सा.का.नि. 455(अ).—जहां कि चीन जनवादी गणराज्य और इंडोनेशिया में मूलत: उत्पादित या वहां से निर्यातित "विस्कोस स्टैपल फाइबर (वीएसएफ), जिमसें बम्बू फाइबर, डाइड फाइबर, मॉडल फाइबर और फायर रिटायडेंट फाइबर नहीं आते हैं" के आयात पर भारत सरकार, वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना संख्या 43/2016-सीमाशुल्क (एडीडी), दिनांक 8 अगस्त, 2016, जिसे सा.का.नि. 777 (अ), दिनांक 8 अगस्त, 2016 के तहत भारत के राजपत्र, असाधारण, के भाग ।।, खंड 3, उप खंड (i) में प्रकाशित किया गया था, के द्वारा लगाए गए प्रतिपाटन शुल्क को जारी रखने के मामले में विनिर्दिष्ट प्राधिकारी ने सीमा शुल्क टैरिफ (पाटित वस्तुओं की पहचान, उनका आंकलन और उन पर प्रतिपाटन शुल्क का संग्रहण तथा क्षति निर्धारण) नियमावली, 1995 (एतश्मिन पश्चात जिसे उक्त नियमावली से संदर्भित किया गया है) के नियम 23 के साथ पठित सीमा शुल्क टैरिफ अधिनियम, 1975 (1975 का 51) (एतश्मिन पश्चात जिसे उक्त सीमा शुल्क टैरिफ अधिनियम से संदर्भित किया गया है) की धारा 9क की उप धारा (5) के अनुसार प्रारंभिकीकरण अधिसूचना संख्या 7/03/2021-डीजीटीआर, दिनांक 22 फरवरी, 2021, जिसे दिनांक 22 फरवरी, 2021 के तहत भारत के राजपत्र, असाधारण, के भाग ।, खंड । में प्रकाशित किया गया था, के तहत समीक्षा का कार्य शुरू किया है और उन्होंने 3628 GI/2021
(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] उक्त सीमा शुल्क टैरिफ अधिनियम की धारा 9क की उप धारा (5) के अनुसार उक्त प्रतिपाटन शुल्क को आगे भी जारी रखने के लिए अनुरोध किया है ।
अत: अब उक्त नियमावली के नियम 18 और 23 के साथ पठित सीमा शुल्क टैरिफ अधिनियम की धारा 9क की उप धारा (1) और (5) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए के न्द्र सरकार, एतदद्वारा, भारत सरकार, वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना संख्या 43/2016-सीमा शुल्क (एडीडी), दिनांक 8 अगस्त, 2016, जिसे सा.का.नि. 777 (अ), दिनांक 8 अगस्त, 2016 के तहत भारत के राजपत्र, असाधारण, के भाग ।।, खंड 3, उप खंड (i) में प्रकाशित किया गया था, में निम्नलिखित संशोधन करती है, यथा:-
उक्त अधिसूचना में, पैराग्राफ 2 के पश्चात और स्पष्टीकरण से पहले निम्नलिखित पैराग्राफ को अंत:स्थापित किया जाएगा, यथा:-
"3. पैराग्राफ 2 में निहित किसी भी बात के बावजूद, यह प्रतिपाटन शुल्क दिनांक 31 अक्टूबर, 2021 तक, जिसमें यह तारीख भी शामिल है, यदि इसके पहले इसे वापस नहीं ले लिया जाता है, इसका अधिक्रमण नहीं होता है या इसमें संशोधन नहीं किया जाता है तो, लागू रहेगा"

G.S.R. 455(E).—Whereas, the designated authority vide initiation notification No. 7/03/2021- DGTR dated 22.02.2021, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 22nd February, 2021, has initiated review in terms of sub-section (5) of section 9A of the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the Customs Tariff Act) read with rule 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 (hereinafter referred to as the said rules), in the matter of continuation of anti-dumping duty on imports of "Viscose Staple Fibre (VSF) excluding Bamboo Fibre, Dyed Fibre, Modal Fibre & Fire-retardant Fibre", originating in or exported from China PR and Indonesia, imposed vide notification of the Government of India, in the Ministry of Finance (Department of Revenue) No. 43/2016-Customs(ADD), dated 8th August, 2016, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 777(E), dated the 8th August, 2016, and has requested for extension of the said anti-dumping duty in terms of sub-section (5) of section 9A of the Customs Tariff Act. Now, therefore, in exercise of the powers conferred by sub-sections (1) and (5) of section 9A of the Customs Tariff Act, read with rules 18 and 23 of the said rules, the Central Government hereby makes the following amendment in the notification of the Government of India, in the Ministry of Finance (Department of Revenue) No. 43/2016-Customs(ADD), dated 8th August, 2016, published in the Gazette {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड 3(i)] भारत का राजपत्र : असाधारण
of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 777(E), dated the 8th August, 2016, namely :-
In the said notification, after paragraph 2 and before the Explanation, the following paragraph shall be inserted, namely-
"3. Notwithstanding anything contained in paragraph 2, the anti-dumping duty shall remain in force up to and inclusive of the 31st October, 2021, unless revoked, superseded or amended earlier.".
