भारतीय प्रतिभूति और विनिमय बोर्ड (बाजार सहभागियों के के न्द्रीय डाटाबेस) विनियम, 2003 के निरसन से संबंधित अधिसूचना

सं. सेबी/एलएडी-एनआरओ/जीएन/2021/05.—भारतीय प्रतिभूति और विनिमय बोर्ड, भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 (1992 का 15) की धारा 30 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्द्वारा भारतीय प्रतिभूति और विनिमय बोर्ड (बाजार सहभागियों के के न्द्रीय डाटाबेस) विनियम, 2003 (जो भारत के राजपत्र, असाधारण, भाग III - खण्ड 4 में, तारीख 20 नवम्बर, 2003 की भारतीय प्रतिभूति और विनिमय बोर्ड की अधिसूचना फा.सं. भाप्रविबो/विधि/26/2003 द्वारा, प्रकाशित हुए थे) को तुरंत प्रभाव से निरसित करता है । 1. उपरोक्त विनियमों के निरसित होने से -

(i) उपरोक्त विनियमों के पूर्व प्रवर्तन अथवा उनके तहत की गई किसी भी बात आदि या न की गई किसी भी बात आदि;

(ii) उपरोक्त विनियमों के तहत अर्जित या प्रोद्भूत या उपगत किसी अधिकार, विशेषाधिकार, बाध्यता या दायित्व; 174 GI/2021 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (iii) उपरोक्त विनियमों के अनुसार किए गए किसी उल्लंघन या अपराध के संबंध में लगाई गई किसी शास्ति (पेनल्टी) या दिए गए किसी दंड;

(iv) उपरोक्तानुसार किसी ऐसे अधिकार, विशेषाधिकार, बाध्यता, दायित्व, शास्ति (पेनल्टी) या दंड की बाबत किसी अन्वेषण (इन्वेस्टिगेशन), कानूनी कार्यवाही या उपचार,

पर कोई असर नहीं पड़ेगा ।

2. ऐसा कोई अन्वेषण (इन्वेस्टिगेशन), कानूनी कार्यवाही या उपचार किया जा सके गा, उसे जारी रखा जा सके गा या उसे लागू कराया जा सके गा, और ऐसी कोई शास्ति (पेनल्टी) लगाई जा सके गी या ऐसा कोई दंड दिया जा सके गा, मानो कि उपरोक्त विनियम निरसित ही न हुए हों ।

NOTIFICATION

Notification repealing the Securities and Exchange Board of India (Central Database of Market Participants)

Regulations, 2003

No. SEBI/LAD-NRO/GN/2021/05—In exercise of the powers conferred by Section 30 of the Securities and Exchange Board of India Act, 1992 (15 of 1992), the Securities and Exchange Board of India hereby repeals with immediate effect the Securities and Exchange Board of India (Central Database of Market Participants) Regulations, 2003 published in Part-III, Section 4 of the Gazette of India, Extraordinary, under notification of the Securities and Exchange Board of India number F. No. SEBI/LE/26/2003 dated the 20th November, 2003.

1. The repeal of the said regulations shall not affect—

(i) the previous operation of the said regulations or anything done or omitted to be done or suffered therein;

(ii) any right, privilege, obligation or liability acquired or accrued or incurred under the said regulations;

(iii) any penalty or punishment incurred in respect of any contravention or offence committed under the said regulations;

(iv) any investigation, legal proceedings or remedy in respect of any such right, privilege, obligation, liability, penalty or punishment as aforesaid.

2. Any such investigation, legal proceeding or remedy may be instituted, continued or enforced and any such penalty or punishment may be imposed as if the said regulations had not been repealed.
