का.आ. 2579(अ).—जबकि, विदेशी मुद्रा संरक्षण और तस्करी गतिविधि निवारण अधिनियम, 1974(1974 का 52) की धारा 3 की उप-धारा (1) के तहत विशेष रूप से अधिकार प्राप्त संयुक्त सचिव, भारत सरकार द्वारा उक्त उप-धारा के तहत दिनांक 29.01.2021 को जारी आदेश सं.पीडी-12001/08/2021- कोफे पोसा में यह निदेश दिया गया था कि श्री राके श कु मार, सुपुत्र स्व. श्री जगदीश कु मार, निवासी मकान सं. 50/1, न्यू दसमेस नगर, वार्ड नं. 1, राजपुरा, जिला- पटियाला, पंजाब-140401 को हिरासत में लिया जाए और तिहाड़ जेल, नई दिल्ली में रखा जाए ताकि भविष्य में उन्हें माल की तस्करी करने, माल की तस्करी को बढावा देने और तस्करी के माल का परिवहन करने या छु पाने या रखने से रोका जा सके ।
2. जबकि के न्द्र सरकार के पास यह विश्वास करने के कारण हैं कि पूर्वोक्त व्यक्ति भगोड़ा है या अपने को छिपाए हुए है ताकि आदेश का पालन न किया जा सके ।
3. अत: अब, उक्त अधिनियम की धारा 7 की उप-धारा (1) के खंड (ख) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्र सरकार एतद् द्वारा पूर्वोक्त व्यक्ति को निदेश देती है कि सरकारी राजपत्र में इस आदेश के प्रकाशन की तारीख से 7 दिन के अंदर वह पुलिस महानिदेशक, पंजाब सरकार, चंडीगढ़ के सामने उपस्थित हो। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF FINANCE (Department of Revenue)

ORDER
New Delhi, the 25th June, 2021
S.O. 2579(E).—Whereas the Joint Secretary to the Government of India, specially empowered under sub-section (1) of Section 3 of the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974 (52 of 1974) issued Order No. PD-12001/08/2021-COFEPOSA dated 29.01.2021 under the said sub-section directing that Shri Rakesh Kumar, S/o Late Shri Jagdish Kumar, R/o House No. 50/1, New Dashmes Nagar, Ward No.1, Rajpura, District- Patiala, Punjab-140401 be detained and kept in Tihar Jail, New Delhi with a view to prevent him from smuggling goods, abetting the smuggling of goods and engaging in transporting or concealing or keeping smuggled goods in future.
2. Whereas the Central Government has reasons to believe that the aforesaid person has absconded or has been concealing himself so that the Order cannot be executed.
3. Now, therefore, in exercise of the powers conferred by clause (b) of sub-section (1) of Section 7 of the said Act, the Central Government hereby directs the aforesaid person to appear before the Director General of Police, Government of Punjab, Chandigarh within 7 days of the publication of this Order in the Official Gazette.
