.-जबकि, केन्द्र सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का.आ. 4580(ई), दिनांकित 17 दिसंबर, 2020 के द्वारा मध्य प्रदेश राज्य में स्थित राष्ट्रीय राजमार्ग-12 [(किमी 315.725 से किमी 421.325 को छोड़कर (भोपाल-ब्यावरा खण्ड)] को मध्य प्रदेश राज्य सरकार को सुपुर्द कर दिया है।

अतः अब, राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संग्रहण) नियम, 2008 (जो इसके आगे ''नियम'' के रूप में उल्लिखित है) के नियम 3 के साथ पठित, राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार, एतदद्वारा मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग-12 के जबलपुर से हिरन नदी खंड के डिजाइन कि.मी. 10.400 से कि.मी. 66.000 (मौजूदा कि.मी. 10.400 से कि.मी. 66.400) तक खंड केे प्रयोग के लिए निम्नलिखित तालिका 1 के कॉलम (1) में विनिर्दिष्ट वाहनों के प्रकार पर 55.2245 कि.मी. के निवल सड़क खंड लंबाई और 3.755 कि.मी. (0.3755 कि.मी. लंबाई वाले) समतुल्य संरचना लंबाई (60 मीटर से अधिक की लंबाई) के लिए तालिका 1 के कॉलम (2) में विनिर्दिष्ट दर से यांत्रिक वाहन से फीस उदगृहीत करती है तथा भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को उसके अधिकारियों अथवा किसी ठेकेदार के माध्यम से उक्त फीस के संग्रहण के लिए प्राधिकृत करती है, अर्थात्‌ः-

1. इसके अंतर्गत उद्‌गृहीत और संगृहीत की जाने वाली फीस ऐसे पथकर प्लाजा के लिए विनिर्दिष्ट निवल सड़क लंबाई हेतु पथकर प्लाजा पर देय और संदेय होगी, अर्थात्‌ः-

2. उपर्युक्त के अतिरिक्त, निम्नलिखित पथकर प्लाजा पर 60 मीटर से अधिक लंबाई वाली निम्नलिखित अवसंरचनाओं के उपयोग के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को परिवर्तित करके निम्नलिखित फीस भी देय और संदेय होगीः-

3. गैर- वाणिज्यिक प्रयोजनों के लिए पंजीकृत यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किमी की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2020-21 के लिए 275.00 रू. (दो सौ पछत्तर रूपए मात्र) है और यह उक्त नियमों के उपबंधों के अनुसार प्रत्येक वर्ष संशोधन के अध्यधीन है।

4. राजमार्ग खंड पर बहुल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्‌3 [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण

5. फीस प्लाजा स्थित होने वाले जिले में पंजीकृत वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोडकर) के लिए फीस उस श्रेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशर्ते कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई सर्विस रोड या वैकल्पिक सड़क उपलब्ध न हों।

6. संबंधित श्रेणी के वाहनों के लिए विनिर्दिष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी के ऐसी श्रेणी के वाहनों के लिए उक्त नियमों के नियम 10 के उप-नियम 1क में विनिर्दिष्ट फीस के समतुल्य फीस का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहीं होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहीं जाता।

7. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्विस रोड, वैकल्पिक सड़क इत्यादि उक्त नियमों में विनिर्दिष्ट परिभाषाओं के अनुरूप होंगी।

8. फीस की दरें उक्त नियमों के नियम 12 के अनुसरण में प्रयोक्ताओं के सूचनार्थ प्रदर्शित करनी होंगी। 9. यांत्रिक वाहनों से फीस की वास्तविक राशि उपर्युक्त तालिका-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी फीस की आधार दर के आधार पर प्रभारित होगी और छूटों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंग्रेजी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा। 10. परियोजना की अनुमानित पूंजीगत लागत 628.45 करोड़ रू. है। [चूंकि भूमि अधिग्रहण, सार्वजनिक जन सुविधाओं के अंतरण, पेडों को काटने आदि कार्यकलापों को अभी पूरा किया जाना है इसलिए पूंजीगत लागत परिवर्तन के अध्यधीन है और अंतिम पूंजीगत लागत को पृथक रूप से अधिसूचित किया जाएगा] प्राप्त प्रयोक्ता फीस के माध्यम से वसूल की गई पूंजीगत लागत का भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा रिकार्ड रखा जाएगा तथा पूंजीगत लागत की वसूली के पश्चात्‌ उदग्राह्य फीस घटाकर दरों के 40% तक कर दी जाएगी और कथित नियमों के अनुसरण में वार्षिक रूप से संशोधित की जाएगी।

NOTIFICATION

New Delhi, the 21st June, 2021

S.O. 2585(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways S.O 4580(E) dated 17th December 2020, issued under Section 5 of the National Highways Act,1956(48 of 1956), the Central Government has entrusted the National Highway 12 [excluding from km 315.725 to km.421.325 (Bhopal-Bioara Section)] in the state of Madhya Pradesh to the State Government of Madhya Pradesh;

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules 2008, (hereinafter referred to as the 'rules'), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in the column (2) of the table 1 for net road section length of 55.2245 km and for equivalent structure length of 3.755 Km (having length more than 60m) (having length of 0.3755km) on the type of vehicles specified in column (1) of the table 1 below of Jabalpur-Hiran River Section from design kilometer 10.400 to kilometer 66.000 (existing km10.400 to km 66.400) of National Highway number 12 (New National Highway - 45) in the state of Madhya Pradesh and authorizes the National Highways Authority of India to collect, either through its officials or through a contractor, the said free, namely:—

1. The fee to be levied and collected hereunder shall be due and payable at the following Fee Plazas for the distance specified for each such Fee Plaza:

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60 m at the following Fee Plaza, by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:.

The rate of the monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs 275.00 (Rs Two hundred seventy Five) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules

4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:—

5. Fee for the commercial vehicle (excluding vehicles playing under national permit) registered in the district where the fee plaza falls shall be 50% of the specified rate that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the over loaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

7. All the definitions including category of mechanical vehicles, its permission load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.

8. The fee rate shall be displayed for information of the users in accordance with rule 12 of the said rules.

9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discount will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and same shall be published in at least one newspaper in English and vernacular language.

10. The estimated Capital cost of the project is Rupees 628.45 crore {The capital cost is subject to variation as the activities of the land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduce to 40% of the rates and shall be revised annually in accordance with the said rules.
