सा.का.नि. 47(अ).- कें द्रीय सरकार, पर्यावरण (संरक्षण) अधिनियम, 1986 (1986 का 29) की धारा 6, 8, और 25 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, परिसंकटमय और अन्य अपशिष्ट (प्रबंधन और सीमापारीय संचलन) नियम, 2016 में संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभ -
(1) इन नियमों का नाम परिसंकटमय और अन्य अपशिष्ट (प्रबंधन और सीमापारीय संचलन) संशोधन नियम, 2021 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे।
2. परिसंकटमय और अन्य अपशिष्ट (प्रबधन और सीमापारीय संचलन) नियम, 2016 (जिन् हें इसमें इसके पश्चात् उक्त नियम कहा गया है) में :-
(क) नियम 12 के उप-नियम (6) के पश्चात् निम्नलिखित अंत:स्थापित किया जाएगा, अर्थात् :-
"6क. अनुसूची VI में बेसल संख्या ख3010 के सामने स्तंभ (2) में उल्लिखित अनुसार कें द्रीय सरकार द्वारा अधिसूचित विशेष आर्थिक जोन में अवस्थित और निर्यातोन्मुख इकाइयों के लिए 'पश्च-औद्योगिक या पूर्व- उपभोक्ता पॉलिइथीलीन अपशिष्ट' और 'पॉलीमिथाइल मीथाक्राइलेट के आयात की अनुमति है।

'पश्च-औद्योगिक या पूर्व-उपभोक्ता पॉलिइथीलीन अपशिष्ट' के आयात के लिए, इस अधिसूचना की तारीख से 18 माह के लिए या ऐसे आयात के प्रभाव का निर्धारण करने के लिए की गई समीक्षा या लेखा परीक्षा, जो भी बाद में हो, के आधार पर कोई निर्णय लिए जाने तक टन-भार के संदर्भ में न्यूनतम पचास प्रतिशत निर्यात की अपेक्षा से, अनुमति होगी।"
(ख) उक्त नियमों की अनुसूची ।।। के भाग ख में बेसल संख्या ख3 और तत्स्थानी प्रविष्टियों के पश्चात् निम्नलिखित क्रम संख्या और प्रविष्टियां अन्त:स्थापित की जाएंगी, अर्थात् :-

(ग) उक्त नियमों की अनुसूची ।।। के भाग ख में बेसल संख्या ख3030 और ख3035 और तत्स्थानी प्रविष्टियों का लोप किया जाएगा;
(घ) उक्त नियमों की अनुसूची ।।। के भाग घ में बेसल संख्या ख3020 और तत्स्थानी प्रविष्टियों के पश्चात् निम्नलिखित क्रम संख्या और प्रविष्टियों अन्त:स्थापित की जाएंगी :-

NOTIFICATION
New Delhi, the 27th January, 2021
G.S.R. 47(E).—In exercise of the powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules further to amend the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, namely:-
1. Short title and commencement -
(1) These rules may be called the Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 (hereafter in this notification referred to as the said rules): -
(a) in rule 12, after sub-rule (6), the following sub-rule shall be inserted, namely: -
"6A. The import of 'post-industrial or pre-consumer polyethylene wastes' and 'Polymethyl Methacrylate' mentioned at column (2), against Basel Number B3010 in Schedule VI, is permitted to units in Special Economic Zones and Export Oriented Units notified by the Central Government.
6B. the import of 'post-industrial or pre-consumer polyethylene wastes' shall be permitted with a requirement of at least fifty percent exports in terms of tonnage for 18 months from the date of this notification or till a decision is taken on the basis of review or audit undertaken to ascertain the effect of such import, whichever is later.";
(b) in the said rules, in Schedule III, in Part B, after Basel number B3 and the entries relating thereto the following serial number and entries shall be inserted, namely: -

(c) in the said rules, in Schedule III, in Part B, the Basel Number B3030 and B3035 and the entries relating thereto shall be omitted;
