का.आ. 2691(अ).—जबकि, के न्द्र सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का.आ. 4155(अ), दिनांकित 23 दिसंबर, 2016 के द्वारा मध्य प्रदेश राज्य में स्थित राष्ट्रीय राजमार्ग सं. 552 विस्तार को मध्य प्रदेश राज्य सरकार को सुपुर्द कर दिया है;
अत: अब, राष्ट्रीय राजमार्ग फीस (दरों का निर्धारण और संग्रहण) नियम, 2008 (जो इसके आगे 'नियम' के रूप में उल्लिखित है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्रीय सरकार, एतदद्वारा मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग सं. 552 विस्तार के पोरसा-अटर-भिड खंड के डिजाईन किमी 295.200 से किमी 343.800 (मौजूदा किमी 290.075 किमी से 340.200 किमी तक) पर 46.607 किमी लंबाई की निवल सड़क खंड के लिए तालिका 1 के कॉलम (2) में विनिदिष्ट दर के 60 प्रतिशत पर और 2.93 किमी (0.293 किमी लंबाई वाली) समतुल्य संरचना लंबाई (60 मी. से अधिक लंबाई वाले) के लिए तालिका 1 के कॉलम (2) में विनिदिष्ट दर पर नीचे दी गई तालिका 1 के कॉलम (1) में विनिदिष्ट वाहनों के प्रकार पर फीस उदगृहीत करती है तथा भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को उसके अधिकारियों अथवा किसी ठेके दार के माध्यम से उक्त फीस के संग्रहण के लिए प्राधिकृ त करती है, अर्थात:-

1. इसके अंतर्गत उदगृहीत और संगृहीत फीस ऐसे शुल्क प्लाजा के अंतर्गत विनिदिष्ट दूरी हेतु निम्नलिखित पथकर प्लाजाओं में देय और संदेय होगी अर्थात्:-

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित शुल्क प्लाजा पर 60 मीटर से अधिक लंबाई वाली निम्नलिखित अवसंरचनाओं के उपयोग के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को परिवतित करके निम्नलिखित फीस भी देय और संदेय होगी:-

60 मी. से अधिक लंबाई वाली अवसंरचनाओं का ब्यौरा निम्नानुसार हैं: -

3. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किमी की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2020-21 के लिए 275.00 रु. (दो सौ पचहत्तर रुपए मात्र) है और कथित नियमों के प्रावधानों के अनुसार प्रतिवर्ष संशोधन के अध्यधीन है।
4. राजमार्ग खंड पर बहुल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्

5. फीस प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए फीस उस श्रेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशर्ते कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई सविस रोड या वैकल्पिक सड़क उपलब्ध न हों ।
6. संबंधित श्रेणी के वाहनों के लिए विनिदिष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश लिए, कथित नियमों के नियम 10 के उप-नियम 1ए के अनुसार अनुप्रयोज्य फीस के समतुल्य फीस का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहीं होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहीं जाता।
7. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी सहित, इनके अनुज्ञेय भार, छू ट प्राप्त वाहनों की श्रेणी, सविस रोड, वैकल्पिक सड़क इत्यादि पूर्वोक्त नियमों में विनिदिष्ट परिभाषाओं के अनुरूप होंगी।
8. फीस की दरें उक्त नियमों के नियम 12 के अनुसरण में प्रयोक्ताओं के सूचनार्थ प्रदशित करनी होंगी ।
9. यांत्रिक वाहनों से फीस की वास्तविक राशि उपयु र्क्त तालिका-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी फीस की आधार दर के आधार पर प्रभारित होगी और छू टों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंग्रेजी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा। 10. परियोजना की अनुमानित पू ंजीगत लागत 217.22 करोड़ रू. है । [भूमि अधिग्रहण, सार्वजनिक जन सुविधाओं के स्थानांतरण, पेड़ों को काटने आदि कार्यकलापों को अभी पूरा किया जाना है इसलिए, पू ंजीगत लागत परिवर्तन के अध्यधीन है और अंतिम पू ंजीगत लागत को पृथक रूप से अधिसूचित किया जाएगा]। भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प्रयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पू ंजीगत लागत की वसूली हो जाने के पश्चात्, लगाए जाने वाले शुल्क की दरों को घटाकर 40% कर दिया जाएगा और उक्त नियमों के अनुसार इसमें वाषिक तौर पर संशोधन किया जाएगा।

New Delhi, the 1st July, 2021
S.O. 2691(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 4155(E) dated the 23rd December, 2016 issued under Section 5 of the National Highways Act,1956 (48 to 1956), the Central Government has entrusted the National Highway 552 Extension as situated within the State of Madhya Pradesh to the State Government of Madhya Pradesh.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at sixty Percent of the rate specified in column (2) of the Table 1 for net road section length of 46.607 km and at the rate specified in column (2) of the Table (1) for equivalent structure length (having length more than 60m) of 2.93 km (having length of 0.293 km) on the type of vehicles specified in column (1) of the table 1 below for the use of Porsa- Ater-Bhind Section from Design kilometre 295.200 to kilometer 343.800 (existing km 290.075 to km 340.200) of National Highway 552 Extn. in the State of Madhya Pradesh and authorises the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified for such Fee Plaza namely:-

2. In addition to above, the following fee shall be also due and payable for the use of the following structures having length more than 60m at the following toll plaza, by the converting the length of structures into an equivalent length of Highway by the multiplying the length of such structures by the equalization factor of 10:-

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs 275.00 (Rs. Two Hundred Seventy Five Only) for the year 2020-21 and is subject to revision every year as per the provisions of the said rules.
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: -

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.
8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.
10. The estimated capital cost of the project is Rs. 217.22 Crores. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The final capital cost will be notified separately. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
