(विदेशी पोर्टफोलियो निवेशक) (संशोधन) विनियम, 2021
सं. सेबी/एल.ए.डी.-एन.आर.ओ./जी.एन./2021/32.—भारतीय प्रतिभूति और विनिमय बोर्ड, भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 की धारा 11 की उप-धारा (1), धारा 11 की उप-धारा (2) के खंड (खक) तथा धारा 12 की उप-धारा (1) एवं (1क) के साथ पठित धारा 30 की उप-धारा (1) द्वारा, और निक्षेपागार अधिनियम, 1996 की धारा 25 के तहत, प्रदान की गई शक्तियों का प्रयोग करते हुए, एतद्द्वारा, भारतीय प्रतिभूति और विनिमय बोर्ड (विदेशी पोर्टफोलियो निवेशक) विनियम, 2019 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात्,- 1. इन विनियमों को भारतीय प्रतिभूति और विनिमय बोर्ड (विदेशी पोर्टफोलियो निवेशक) (संशोधन) विनियम, 2021 कहा जा सके गा ।
2. वे राजपत्र में उनके प्रकाशन की तारीख को लागू होंगे ।
3. भारतीय प्रतिभूति और विनिमय बोर्ड (विदेशी पोर्टफोलियो निवेशक) विनियम, 2019 में,-
I. विनियम 2 में, उप-विनियम (1) में, खंड (ढ) में, शब्द "भारत के विदेशी नागरिक", शब्दों "किसी दूसरी देश की नागरिकता रखने वाले भारतीय मूल के नागरिक" से प्रतिस्थापित हो जाएँगे ।

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] II. विनियम 4 में, -
(i) खंड (ख) में, शब्द "भारत का विदेशी नागरिक", शब्दों "किसी दूसरी देश की नागरिकता रखने वाला भारतीय मूल का नागरिक" से प्रतिस्थापित हो जाएँगे।
(ii) खंड (ग) निम्नलिखित से प्रतिस्थापित हो जाएगा, अर्थात्,-
"(ग) अनिवासी भारतीय या किसी दूसरी देश की नागरिकता रखने वाले भारतीय मूल के नागरिक या निवासी भारतीय (जो व्यक्ति हों) आवेदक का हिस्सा हो सकते हैं, बशर्ते कि वे बोर्ड द्वारा समय- समय पर निर्धारित की जाने वाली शर्तें पूरी करें:
परंतु यह कि ऐसे निवासी भारतीय भी आवेदक का हिस्सा हो सकते हैं जो व्यक्ति न हों, बशर्ते कि नीचे दी हुई शर्तें पूरी होती हों, अर्थात् –
i. ऐसा निवासी भारतीय (जो व्यक्ति न हो) आवेदक का पात्र निधि प्रबंधक (फंड मैनेजर) [आय-कर अधिनियम, 1961 (1961 का 43) की धारा 9क (9ए) की उप-धारा (4) के अनुसार] हो; और ii. आवेदक ऐसी पात्र निवेश निधि (इन्वेस्टमेंट फंड) [आय-कर अधिनियम, 1961 (1961 का 43) की धारा 9क (9ए) की उप-धारा (3) के अनुसार] हो, जिसे आय-कर नियम, 1962 के तहत मंजूरी प्रदान की गई हो; "

(1) 19 दिसम्बर, 2019 को भारतीय प्रतिभूति और विनिमय बोर्ड (विदेशी पोर्टफोलियो निवेशक) (संशोधन) विनियम 2019, सं. सेबी/एल.ए.डी.-एन.आर.ओ./जी.एन./2019/44, द्वारा
(2) 7 अप्रैल, 2020 को भारतीय प्रतिभूति और विनिमय बोर्ड (विदेशी पोर्टफोलियो निवेशक) (संशोधन) विनियम 2020, सं. सेबी/एल.ए.डी.-एन.आर.ओ./जी.एन./2020/09, द्वारा
(3) 17 अप्रैल, 2020 को भारतीय प्रतिभूति और विनिमय बोर्ड (रेग्यूलेटरी सैंडबॉक्स) (संशोधन) विनियम, 2020, सं. सेबी/एल.ए.डी.-एनआरओ/जीएन/2020/10, द्वारा
संशोधित हुए थे ।

SECURITIES AND EXCHANGE BOARD OF INDIA (FOREIGN PORTFOLIO INVESTORS)
(AMENDMENT) REGULATIONS, 2021
No. SEBI.LAD-NRO/GN/2021/32.—In exercise of the powers conferred by sub-section (1) of Section 30 read with sub section (1) of Section 11, clause (ba) of sub-section (2) of Section 11 and sub-sections (1) and (1A) of Section 12 of the Securities and Exchange Board of India Act, 1992, and under Section 25 of the Depositories Act, 1996, the Securities and Exchange Board of India hereby, makes the following regulations, to further amend the Securities and Exchange Board of India (Foreign Portfolio Investors) Regulations, 2019, namely,-
1. These regulations may be called the Securities and Exchange Board of India (Foreign Portfolio Investors) (Amendment) Regulations, 2021.

3. In the Securities and Exchange Board of India (Foreign Portfolio Investors) Regulations, 2019 – I. In Regulation 4, clause (c) shall be substituted with the following, namely, –
"(c) non-resident Indians or overseas citizens of India or resident Indian individuals
may be constituents of the applicant provided they meet the conditions specified by the
Board from time to time:
Provided that resident Indian other than individuals, may also be constituents of the
applicant, subject to the following conditions, namely –
i. such resident Indian, other than individuals, is an eligible fund manager of
the applicant, as provided under sub-section (4) of section 9A of the Income
Tax Act, 1961 (43 of 1961); and
ii. the applicant is an eligible investment fund as provided under sub-section (3)
of section 9A of the Income Tax Act, 1961 (43 of 1961) which has been
granted approval under the Income Tax Rules, 1962;"
