सा.का.नि. 439(अ).— कें द्रीय मोटर यान नियमावली, 1989 निम्नलिखित कतिपय प्रारूप नियमों में, जिसे कें द्रीय सरकार, मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और संशोधन करने का प्रस्ताव करती है, जिसे एतद्द्वारा उक्त अधिनियम की धारा 212 की उप-धारा (1) द्वारा यथापेक्षित उनके द्वारा संभाव्य सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है और एतद् दद्वारा नोटिस दिया जाता है कि उक्त प्रारूप नियमों पर उस तारीख से जब इस अधिसूचना की प्रतियां, भारत के राजपत्र में यथाप्रकाशित, आम जनता को उपलब्ध कराई जाती हैं, से तीस दिन की अवधि की समाप्ति के पश्चात विचार किया जाएगा।
इन प्रारूप नियमों संबंधित आक्षेप या सुझाव, यदि कोई हों, संयुक्त सचिव (एमवीएल, परिवहन, टोल), सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, संसद मार्ग, नई दिल्ली-110001 को भेजे जा सकें गे अथवा comments- [email protected]; पर ई-मेल किए जा सकें गे।
उक्त प्रारूप नियमों के बारे में आक्षेप या सुझाव, जो किसी व्यक्ति से उक्त प्रारूप नियमों के संबंध में इस प्रकार विनिर्दिष्ट अवधि की समाप्ति के भीतर प्राप्त किए जाते हैं, पर कें द्रीय सरकार द्वारा विचार किया जाएगा। 3536 GI/2021

प्रारूप नियम
1. संक्षिप्त शीर्षक और प्रारंभ - (1) इन नियमों को कें द्रीय मोटर यान (....... संशोधन) नियम, 2021 कहा जा सकता है। (2) ये नियम सरकारी राजपत्र में इनके अंतिम प्रकाशन की तारीख से लागू होंगे।
2. कें द्रीय मोटर यान नियम, 1989 (इसमें मूल नियम के रूप में उल्लिखित है) के नियम 115 में, -
(i) उप-नियम (18) के खंड (i) में, -
1. 'तालिका 2' के पश्चात् दी गई 'टिप्पणियों' में क्रमांक (21) के पश्चात् निम्नलिखित क्रम संख्या को अंत:स्थापित किया जाएगा, अर्थात्:-
"(22) द्वि-ईंधन वाहनों के लिए, रेफरेंस गैसोलीन ईंधन विनिर्माता द्वारा अनुमोदन के दौरान घोषित ई-10 या ई 12 या ई 15 के अनुसार होगा।''
(ii) उप-नियम (19) के खंड (i) में, -
(1) 'तालिका 2' के पश्चात् दी गई 'टिप्पणियों' में क्रमांक (15) के पश्चात् निम्नलिखित क्रम संख्या को अंतःस्थापित किया जाएगा, अर्थात्:-
"(16) द्वि-ईंधन वाहनों के लिए, रेफरेंस गैसोलीन ईंधन विनिर्माता द्वारा अनुमोदन के दौरान घोषित ई-5 या ई 12 या ई 15 के अनुसार होगा ।''
(iii) उप नियम (20) में, -
(1) 'तालिका 2' के पश्चात् दी गई 'टिप्पणियों' में क्रम संख्या (14) के पश्चात् निम्नलिखित क्रम संख्या को प्रतिस्थापित किया जाएगा, अर्थात्:-
"(15) सीएनजी/बायो-सीएनजी/एचसीएनजी वाहन एआईएस 024, एआईएस-028 संशोधन 1 के अनुसार लागू सभी सुरक्षा आवश्यकताओं को पूरा करेंगे;
(16) ई12 या ई15 या ई20 या ई85 या ई100 के इथेनॉल मिश्रण के स्तर के लिए वाहन की अनुकू लता को वाहन निर्माता द्वारा परिभाषित किया जाएगा और इसे स्पष्ट रूप से दिखाई देने वाला स्टिकर वाहन पर लगाकर प्रदर्शित किया जाएगा।";
(2) 'तालिका 2' के पश्चात् दी गई 'टिप्पणियों' में क्रम संख्या (16) के पश्चात् निम्नलिखित क्रम संख्या को अंतःस्थापित किया जाएगा, अर्थात्:-
"(17) द्वि-ईंधन वाहनों के लिए, रेफरेंस गैसोलीन ईंधन विनिर्माता द्वारा अनुमोदन के दौरान घोषित ई-10 या ई 12 या ई 15 के अनुसार होगा। ''
(iv) उप नियम (22) में, -
(1) 'तालिका 2' के पश्चात् दी गई 'टिप्पणियों' में क्रम संख्या (14) के पश्चात् निम्नलिखित क्रम संख्या को अंत:स्थापित किया जाएगा, अर्थात्:-
"15. ई12 या ई15 या ई20 या ई85 या ई100 के इथेनॉल मिश्रण के स्तर के लिए वाहन की अनुकू लता को वाहन निर्माता द्वारा परिभाषित किया जाएगा और इसे स्पष्ट रूप से दिखाई देने वाला स्टिकर वाहन पर लगाकर प्रदर्शित किया जाएगा।
(16) द्वि-ईंधन वाहनों के लिए, रेफरेंस गैसोलीन ईंधन विनिर्माता द्वारा अनुमोदन के दौरान घोषित ई-10 या ई 12 या ई 15 के अनुसार होगा।"
3. मूल नियम में, 115-ट के पश्चात् निम्नलिखित नियम अंतःस्थापित करें, अर्थात्:-
"115-ठ. ई-12 (12% इथेनॉल-गैसोलीन मिश्रण) और ई-15 (15% इथेनॉल-गैसोलीन मिश्रण) वाहनों के लिए बड़े पैमाने पर उत्सर्जन मानक।3 [भाग II—खण्ड 3(i)] भारत का राजपत्र : असाधारण (1) ई -12 और ई -15 के इथेनॉल गैसोलीन मिश्रणों से चलाने के लिए स्पार्क इग्निशन इंजन वाले नए निर्मित गैसोलीन वाहनों के प्रकार को प्रचलित गैसोलीन उत्सर्जन मानदंडों के अनुसार अनुमोदित किया जाएगा। " (2) ई12 और ई15 के इथेनॉल मिश्रण के स्तर के लिए वाहन की अनुकू लता को वाहन निर्माता द्वारा परिभाषित किया जाएगा और इसे स्पष्ट रूप से दिखाई देने वाला स्टिकर वाहन पर लगाकर प्रदर्शित किया जाएगा। (3) टाइप अनुमोदन परीक्षण के लिए परीक्षण आवश्यकताएं नीचे दी गई तालिका के अनुसार होंगी:

टिप्पणियां-
1. सीएमवीआर अनुपालना के लिए उत्सर्जन परीक्षण, जैसा लागू हो और समय-समय पर संशोधित एआईएस 137 के अनुसार किया जाएगा।
2. सीएमवीआर अनुपालन के लिए वाहन विनिर्माता नियम 126 के तहत निर्दिष्ट परीक्षण एजेंसियों को वाहन सौंपेंगे।
3. खराब होने वाले कारक वाहन श्रेणी के लिए यथा अधिसूचित प्रचलित उत्सर्जन मानदंडों के अनुसार होंगे। 4. जब तक बीआईएस द्वारा ई -12 और ई -15 के लिए गैसोलीन इथेनॉल ईंधन मिश्रण को अधिसूचित नहीं किया जाता है, तब तक सीएमवीआर अनुपालना के प्रयोजनार्थ आईएस 17586: 2021 के अनुसार ई -12 और ई -15 के लिए वाणिज्यिक गैसोलीन इथेनॉल ईंधन मिश्रण ईंधन का इस्तेमाल किया जाएगा। गैसोलीन रेफरेंस ईंधन वाहन श्रेणी के लिए यथा अधिसूचित किया जाएगा।

टिप्पणियां-
1. सीएमवीआर अनुपालना के लिए उत्सर्जन परीक्षण, जैसा लागू हो और समय-समय पर संशोधित एआईएस 137 के अनुसार किया जाएगा।
2. सीएमवीआर अनुपालन के लिए वाहन विनिर्माता नियम 126 के तहत निर्दिष्ट परीक्षण एजेंसियों को वाहन सौंपेंगे।

NOTIFICATION
New Delhi, the 28th June, 2021
G.S.R. 439(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall5 [भाग II—खण्ड 3(i)] भारत का राजपत्र : असाधारण be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public;
Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL, Transport & Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the email: [email protected];
The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government.
Draft Rules
1. (1) These rules may be called as Central Motor Vehicles (….Amendment) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In Central Motor Vehicle Rules, 1989 (herein referred to as principal rules), in rule 115,-
(i) in sub-rule (18), in clause (i), -
1. in the 'Notes' given after 'Table 2', after serial number (21), the following serial number shall be inserted, namely:-,-
"(22) For the bi-Fuel vehicles, the Reference Gasoline fuel shall be as per E-10 or E12 or E15 as declared by the manufacturer during approval.''
(ii) in sub-rule (19), in clause (i), -
(1) in the 'Notes' given after 'Table 2', after serial number (15), the following serial number shall be inserted , namely:-,-
"(16) For the bi-Fuel vehicles, the Reference Gasoline fuel shall be as per E-5 or E12 or E15 as declared by the manufacturer during approval.''
(iii) in sub rule (20),-
(1) in the 'Notes' given after 'Table 2', after serial number (14), the following serial number shall be substituted, namely:-,-
"(15) The CNG/Bio-CNG/HCNG Vehicles shall meet all the safety requirements as per AIS 024, AIS-028 Revision 1 as applicable;
(16) The compatibility of vehicle to level of ethanol blend of E12 or E15 or E20 or E85 or E100 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.";
(2) in the 'Notes' given after 'Table 2', after serial number (16), the following serial number shall be inserted, namely:-,-
"(17) For the bi-Fuel vehicles, the Reference Gasoline fuel shall be as per E-10 or E12 or E15 as declared by the manufacturer during approval.''
(iv) in sub rule (22),-
(1) in the 'Notes' given after 'Table 2', after serial number (14), the following serial number shall be inserted, namely:-,-

3. In the principal rule, after 115-K, insert the following rule, namely:-
"115-L. Mass emission standard for E-12 (12 % Ethanol-Gasoline Blend) and E-15 (15 % Ethanol-Gasoline
Blend) vehicles.
(1) The newly manufactured gasoline vehicles fitted with spark ignition engine compatible to run on ethanol gasoline blends of E-12 and E-15 shall be type approved as per prevailing gasoline emission norms."
(2) The compatibility of vehicle to level of ethanol blend of E-12 and E-15 shall be defined by the vehicle manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.
(3) Test requirements for Type Approval test shall be as per Table below:

Notes-
1. Emission tests for CMVR compliance, shall be carried out as per AIS 137 as applicable and as amended from time to time.
2. Vehicles manufacturer shall submit the vehicle to the Test Agencies referred under rule 126, for CMVR compliance.
3. Deterioration factors shall be as per prevailing emission norms, as notified for the vehicle category.
4. Till the time reference gasoline ethanol fuel blend for E-12 and E-15 is notified by BIS, commercial gasoline ethanol fuel blend fuel for E-12 and E-15, as per IS 17586: 2021, shall be used for the purpose of CMVR compliance. Gasoline Reference Fuel shall be as notified for the vehicle category.
5. Deterioration factors shall be as per prevailing emission norms, as notified for the vehicle category.
