का.आ. 3084(अ).—केन्द्रीय सरकार ने पेट्रोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का अर्जन) अधिनियम, 1962 (1962 का 50) (जिसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 6 की उपधारा (1) के अधीन जारी की गई भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना जिसका प्रकाशन भारत के राजपत्र संख्या 3670 दिनांक 20 नवम्बर 2020 का. आ. 4172 (अ) भाग दिनांक 17 नवम्बर 2020 II खंड उपखंड (ii) में किया गया है। इस अधिसूचना से सलंग्न अनुसूची में विनिर्दिष्टत गुजरात राज्य की तहसील चोरयासी जिला सूरत गुजरात राज्य की भूमि में 24'' व्यास गैस, 18'' व्यास ऑयल/गैस, 8'' व्यास एवं 4'' व्यास पानी की पाइपलाइन कॅम्बे बेसिन CB-OS/2 ब्लॉक से ऑनशोर टर्मिनल साइट सुवाली गॉव तक क्रूड ऑयल/नेचुरल गैस एवं पानी के परिवहन के लिए वेदांता लिमिटेड (केयर्न ऑइल और गैस), ऑयल एण्ड नेचुरल गैस कॉर्पोरेशन (ओएनजीसी) और टाटा पेट्रोडाइन लिमिटेड (टीपीएल) द्वारा क्रियान्वित की जा रही परियोजना के सम्बन्ध में पाइपलाइन बिछाने के उपयोग के अधिकार का अर्जन करने के लिये अपने आशय की घोषणा की थी। और उक्त राजपत्र अधिसूचना की प्रतियाँ जनता को तारीख 14 दिसम्बर 2020 को उपलब्ध करा दी गई थीं। और उक्त अधिनियम की धारा 6 की उपधारा (1) के अनुसरण में सक्षम प्राधिकारी ने केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है।
और केन्द्रीय सरकार ने उक्त रिपोर्ट पर विचार करने के पश्चात और यह समाधान हो जाने पर कि उक्त भूमि पाइपलाइन बिछाने के लिये अपेक्षित है उसमेें उपयोग के अधिकार का अर्जन करने का विनिश्चय किया है।
अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतद्द्वारा घोषणा करती है कि इस अधिसूचना से सलंग्न अनुसूची में विनिर्दिष्ट भूमि में पेट्रोलियम पाइपलाइन बिछाने के उपयोग का अधिकार अर्जित किया जाए।
और केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उपधारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से केन्द्रीय सरकार में निहित होने के बजाय सभी विल्लंगमों से मुक्त होकर वेदांता लिमिटेड (केयर्न ऑइल और गैस), ऑयल एण्ड नेचुरल गैस कॉर्पोरेशन (ओएनजीसी) और टाटा पेट्रोडाइन लिमिटेड (टीपीएल) में निहित होगा।

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पेट्रोलियम और खनिज पाइपलाइन अधिनियम, 1962 की धारा 10 के अधीन किसी भी क्षतिपूर्ति के लिए वेदांता लिमिटेड (केयर्न ऑइल और गैस), ऑयल एण्ड नेचुरल गैस कॉर्पोरेशन (ओएनजीसी) और टाटा पेट्रोडाइन लिमिटेड (टीपीएल) पूर्णतया उत्तरदायी होगी और पाइपलाइन से सम्बन्धित किसी भी मामले के विरूद्ध कोई वाद दावा या कानूनी कार्यवाही नहीं हो सकेगी।

NOTIFICATION
New Delhi, the 28th July, 2021
S.O. 3084(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and Natural Gas, Published in the Gazette No. 3670 date 20 November, 2020 S.O. No. 4172 (A) Date 17 November 2020, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (Hereinafter referred to as the said Act), the Central Government declared its intention to acquire the right of user in the land situated in Tehsil Choryasi of District Surat in Gujarat State, specified in the schedule appended to that notification for the purpose of laying of Crude/Gas & Water from 24"Ø Gas 18"Ø Crude/Gas, 8"Ø & 4"Ø Water Pipeline from CB-OS/2 Block of Cambay Basin to Onshore Terminal site near Suvali village in the State of Gujarat by Vedanta Limited – Cairn Oil & Gas on behalf of Joint Venture (JV) consortium of Vedanta Limited - Cairn Oil & Gas, Oil and Natural Gas Corporation (ONGC) and Tata Petrodyne Ltd. (TPL).
And whereas copies of the said Extra Ordinary Gazette notification were made available to the public on 14 December. 2020.
And whereas the competent authority has under sub-section (1) of section 6 of the said Act has submitted report to the Central Government.
And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Vedanta Limited – Cairn Oil & Gas on [भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण
3 behalf of Joint Venture (JV) consortium of Vedanta Limited - Cairn Oil & Gas, Oil and Natural Gas Corporation (ONGC) and Tata Petrodyne Ltd. (TPL), free from all encumbrances.
Vedanta Limited - Cairn Oil & Gas on behalf of Joint Venture (JV) consortium of Vedanta Limited - Cairn Oil & Gas, Oil and Natural Gas Corporation (ONGC) and Tata Petrodyne Ltd. (TPL).shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
