सा.का.नि. 512(अ).—कें द्रीय सरकार, प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का 13) की धारा 13 की उप धारा (1) और (2) के साथ पठित धारा 35 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्रीय प्रशासनिक अधिकरण (समूह 'क और 'ख' पुस्तकालय पद) भर्ती नियम, 2014 का संशोधन करने के लिए निम्नलिखित नियम बनाते है, अर्थात् :-

1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम कें द्रीय प्रशासनिक अधिकरण (समूह 'क और 'ख' पुस्तकालय पद) भर्ती (संशोधन) नियम, 2021 है I

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे I

2. कें द्रीय प्रशासनिक अधिकरण (समूह 'क और 'ख' पुस्तकालय पद) भर्ती नियम, 2014 में, (जिसे इसमें इसके पश्चात उक्त नियम कहा गया है), नियम 3 के स्थान पर, निम्नलिखित नियम रखा जाएगा, अर्थात्त :-

"3. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.—उक्त पदों की संख्या, उनका वर्गीकरण और उससे संलग्न वेतन मैट्रिक्स में स्तर वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिदिष्ट किया जाएगा I" 3. उक्त नियमों की, अनुसूची में,—

(क) पुस्तकालय और सूचना अधिकारी पद से सम्बंधित क्रम संख्यांक 1 के सामने, —

(i) स्तंभ 4 में, स्तंभ शीर्षक और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित स्तंभ शीर्षक और प्रविष्टियां रखी जाएँगी, अर्थात :-

(ii) स्तंभ (11) में, —

(क) (i) प्रोन्नति उपशीर्षक में, "वेतन बैंड-2, 9300 – 34800 रु. के साथ 4600/- रु. का ग्रेड वेतन" शब्दों, अंकों और अक्षरों के स्थान पर, "वेतन मैट्रिक्स में स्तर 7 (44900 - 142400 रु.)" शब्द, अंक और अक्षर रखे जाएंगे;

(ख) (i) प्रोन्नति उपशीर्ष में टिप्पण 2 का लोप किया जाए;

(ग) (ii) प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है) उपशीर्षक में, मद (क) में, उप-मद (ii) में, "वेतन बैंड-2, 9300 – 34800/- रु. के साथ 4600/- रु. का ग्रेड वेतन" शब्दों, अंकों और अक्षरों के स्थान पर, "वेतन मैट्रिक्स में स्तर 7 (44900 - 142400 रु.)" शब्द, अंक और अक्षर रखे जाएंगे;

(घ) वांछनीय उपशीर्षक में, टिप्पण 4 का लोप किया जाए I

(ख) सहायक पुस्तकालय और सूचना अधिकारी पद से सम्बंधित क्रम संख्यांक 2 के सामने, —

(i) स्तंभ 4 में, प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जाएँगी, अर्थात :-

(ii) स्तंभ (11) में,-

(क) (i) प्रोन्नति उपशीर्षक में, "वेतन बैंड-2, 9300 – 34800/- रु. के साथ 4200/- रु. का ग्रेड वेतन" शब्दों, अंकों और अक्षरों के स्थान पर, "वेतन मैट्रिक्स में स्तर 6 (35400 - 112400 रु.)" शब्द, अंक और अक्षर रखे जाएंगे;

(ख) (i) प्रोन्नति उपशीर्षक में टिप्पण 2 का लोप किया जाए;

(ग) (ii) प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है) उपशीर्ष में, मद (क) में, उप-मद (ii) में, "वेतन बैंड-2, 9300 – 34800/- रु. के साथ 4200/- रु. का ग्रेड वेतन" शब्दों, अंकों और अक्षरों के स्थान पर, "वेतन मैट्रिक्स में स्तर 6 (35400 - 112400 रु.)" शब्द, अंक और अक्षर रखे जाएंगे;

(घ) (ii) प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है) उपशीर्षक में, टिप्पण 4 का लोप किया जाए I

(ग) पुस्तकालय और सूचना सहायक पद से सम्बंधित क्रम संख्यांक 3 के सामने, —

(i) स्तंभ 4 में, प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जाएँगी, अर्थात :-

(ii) स्तंभ (10) में, "सीधी भर्ती द्वारा" शब्दों के पश्चात, निम्नलिखित अतः स्थापित किया जाएगा, अर्थात :-

"टिप्पण: पदधारी के प्रतिनियुक्ति या लम्बी बीमारी या अध्ययन छु ट्टी या किन्ही अन्य परिस्थितियों में एक वर्ष या उससे अधिक अवधि के लिए बाहर रहने के कारण हुई रिक्तियां कें द्रीय सरकार के ऐसे अधिकारियों में से प्रतिनियुक्ति के आधार पर भरी जाएँगी –

(क) जो नियमित आधार पर सदृश पदधारण करते हो; या

(ख) जिन्होनें वेतन मैट्रिक्स में स्तर 5 (29200 - 92300 रु.) में छह वर्ष नियमित सेवा की है; और (ग) जो स्तंभ (7) के अधीन सीधे भर्ती किये जाने वाले व्यक्तियों के लिए विहित अहर्ता और अनुभव रखते हो ।

टिप्पण 1: प्रतिनियुक्ति की अवधि, जिसके अंतर्गत कें द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में नियुक्ति से ठीक पहले धारित किसी अन्य पूर्व काडर पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी ।

टिप्पण 2: प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तिथि को 56 वर्ष से अधिक नहीं होगी ;"

(iii) स्तंभ (11) में, टिप्पण, टिप्पण 1, टिप्पण 2, टिप्पण 3 और टिप्पण 4 का क्रमशः लोप किया जाए;

(iv) स्तंभ (11) में निम्नलिखित प्रविष्टि विहित की जाएँगी, अर्थात "लागू नहीं होता" ।

NOTIFICATION

New Delhi, the 29th July, 2021

G.S.R. 512(E).—In exercise of the powers conferred by section 35 read with sub-sections (1) and (2) of section 13 of the Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules to amend the Central Administrative Tribunal (Group ‗A' and Group ‗B' Library Posts) Recruitment Rules, 2014, namely:-

1. Short title and commencement.—(1) These rules may be called the Central Administrative Tribunal (Group ‗A' and Group ‗B' Library Posts) Recruitment (Amendment) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Administrative Tribunal (Group ‗A' and Group ‗B' Library Posts) Recruitment Rules, 2014 (hereinafter referred to as the said rules), for rule 3, the following rule shall be substituted, namely:-

―3. Number of posts, classification and Level in Pay Matrix.—The number of said posts, their classification and the Level in the Pay Matrix attached thereto, shall be as specified in columns (2) to (4) of the said Schedule.‖.

3. In the said rules, in the Schedule, —

(a) against serial number 1, relating to the post of Library and Information Officer,ꟷ

(i) in column (4), for the column heading and the entries relating thereto, the following column heading and entries shall be substituted, namely:-

(ii) in column (11), —

(A) in the sub-heading (i) Promotion, for the words, figures and letters ―pay band-2, Rs. 9300 - 34800 plus grade pay of Rs. 4600/-‖, the words, figures and letters ―Level 7 (Rs. 44900 – 142400) in the Pay Matrix‖ shall be substituted;

(B) in the sub-heading (i) Promotion, Note 2 shall be omitted;

(C) in the sub-heading (ii) Deputation (including Short-term contract), in item (a), in sub-item (ii), for the words, figures and letters ―pay band-2, Rs. 9300 – 34800/- plus grade pay of Rs. 4600/-‖, the words, figures and letters ―Level 7 (Rs. 44900 – 142400) in the Pay Matrix‖ shall be substituted;

(D) in the sub-heading Desirable, Note 4 shall be omitted.

(b) against serial number 2, relating to the post of Assistant Library and Information Officer, —

(i) in column (4), for the entry, the following entry shall be substituted, namely:-

(ii) in column (11),-

(A) in the sub-heading (i) Promotion, for the words, figures and letters ―pay band-2, Rs. 9300 – 34800/- plus grade pay of Rs. 4200/-‖, the words, figures and letters ―Level 6 (Rs. 35400 – 112400) in the Pay Matrix‖ shall be substituted;

(B) in the sub-heading (i) Promotion, Note 2 shall be omitted;

(C) in the sub-heading (ii) Deputation (including Short-term contract), in item (a), in sub-item (ii), for the words, figures and letters ―pay band-2, Rs. 9300 – 34800/- with grade pay of Rs. 4200/-‖, the words, figures and letters ―Level 6 (Rs. 35400 – 112400) in the Pay Matrix‖ shall be substituted;

(D) in the sub-heading (ii) Deputation (including Short-term contract), Note 4 shall be omitted.

(c) against serial number 3, relating to the post of Library and Information Assistant, —

(i) in column (4), for the entry, the following entry shall be substituted, namely:-

(ii) in column (10), after the words ―Direct Recruitment‖, the following shall be inserted, namely:-

―Note: Vacancies caused by the incumbent being away on deputation or long illness or study leave or under other circumstances for a duration of one year or more may be filled on deputation basis from officers of Central Government –

(a) holding analogous posts on regular basis; or

(b) with six years regular service in the Level 5 (Rs. 29200 – 92300) in the Pay Matrix;

and

(c) possessing the qualification and experience prescribed for direct recruits under column (7).

Note 1: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not to exceed three years.

Note 2: The maximum age limit for appointment by deputation shall be ‗not exceeding fifty-six years' as on the closing date of receipt of application;‖

(iii) in column (11), the Note, Note 1, Note 2, Note 3 and Note 4 shall respectively be omitted;

(iv) In column (11), the following entry shall be prescribed, namely ―Not Applicable‖.
