का.आ. 280(अ).— यतः, के न्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का. आ. सं. 386(अ) तारीख 16 फरवरी 2010 द्वारा उत्तराखंड राज्य में रारा-58 के 152.00 कि.मी. से 218.200 कि.मी. (उत्तरप्रदेश / उत्तराखंड सीमा से हरिद्वार-नेपाली फार्म खंड) भारतीय राष्ट्रीय राजमार्ग प्राधिकारण (जिसे इसमें इसके पश्चात "प्राधिकरण" कहा गया है) को सौंपा है;

अतः अब, के न्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क दरों का अवधारण एवं संग्रहण नियम, 2008 (जिसे इसमें इसके पश्चात "नियम'' कहा गया है, के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उत्तराखंड राज्य में राष्ट्रीय राजमार्ग संख्या – 58 (नया रारा-334) के मुजफ्फरपुर–हरिद्वार सेक्शन के डिजाइन कि.मी. 166.000 से कि.मी. 209.120 (विद्यमान कि.मी. 166.000 से कि.मी. 211.000) के चार तथा अधिक लेन के उपयोग हेतु सड़क खंड की निवल लंबाई 24.471 कि.मी. और 19.000 कि.मी.

लंबाई (जिसकी लंबाई 1.900 कि.मी. है) की समकक्ष संरचना (जिनकी लंबाई 60 मी. से अधिक है) के लिए यांत्रिक वाहनो पर सारणी (1) के स्तम्भ (2) में विनिर्दिष्ट दर के 100% की दर और 5.250 कि.मी. (जिनकी लंबाई 0.525 कि.मी. है) की समकक्ष संरचना (जिनकी लंबाई 60 मी. से अधिक है) के लिए सारणी (1) के कॉलम (2) में विनिर्दिष्ट आधार दरों के 60% 386 GI/2021

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पर और बाइपासों जिनकी लंबाई 16.224 कि.मी. और लागत दस करोड़ रुपये या अधिक है, के उपयोग हेतु नीचे सारणी (1) के स्तम्भ (1) में विनिर्दिष्ट प्रकार के वाहनों पर आधार दर के 150% पर शुल्क उद्ग्रहीत करती है एवं प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क को संग्रहीत करने के लिए प्राधिकृ त करती है , अर्थात :-

1. नीचे उद्ग्रहीत एवं संग्रहीत शुल्क, निम्नलिखित शुल्क प्लाजा पर, ऐसे शुल्क प्लाजा के लिए विनिर्दिष्ट सड़क की निवल लम्बाई हेतु शोध्य और संदेय होगाः

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित बाइपास जिनकी लागत 10 करोड़ रुपए अथवा अधिक है, के उपयोग के लिए निम्नलिखित शुल्क प्लाजा पर ऐसे शुल्क प्लाजा के लिए विनिर्दिष्ट बाइपास की निवल लम्बाई हेतु निम्नलिखित शुल्क भी शोध्य और संदेय होगा :

3. उपयु र्क्त के अतिरिक्त, निम्नलिखित संरचनाओं, जिनकी लम्बाई 60 मीटर से अधिक है, के उपयोग के लिए ऐसी संरचनाओं की लम्बाई को समकरण गुणक 10 से गुणा करके राजमार्ग की समकक्ष लम्बाई में परिवर्तित करते हुए, निम्नलिखित शुल्क प्लाज़ा(ओं) पर, निम्नलिखित शुल्क भी शोध्य और संदेय होगाः

4. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त हुआ हो और वह शुल्क प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता हो, उसके लिए वर्ष 2020-2021 के लिए मासिक पास की दर 275.00/- रूपए (दो सौ पचहत्तर रूपए मात्र) होगी और उक्त नियमों के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा।

5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्ः 5 [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण

6. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृ त वाणिज्यिक वाहन ) राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर (के लिए शुल्क उस श्रेणी के लिए वाहन के लिए विनिर्दिष्ट शुल्क का 50% होगा बशर्ते के ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो।

7. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक अथवा मालिक अथवा प्रभारी व्यक्ति को ऐसे अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संग्रहण एजेंसी को उक्त नियमों के नियम 10 के उपनियम 1 ए के अनुसार शुल्क का भुगतान करना होगा और उसे राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए।

8. यांत्रिक वाहनों की श्रेणी, उनके लिए अनुज्ञेय भार, छू ट-प्राप्त वाहनों की श्रेणी, सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी।

9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा।

10. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जाने वाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा खंडों की पूरी कर ली गई लम्बाई के आधार पर की जायेगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक तौर पर संशोधन किया जाएगा तथा उसे, तदनुसार, अंग्रेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।

11. इस परियोजना की अनुमानित पू ंजीगत लागत 1376 करोड़ रुपए है। पू ंजी लागत में परिवर्तन हो सकता है क्योंकि भूमि अर्जन, जन – उपयोगिता स्थान बदलने , बदलने , पेड़ों की कटाई आदि जैसे क्रियाकलाप अभी पूरे किए जाने शेष हैं। अंतिम पू ंजीगत लागत को अलग से अधिसूचित किया जाएगा। प्राधिकरण द्वारा प्रयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पू ंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पू ंजीगत लागत की वसूली हो जाने के पश्चात, लगाए जाने वाले शुल्क की दरों को घटाकर 40% कर दिया जाएगा और उक्त नियमों के अनुसार इस में वार्षिक तौर पर संशोधन किया जाएगा।

NOTIFICATION

New Delhi, the 20th January, 2021

S.O. 280(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 386(E) dated the 16th February 2010 issued under Section 11 of the National Highway Authority of India Act 1988 ( 68 to 1988) , the Central Government has entrusted the stretch from kilometer 152.00 to kilometer 218.200 (Uttar Pradesh/Uttarakhand Border to Haridwar-Nepali Farm section) of National Highway No.58 in the state of Uttarakhand to the National Highways Authority of India (hereinafter referred to as the "Authority");

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table 1 at 100% of the base rate for net road section length of 24.471 km for the use of four and more alone section and for equivalent structure length (having length more than 60m) of 19.000 km (having length of 1.900 km) and at 60% of the base rate specified in column (2) of the Table 1 for equivalent structure length (having length more than 60m) of 5.250 km (having length of 0.525 km) and at one and one half times the base rate for bypasses having length of 16.224 km costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below of Muzaffarnagar-Haridwar section from design kilometer 166.000 to kilometer 209.120 ( existing km 166.000 to km 211.000) of National Highway number 58 ( New NH-334) in the State of Uttarakhand and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalisation factor of 10: -

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 275.000 (Two Hundred and Seventy-Five Only) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules.

5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: -

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.

9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.

10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.

11. The estimated capital cost of the project is Rupees 1376 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
