का. आ. 2730(अ).—के न्द्रीय सरकार का यह समाधान हो गया है कि लोक हित में ऐसा करना अपेक्षित है कि किसी तेल क्षेत्र उद्योग में लगी सेवाएं, जो औद्योगिक विवाद अधिनियम, 1947 (1947 का 14) की पहली अनुसूची के मद 17 के अधीन आती हैं, को उक्त अधिनियम के प्रयोजनों के लिए लोक उपयोगिता सेवा घोषित किया जाना चाहिए;
और कें द्रीय सरकार ने भारत सरकार के श्रम और रोजगार मंत्रालय की अधिसूचना सं. का.आ. 3549(अ), तारीख 12 अक्तू बर, 2020, द्वारा अंततः तारीख 12 अक्तू बर, 2020 से छह मास की अवधि के लिए उक्त औद्योगिक स्थापनों को उक्त अधिनियम के प्रयोजनों के लिए लोक उपयोगी सेवा घोषित किया था;
और के न्द्रीय सरकार की यह राय है कि छह मास की और अवधि के लिए उक्त उद्योग की लोकहित उपयोगी सेवा प्रास्थिति के विस्तार की अपेक्षा की जाती है;
अत:, अब, कें द्रीय सरकार, औद्योगिक विवाद अधिनियम, 1947 (1947 का 14) की धारा 2 के खंड (ढ) के उपखंड (vi) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, घोषित करती है कि किसी तेल क्षेत्र उद्योग में लगी सेवाएं, उक्त अधिनियम के प्रयोजनों के लिए इस अधिसूचना के प्रकाशन की तारीख से प्रवृत छह मास की अवधि के लिए लोक उपयोगिता सेवा होंगी । 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION
New Delhi, the 7th July, 2021
S.O. 2730(E).—Whereas the Central Government is satisfied that public interest requires that the industry engaged in the services in any oilfield, which is covered under item 17 of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947), to be a public utility service for the purposes of the said Act; And whereas the Central Government has lastly declared the said industry to be a public utility service for the purposes of the said Act for a period of six months with effect from the 12th October, 2020, vide notification of the Government of India in the Ministry of Labour and Employment, number S.O. 3549(E), dated the 12th October, 2020;
And whereas the Central Government is of the opinion that public interest requires the extension of the public utility service status to the said industry for a further period of six months;
Now, therefore, in exercise of the powers conferred by the proviso to sub-clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the Central Government hereby declares the industry engaged in the services in any oilfield to be a public utility service for the purposes of the said Act for a period of six months with effect from the date of publication of this notification.
