] भारत का राजपत्र : असाधारण 3 (3) 17 अप्रैल, 2020 को भारतीय प्रतिभूति और विनिमय बोर्ड (रेग्यूलेटरी सैंडबॉक्स) (संशोधन) विनियम 2020, सं. सेबी/एल.ए.डी.-एनआरओ/जीएन/2020/10, द्वारा
(4) 3 जुलाई, 2020 को भारतीय प्रतिभूति और विनिमय बोर्ड [विनिधान (निवेश) सलाहकार] (संशोधन) विनियम, 2020, सं. सेबी/एल.ए.डी.-एन.आर.ओ./जी.एन./2020/22, द्वारा संशोधित हुए थे ।

SECURITIES AND EXCHANGE BOARD OF INDIA (INVESTMENT ADVISERS)
(AMENDMENT) REGULATIONS, 2021
No. SEBI/LAD-NRO/GN/2021/04.—In exercise of the powers conferred by sub-section (1) of section 30 read with clause (b) of sub-section (2) of section 11 of the Securities and Exchange Board of India Act, 1992 (15 of 1992), the Board hereby makes the following regulations to further amend the Securities and Exchange Board of India (Investment Advisers) Regulations, 2013, namely, –
1. These Regulations may be called the Securities and Exchange Board of India (Investment Advisers) (Amendment) Regulations, 2021.
2. They shall come into force on the date of their publication in the Official Gazette
3. In the Securities and Exchange Board of India (Investment Advisers) Regulations, 2013, - I. after clause (m) of regulation 6, the following clause shall be inserted, namely, - "(n) Whether the applicant is a member of a recognized body or body corporate as specified under regulation 14:
Provided that the existing investment advisers shall comply with the requirement under
this clause in such manner as may be specified by the Board."
II. in the Second Schedule, -
i. in clause 1,
a. sub-clause (a) shall be substituted with the following, namely, -
"For individuals and firms: ₹ 2,000"
b. sub-clause (b) shall be substituted with the following, namely, -
"For body Corporate including Limited Liability Partnerships:
₹ 10,000"
ii. clause 2 shall be substituted with the following, namely,-
―2. Every applicant shall pay registration fee at the time of grant of certificate by the Board as under:
a. For individuals and firms: ₹ 3,000
b. For body Corporate including Limited Liability Partnerships:
₹ 15,000"
iii. in clause 3,
a. the words "prescribed at paragraph 2 above" shall be substituted with
the words and symbol "specified below,"
b. after the words "has been paid", the symbol "." shall be substituted
with the symbol ":"4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] c. after the newly inserted ":", the following sub-clauses shall be inserted,
namely, -
"(a) for individuals and firms: ₹ 1,000
(b) for Body Corporate including Limited Liability Partnerships:
₹ 5,000"
