.—केंद्र सरकार, महापत्तन न्यास अधिनियम, 1963 (1963 का 38) की धारा 132 की उप-धारा (1) के साथ पठित, धारा 124 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कोचीन पत्तन के न्यासी मंडल द्वारा तैयार किए गए, इस अधिसूचना में अनुबंधित अनुसूची में यथा वर्णित, कोचीन पत्तन न्यास कर्मचारी (भर्ती, वरिष्ठता व पदोन्नति) संशोधन विनियम, 2021 को एतद्‌द्वारा अनुमोदित करती है।

2. उक्त संशोधन विनियम, राजपत्र में इस अधिसूचना के प्रकाशन की तिथि से प्रभावी हो जाएंगे। महापत्तन न्यास अधिनियम, 1963 (1963 का 38) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कोचीन पत्तन न्यास का न्यासी मंडल एतद्‌द्वारा कोचीन पत्तन न्यास कर्मचारी (भर्ती, वरिष्ठता व पदोन्नति) विनियम, 2010 को आगे संशोधित करने हेतु निम्नलिखित विनियम बनाता है, नामतः - (1) इन विनियमों को कोचीन पत्तन न्यास कर्मचारी (भर्ती, वरिष्ठता व पदोन्नति) (संशोधन) विनियम, 2021 कहा जाएगा।

(2) ये विनियम केंद्र सरकार के अनुमोदन से शासकीय राजपत्र में इनके प्रकाशन की तिथि से प्रभावी हो जाएंगे।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. कोचीन पत्तन न्यास कर्मचारी (भर्ती, वरिष्ठता व पदोन्नति) विनियम, 2010 (इसके बाद मूल विनियम के रूप में संदर्भित) में विनियम 4 के स्थान पर निम्नलिखित विनियम प्रतिस्थापित किया जाए, नामतः- (1) ऐसे पदों, जिन पर यह विनियम लागू होते हैं, की सभी नियुक्तियां इन विनियमों के प्रावधानों के अनुसार की जाएंगी।

(2) नियुक्ति या तो पदोन्नति या आमेलन या प्रतिनियुक्ति या सीधी भर्ती द्वारा की जा सकती है। (3) विभाग अध्यक्ष के रूप में माने गए पदों और विभाग अध्यक्ष के एक स्तर नीचे के पदों के संबंध में नियुक्तियां, सभी रिक्तियों को ''भर्ती की संयोजन पद्धति'' द्वारा पदोन्नति या आमेलन पर स्थानांतरण के आधार पर इसमें असफल होने पर महापत्तनों, केंद्र सरकार, राज्य सरकार, स्वायत्त निकायों, सरकारी कंपनियों के कर्मचारियों से प्रतिनियुक्ति और इन दोनों में असफल होने पर सीधी भर्ती से की जाएंगी।

(4) पदोन्नति या आमेलन पर स्थांनातरण इन विनियमों में अनुबंधित अनुसूची में निर्धारित पात्रता मानदंडों को पूरा करने वाले महापत्तन न्यासों के अधिकारियों से किया जाना चाहिए।

(5) पद के लिए निर्धारित पात्रता मानदंडों को पूरा करने वाले महापत्तनों, केंद्र सरकार, राज्य सरकारों/स्वायत्त निकायों या सरकारी कंपनियों के कर्मचारियों में से प्रतिनियुक्ति की जानी चाहिएः

बशर्ते कि किसी महापत्तन न्यास के बोर्ड का कोई कर्मचारी, महापत्तन न्यासों में विभाग अध्यक्ष स्तर के पद के लिए प्रतिनियुक्ति के लिए पात्र नहीं होगा।

(6) प्रतिनियुक्ति की सामान्य अवधि तीन वर्ष है, जिसे चार वर्ष तक बढ़ाया जा सकता है।

(7) विशेष परिस्थितियों में यदि किसी पद के मामले में, उसके पदाधिकारी को विभागाध्यक्ष माना गया हो, तो केंद्र सरकार द्वारा और विभागाध्यक्ष के स्तर के नीचे वाले किसी अन्य पद के मामले में अध्यक्ष द्वारा इसे पांच वर्ष तक बढ़ाया जा सकता है।''

3 मूल विनियमों में, अनुसूची में,-

शीर्षक के अंतर्गत, सचिव के पद (श्रेणी-।। पत्तन) से (क) संबंधित क्रम संख्या 5 के सामने -

(क) कॉलम 2 में, प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः -

''सचिव'';

(ख) कॉलम 5 में, प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः -

''1,00,000-260000/- रु.

टिप्पणीः तीन वर्ष की नियमित सेवा पूरी होने के बाद केंद्र सरकार के अनुमोदन से वेतनमान को 120000-280000/-रु. के वेतनमान में उन्नयित किया जाएगा'';

(ग) कॉलम 12 में, प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः-

''सम्मिलित पद्धति से आमेलनः

(i) किसी महापत्तन न्यास के सामान्य प्रशासन विभाग या मानव संसाधन विकास विभाग में तीन वर्ष की नियमित सेवा सहित 80000-220000/-रु. के वेतनमान में पदों को धारित करने वाले अधिकारी पात्र होंगे। प्रतिनियुक्तिः

(ii) केेंद्र सरकार या राज्य सरकार या संघ शासित प्रशासन/सार्वजनिक क्षेत्र उपक्रम या स्वायत्त निकाय (महापत्तनों से अलग) में सामान्य प्रशासन विभाग या मानव संसाधन विकास विभाग में 100000- 260000/-रु. के वेतनमान में इस श्रेणी में दो वर्ष की नियमित सेवा वाले सचिव या समतुल्य पद धारित करने वाले अधिकारी या सामान्य प्रशासन विभाग या मानव संसाधन विकास विभाग में 80000- 220000/-रु. या इससे अधिक के वेतनमान में इस श्रेणी में पांच वर्ष की नियमित सेवा वाले वरिष्ठ उप सचिव और समतुल्य पदों को धारित करने वाले अधिकारी पात्र होंगें।

चयन योग्यता के आधार पर होगा जिसके लिए वार्षिक गोपनीयता रिपोर्टों में समग्र ग्रैडिंग में बैंचमार्क ''बहुत अच्छा'' से नीचे नहीं होगा।3 [भाग II—खण्ड ³(i)] भारत का राजपत्र : असाधारण (ख) शीर्षक के अंतर्गत वित्तीय सलाहकार एवं मुख्य लेखा अधिकारी (श्रेणी-।। पत्तनों) के पद से संबंधित क्रम संख्या 5 के सामने, -

''संयोजन पद्धति के माध्यम से आमेलनः

(i) किसी महापत्तन न्यास के वित्त विभाग में इस श्रेणी में तीन वर्ष की नियमित सेवा वाले 80000- 220000/-रु के वेतनमान का पद धारित करने वाले अधिकारी पात्र होंगे;

प्रतिनियुक्तिः

(ii) केेंद्र सरकार या राज्य सरकार या संघ शासित प्रशासन/सार्वजनिक क्षेत्र उपक्रम या स्वायत्त निकाय (महापत्तनों से अलग) के वित्त विभाग में 100000- 260000/-रु के वेतनमान में दो वर्ष की नियमित सेवा वाले वित्तीय सलाहाकर और मुख्य लेखा अधिकारी या समतुल्य पद धारित करने वाले अधिकारी या वित्त विभाग में 80000- 220000/-रु. या इससे अधिक के वेतनमान में पांच वर्ष की नियमित सेवा वाले वरिष्ठ उप मुख्य लेखा अधिकारी और समतुल्य पदों को धारित करने वाले अधिकारी पात्र होंगे।

चयन, योग्यता के आधार पर होगा जिसके लिए वार्षिक गोपनीयता रिपोर्टो में समग्र ग्रैडिंग में बैंचमार्क ''बहुत अच्छा'' से नीचे नहीं होगा।

(ग) शीर्षक के अंतर्गत उप संरक्षक के पद से संबंधित क्रम सं. 3 के सामने, - (क) कॉलम 5 में, प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः- ''1,00,000-2,60,000/- रु.

टिप्पणीः तीन वर्ष की नियमित सेवा पूरी होने के बाद केंद्र सरकार के अनुमोदन से वेतनमान को 120000 -280000/- रु के वेतनमान में उन्नयित किया जाएगा;''

(ख) कॉलम 12 में, प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः- ''संयोजन पद्धति के माध्यम से आमेलनः

(i) किसी महापत्तन न्यास में एक वर्ष की नियमित सेवा सहित 100000-260000/- रु. के वेतनमान में हार्बर मास्टर का पद धारित करने वाले अधिकारी अथवा 90000-240000/- रु. के वेतनमान में दो वर्ष की नियमित सेवा सहित हार्बर मास्टर का पद धारित करने वाले अधिकारीे पात्र होंगे''

प्रतिनियुक्ति के लिएः

(ii) केेंद्र सरकार या राज्य सरकार या संघ शासित प्रशासन/सार्वजनिक क्षेत्र उपक्रम या स्वायत्त निकाय (महापत्तनों से अलग) के 100000- 260000/- रु. के वेतनमान में इस श्रेणी में दो वर्ष की नियमित सेवा वाले उप संरक्षक या इसके समतुल्य डैक साइड पद धारित करने वाले अधिकारी या 90000- 240000/- रु. के वेतनमान में इस श्रेणी में चार वर्ष की नियमित सेवा वाले हार्बर मास्टर और इसके समतुल्य डैक साइड पदों को धारित करने वाले अधिकारी पात्र होंगे।

चयन योग्यता के आधार पर होगा जिसके लिए वार्षिक गोपनीयता रिपोर्टों में समग्र ग्रैडिंग में बैंच मार्क ''बहुत अच्छा'' से नीचे नहीं होगा।

(घ) पृष्ठ सं. 137 में, यातायात प्रबंधक (श्रेणी।। पत्तनों) के पद से संबंधित क्रम संख्या 5 के सामने - (क) कॉलम 2 में, प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ''यातायात प्रबंधक'',

(ख.) कॉलम 5 में, प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः- ''1,00,000-2,60,000/- रु.

टिप्पणीः तीन वर्ष की नियमित सेवा पूरी होने के बाद केंद्र सरकार के अनुमोदन से वेतनमान को 120000 - 280000/- रु के वेतनमान में उन्नयित किया जाएगा;''

(ग) कॉलम 12 में, प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः- '' संयोजन पद्धति के माध्यम से आमेलनः

(ii) केेंद्र सरकार या राज्य सरकार या संघ शासित प्रशासन/सार्वजनिक क्षेत्र उपक्रम या स्वायत्त निकाय (महापत्तनों से अलग) के यातायात विभाग में 100000- 260000/-रु. के वेतनमान में इस श्रेणी में दो वर्ष की नियमित सेवा वाले यातायात प्रबंधक और समतुल्य पद धारित करने वाले अधिकारी या यातायात विभाग में 80000- 220000/- रु. और इससे अधिक के वेतनमान में इस श्रेणी में पांच वर्ष की नियमित सेवा वाले वरिष्ठ उप यातायात प्रबंधक और समतुल्य पदों को धारित करने वाले अधिकारी पात्र होंगे।

चयन योग्यता के आधार पर होगा जिसके लिए वार्षिक गोपनीयता रिपोर्टो में समग्र ग्रैडिंग में बैंच मार्क ''बहुत अच्छा'' से नीचे नहीं होगा।

शीर्षक के अंतर्गत, मुख्य यांत्रिक अभियंता (श्रेणी-।। पत्तनोंं) के पद से संबंधित क्रम संख्या 5 के सामने -

(क) कॉलम 2 में प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः-

''मुख्य यांत्रिक अभियंता''

(ख) कॅालम 5 में, प्रविष्टियों के लिए, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, नामतः- ''1,00,000-2,60,000/- रु.

टिप्पणीः तीन वर्ष की नियमित सेवा पूरी होने के बाद केंद्र सरकार के अनुमोदन से वेतनमान को 120000 - 280000/- रु. के वेतनमान में उन्नयित किया जाएगा ;''

(i) किसी महापत्तन न्यास के यांत्रिक और इलैक्ट्रिकल अभियांत्रिकी विभाग और समुद्री विभाग (केवल समुद्री अभियंताओं की श्रेणियों के लिए लागू) में 90000- 240000/-रु के वेतनमान में दो वर्ष की नियमित सेवा वाले पद धारित करने वाले अधिकारी या 80000- 220000/-रु के वेतनमान में तीन वर्ष की नियमित सेवा वाले पद धारित करने वाले अधिकारी पात्र होंगे;

प्रतिनियुक्ति के लिएः

( ii) केेंद्र सरकार या राज्य सरकार या संघ शासित प्रशासन/सार्वजनिक क्षेत्र उपक्रम या स्वायत्त निकाय (महापत्तनों से अलग) के यांत्रिक और इलैक्ट्रिकल अभियांत्रिकी विभाग में 100000- 260000/-रु. के वेतनमान में इस श्रेणी में दो वर्ष की नियमित सेवा वाले मुख्य यांत्रिक अभियंता और समतुल्य पद धारित करने वाले अधिकारी या यांत्रिक और इलैक्ट्रिकल अभियांत्रिकी विभाग में 80000- 220000/-रु. और इससे अधिक के वेतनमान में इस श्रेणी में पांच वर्ष की नियमित सेवा वाले उप मुख्य यांत्रिक अभियंता या इसके समतुल्य पदों को धारित करने वाले अधिकारी पात्र होंगे। चयन योग्यता के आधार पर होगा जिसके लिए वार्षिक गोपनीयता रिपोर्टो में समग्र ग्रैडिंग में बैंचमार्क ''बहुत अच्छा'' से नीचे नहीं होगा।

(i) किसी महापत्तन न्यास के सिविल अभियांत्रिकी विभाग में तीन वर्ष की नियमित सेवा वाले 80000- 220000/-रु के वेतनमान का पद धारित करने वाले अधिकारी पात्र होंगे;

प्रतिनियुक्ति के लिएः

( ii) केेंद्र सरकार या राज्य सरकार या संघ शासित प्रशासन/सार्वजनिक क्षेत्र उपक्रम या स्वायत्त निकाय (महापत्तनों से अलग) के सिविल अभियांत्रिकी विभाग में 100000- 260000/-रु. के वेतनमान में इस श्रेणी में दो वर्ष की नियमित सेवा वाले मुख्य अभियंता और समतुल्य पद धारित करने वाले अधिकारी या सिविल अभियांत्रिकी विभाग में 80000- 220000/-रु. और इससे अधिक के वेतनमान में इस श्रेणी में पांच वर्ष की नियमित सेवा वाले उप मुख्य अभियंता या इसके समतुल्य पदों को धारित करने वाले अधिकारी पात्र होंगे।

(ii) केेंद्र सरकार या राज्य सरकार या संघ शासित प्रशासन/सार्वजनिक क्षेत्र उपक्रम या स्वायत्त निकाय (महापत्तनों से अलग) के चिकित्सा विभाग में 100000- 260000/-रु के वेतनमान में इस श्रेणी में दो वर्ष की नियमित सेवा वाले मुख्य चिकित्सा अधिकारी और समतुल्य पद धारित करने वाले अधिकारी या चिकित्सा विभाग में 80000- 220000/-रु और इससे अधिक के वेतनमान में इस श्रेणी में पांच वर्ष की नियमित सेवा वाले वरिष्ठ उप मुख्य चिकित्सा अधिकारी और समतुल्य स्पेशलिस्ट पदों को धारित करने वाले अधिकारी पात्र होंगे।

NOTIFICATION

New Delhi, the 30th July, 2021

G.S.R. 519(E).—In exercise of the powers conferred by sub-section (1) of section 124 read with sub-section (1) of section 132 of the Major Port Trusts Act, 1963 (38 of 1963), the Central Government hereby approves the Cochin Port Trust Employees (Recruitment, Seniority and Promotion) Amendment Regulations, 2021, made by the Board of Trustees of the Cochin Port Trust as set out in the Schedule annexed to this notification.

2. The said regulations shall come into force on the date of their publication of this notification in the Official Gazette.

SCHEDULE

In exercise of the powers conferred by section 28 of the Major Port Trusts Act, 1963 (38 of 1963), the Board of Trustees of the Cochin Port Trust hereby makes the following regulations further to amend the Cochin Port Trust Employees (Recruitment, Seniority and Promotion) Regulations, 2010, namely :-

1. Short title and commencement.- (1) These regulations may be called Cochin Port Trust Employees (Recruitment, Seniority and Promotion) Amendment Regulations, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Cochin Port Trust Employees (Recruitment, Seniority and Promotion) Regulations, 2010 (hereinafter referred to as the principal regulations), for regulation 4, the following regulation shall be substituted, namely :-

"4. Manner of Appointment .- (1) All appointments to the posts to which these regulations apply shall be made in accordance with the provisions of these regulations.

(2) Appointment may be made either by promotion or by absorption or deputation or direct recruitment.

(3) Appointments in respect of posts treated as Head of Department and posts one level below to the Head of Department, all the vacancies shall be filled by "Composite method of recruitment" through promotion or transfer on absorption basis failing which by deputation from the employees of the Major7 [भाग II—खण्ड ³(i)] भारत का राजपत्र : असाधारण Ports, the Central Government, State Governments, Autonomous Bodies, Government Companies and failing both by direct recruitment.

(4) The promotion or transfer on absorption shall be from the officers from the Major Port Trusts fulfilling the eligibility criteria prescribed in the Schedule annexed to these regulations.

(5) Deputation shall be of employees from the Major Ports, the Central Government, State Governments or Autonomous Bodies or Government Companies fulfilling the eligibility criteria prescribed for the post:

Provided that an employee of a Board of any Major Port Trust shall not be eligible for deputation to the Head of Department level post in the Major Port Trusts.

(6) The normal period of deputation is three years, which is extendable to four years.

(7) In exceptional circumstances, this can be extended to five years by the Central Government in the case of a post, the incumbent of which is regarded as the Head of Department and by the Chairman in the case of any other post below the level of Head of Department.".

3. In the principal regulations, in the Schedule ,- (a) under the heading GL. ADMN - Main. ESTT, against serial number 5, relating to the post of Secretary (Category II Ports),-

(A.) in column 2, for the entries, the following entry shall be substituted, namely :-

"Secretary.";

(B.) in column 5, for the entries, the following entries shall be substituted, namely :–

" Rs.1,00,000 - 260000/-

Note: The pay scale shall be upgraded to the scale of pay of Rs.120000 – 280000/- after completion of three years regular service with the approval of the Central Government."; (C.) in column 12, for the entries, the following entries shall be substituted, namely :-

(i) Officers holding posts in the scale of pay Rs.80000 – 220000/- with three years regular service in the grade in the General Administration Department or Human Resources Development Department of a Major Port Trust shall be eligible.

(A.) in column 2, for the entries, the following entries shall be substituted, namely:,-

(B.) in column 5, for the entries, the following entries shall be substituted, namely:-
