का.आ. 3061(अ).—के न्द्रीय सरकार का यह समाधान हो गया है कि लोकहित में भू-मार्ग या जलमार्ग द्वारा यात्रियों या मालों के वहन के लिए परिवहन सेवाएं (रेल से भिन्न), जो औद्योगिक विवाद अधिनियम, 1947 (1947 का 14) की पहली अनुसूची की मद 1 के अधीन आती हैं, को उक्त अधिनियम के प्रयोजनों के लिए लोक उपयोगी सेवा बनाई जाए;
और के न्द्रीय सरकार ने अंतिम बार उक्त उद्योग को भारत सरकार के श्रम और रोजगार मंत्रालय की अधिसूचना सं. का.आ. 4067(अ), तारीख 12 नवंबर, 2020 द्वारा तारीख 27 नवंबर, 2020 से छह मास की अवधि के लिए उक्त अधिनियम के प्रयोजनों के लिए लोक उपयोगी सेवा के रूप में घोषित किया है;
और के न्द्रीय सरकार की यह राय है कि लोकहित में छह मास की और अवधि के लिए उक्त उद्योग की लोक उपयोगी सेवा प्रास्थिति का विस्तार किया जाना अपेक्षित है ;
अतः अब के न्द्रीय सरकार, औद्योगिक विवाद अधिनियम, 1947 (1947 का 14) की धारा 2 के खंड (ढ) के उपखंड (vi) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भू-मार्ग या जलमार्ग द्वारा यात्रियों या मालों के वहन के लिए परिवहन सेवाएं (रेल से भिन्न) को इस अधिसूचना के प्रकाशन की तारीख से प्रवृत छह मास की अवधि के लिए लोक उपयोगी सेवा होंगी। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION
New Delhi, the 30th July, 2021
S.O. 3061(E).—Whereas, the Central Government is satisfied that public interest requires that the services in the Transport (other than railways) for the carriage of passengers or goods, by land or water, which is covered under item 1 of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947), to be a public utility service for the purposes of the said Act;
And whereas, the Central Government has lastly declared the said industry to be public utility service for the purposes of the said Act for a period of six months with effect from the 27th November, 2020 vide notification of the Government of India in the Ministry of Labour and Employment number S.O. 4067(E), dated the 12th November, 2020;
And whereas the Central Government is of the opinion that public interest requires the extension of the public utility service status to the said industry for a further period of six months;
Now, therefore, in exercise of the powers conferred by sub-clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the Central Government hereby declares the services in the Transport (other than railways) for the carriage of passengers or goods, by land or water, to be a public utility service for the purposes of the said Act for a period of six months with effect from the date of publication of this notification.
