रेलवे अधिनियम, 1989 की धारा 20 (ई) के तहत अधिसूचना

का.आ. 2846(अ).—जबकि भारत सरकार की अधिसूचना द्वारा रेल मंत्रालय (रेलवे बोर्ड) में अधिसूचना संख्या एस.ओ. 2452 दिनांक 14.08.2020 रेलवे अधिनियम की 20ए की उप-धारा (1) के तहत भारत के राजपत्र साधारण, भाग- II, खंड 3, उप-खंड (ii), (इसके बाद उक्त अधिसूचना के रूप में संदभित) में प्रकाशित , 1989 (1989 का 24) (इसके बाद उक्त अधिनियम के रूप में संदभित), कें द्र सरकार ने 9.0 किलोमीटर लंबाई के ईब फ्लाईओवर विशेष रेलवे परियोजना के निर्माण के निष्पादन के लिए उक्त अधिसूचना से जुड़ी अनुसूची में निदिष्ट भूमि के अधिग्रहण के अपने इरादे की घोषणा की। ओडिशा के झारसुगुडा जिले में ईब स्टेशन और ब्रु ंदामल स्टेशन को जोड़ने वाले रेलवे यातायात के लिए । और, जबकि उक्त अधिनियम की धारा 20ए की उप धारा (4) के तहत अधिसूचना संख्या 297 दिनांक 04.02.2021 का सार दैनिक समाचार पत्र, द सांबद और प्रमेय इन ओडिया संस्करण में दिनांक 12.02.2021 को प्रकाशित किया गया था। जबकि 11 नग आपत्ति याचिकाएं भूमि खोने वालों से निर्धारित अवधि में प्राप्त हुई हैं और सक्षम प्राधिकारी द्वारा हल कर दी गई हैं, और जबकि, उक्त अधिनियम की धारा 20ई की उप धारा (1) के अनुसार, सक्षम प्राधिकारी ने कें द्र सरकार को अपना रिपोर्ट प्रस्तुत किया है। अब, इसलिए, सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त होने पर, और उक्त अधिनियम की धारा 20ई की उप धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार एतद्द्वारा 3911 GI/2021

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] घोषणा करती है कि अनुसूची में निदिष्ट भूमि इसके साथ संलग्न पूर्वोक्त प्रयोजन के लिए अधिग्रहण किया जाएगा; और, उक्त अधिनियम की धारा 20ई की उप धारा (2) के अनुसरण में, कें द्र सरकार एतद्द्वारा घोषणा करती है कि इस अधिसूचना के आधिकारिक राजपत्र में प्रकाशित होने पर, इसके साथ संलग्न अनुसूची में निदिष्ट भूमि पूरी तरह से सभी प्रकार के बंधनों से मुक्त कें द्रीय सरकार में निहित होगी।

NOTIFICATION

New Delhi, the 12th July, 2021

Notification under Section 20(E) of the Railways Act, 1989

S.O. 2846(E).—Whereas by the notification of the Government of India, in the Ministry of Railways (Railway Board) Notification No. S.O. 2452 dtd. 14.08.2020 published in the Gazette of India Ordinary, Part-II, Section 3, sub-section (ii), (hereinafter referred to as the said notification) under sub-section (1) of 20A of the Railway Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the schedule annexed to the said notification for execution of Special Railway Project of construction of IB Flyover of 9.0 KM. length for Railway traffic connecting IB station and Brundamal station in Jharsuguda District of Odisha.

And, whereas the substance of notification No.297 dtd.04.02.2021 under sub section (4) of section: 20A of the said Act was published in the daily Newspapers, The Sambad & The Prameya in Odia Edition on dtd.12.02.2021 whereas 11 nos. of objection petitions have been received in the stipulated period from the land losers and have been sorted out by the Competent Authority, and whereas, in pursuance of sub section (1) of section: 20E of the said Act, the Competent Authority has submitted his report to the Central Government. Now, therefore, upon receipt of the said report of the Competent Authority, and in exercise of the powers conferred by sub section (1) of the section: 20E of the said Act, the Central Government hereby declares that the lands specified in the schedule annexed hereto shall be acquired for the aforesaid purpose; and, further in pursuance of sub section (2) of section: 20E of the said Act, the Central Government hereby declares that on publication of this notification in the official Gazette, the land specified in the schedule annexed hereto shall vest absolutely in the Central Government free from all Encumbrances.
