भारतीय दिवाला और शोधन अक्षमता बोर्ड (आदर्श उप-विधियां और दिवाला व्यावसायिक एजेंसियों का शासी बोर्ड)
(तीसरा संशोधन) विनियम, 2021
आई.बी.बी.आई./2021-22/जी.एन./आर.ई.जी.076.—भारतीय दिवाला और शोधन अक्षमता बोर्ड, दिवाला और शोधन अक्षमता संहिता, 2016 (2016 का 31) की धारा 240 के साथ पठित धारा 196, धारा 203 और धारा 205 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय दिवाला और शोधन अक्षमता बोर्ड (आदर्श उप-विधियां और दिवाला व्यावसायिक एजेंसियों का शासी बोर्ड) विनियमन, 2016 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात्: -
1. (1) इन विनियमों का संक्षिप्त नाम भारतीय दिवाला और शोधन अक्षमता बोर्ड (आदर्श उप-विधियां और दिवाला व्यावसायिक एजेंसियों का शासी बोर्ड) (तीसरा संशोधन) विनियम, 2021 है ।
(2) ये राजपत्र में उनके प्रकारशन की तारीख को प्रवृत्त होंगे ।
2. भारतीय दिवाला और शोधन अक्षमता बोर्ड (आदर्श उप-विधियां और दिवाला व्यावसायिक एजेंसियों का शासी बोर्ड) विनियमन, 2016 की अनुसूची के खंड 24 में, उपखंड (5) के स्थान पर निम्नलिखित उपखंड रखा जाएगा, अर्थात्:-
"(5) एजेंसी, अनुशासनिक समिति द्वारा अधिरोपित धनीय शास्ति की वसूली तुरंत करेगी और उसे संहिता की धारा 222 के अधीन गठित निधि में जमा कराएगी ।" 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] टिप्पण: भारतीय दिवाला और शोधन अक्षमता बोर्ड (आदर्श उप-विधियां और दिवाला व्यावसायिक एजेंसियों का शासी बोर्ड) विनियमन, 2016, भारत के राजपत्र, असाधारण, भाग III, खंड 4, सं. 421, तारीख 22 नवम्बर, 2016 में अधिसूचना सं. आई.बी.बी.आई./2016-17/जी.एन./आर.ई.जी.001, तारीख 21 नवम्बर, 2016 द्वारा प्रकाशित किए गए थे और उनमें अंतिम संशोधन भारत के राजपत्र, असाधारण, भाग III, खंड 4, सं. 186, तारीख 27 अप्रैल, 2021 में अधिसूचना सं. आई.बी.बी.आई./2021-22/जी.एन./आर.ई.जी.074, तारीख 27 अप्रैल, 2021 द्वारा प्रकाशित भारतीय दिवाला और शोधन अक्षमता बोर्ड (आदर्श उप-विधियां और दिवाला व्यावसायिक एजेंसियों का शासी बोर्ड) (दूसरा संशोधन) विनियम, 2021 द्वारा किया गया था ।

Insolvency and Bankruptcy Board of India (Model Bye-Laws and Governing Board of Insolvency
Professional Agencies) (Third Amendment) Regulations, 2021
No. IBBI/2021-22/GN/REG076.- In exercise of the powers conferred by sections 196, 203 and 205 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations further to amend the Insolvency and Bankruptcy Board of India (Model Bye-Laws and Governing Board of Insolvency Professional Agencies) Regulations, 2016, namely:-
1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Model Bye-Laws and Governing Board of Insolvency Professional Agencies) (Third Amendment) Regulations, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Insolvency and Bankruptcy Board of India (Model Bye-Laws and Governing Board of Insolvency Professional Agencies) Regulations, 2016, in the Schedule, in clause 24, for sub-clause (5), the following sub-clause shall be substituted, namely:-
"(5) The Agency shall promptly realise the monetary penalty imposed by the Disciplinary Committee and credit the same to the Fund constituted under section 222 of the Code. "

[ADVT.-III/4/Exty./157/2021-22] Note: The Insolvency and Bankruptcy Board of India (Model Bye-Laws and Governing Board of Insolvency Professional Agencies) Regulations, 2016 were published vide notification No. IBBI/2016-17/GN/REG001 dated 21st November, 2016 in the Gazette of India, Extraordinary, Part III, Section 4, No. 421 on 22nd November, 2016 and were last amended by the Insolvency and Bankruptcy Board of India (Model Bye-Laws and Governing Board of Insolvency Professional Agencies) (Second Amendment) Regulations, 2021 published vide notification No. IBBI/2021- 22/GN/REG074 dated 27th April, 2021, in the Gazette of India, Extraordinary, Part III, Section 4, No. 186 on 27th April, 2021.
