का.आ. 3115(अ).—जबकि राष्ट्रीय सहबद्ध और स्वास्थ्य देख-रेख वृत्ति आयोग अधिनियम, 2021 (2021 का 14) (जिसे इसके आगे अधिनियम कहा जाएगा) को राष्ट्रपति की सहमति 28 मार्च, 2021 को प्राप्त हुई।
और जबकि अधिनियम की धारा 3 की उपधारा (1) में प्रावधान है कि के न्द्र सरकार की अधिसूचना द्वारा इस संबंध में तय की गई तारीख से एक आयोग गठित किया जाएगा जिसे राष्ट्रीय सहबद्ध और स्वास्थ्य देख-रेख वृत्ति आयोग कहा जाएगा, जो इस अधिनियम के तहत यथानिर्धारित शक्तियों का प्रयोग करेगा और कत्र्तव्यों का निर्वहन करेगा। और जबकि अधिनियम की धारा 20 की उप-धारा (1) में प्रावधान है कि के न्द्र सरकार इस अधिनियम को राष्ट्रपति की सहमति मिलने के शीघ्र बाद, परन्तु उक्त सहमति मिलने की तारीख से 60 दिनों के भीतर, तीन वर्षों के लिए या इस अधिनियम की धारा 3 के तहत नियमित आयोग गठित होने तक, जो भी पहले हो, एक अंतरिम आयोग गठित करेगा।
और जबकि भारत में कोविड महामारी की दूसरी लहर के कारण, अंतरिम आयोग निर्धारित अवधि के भीतर गठित नहीं किया जा सका और उसके कारण अधिनियम की धारा 20 के उक्त उपबंधों के अनुपालन में कठिनाइयां आई। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 1. लघुशीर्षक और प्रारंभ: (1) इस आदेश को राष्ट्रीय सहबद्ध और स्वास्थ्य देख-रेख वृत्ति आयोग प्रथम (कठिनाइयों का समापन) आदेश, 2021 कहा जाएगा। (2) यह राजपत्र में प्रकाशन की तारीख से लागू होगा।
2. एतद्द्वारा स्पष्ट किया जाता कि के न्द्र सरकार इस अधिनियम को राष्ट्रपति की सहमति मिलने के शीघ्र बाद, परन्तु उक्त सहमति मिलने की तारीख से छह माह के भीतर, तीन वर्षों के लिए या इस अधिनियम की धारा 3 के तहत नियमित आयोग गठित किए जाने तक, जो भी पहले हो, एक अंतरिम आयोग गठित करेगा।

ORDER
New Delhi, the 3rd August, 2021
S.O. 3115(E).—Whereas the National Commission for Allied and Healthcare Professions Act, 2021 (14 of 2021) (hereinafter referred to as the Act) received the assent of the President on 28th March, 2021;
AND WHEREAS sub-section (1) of section 3 of the Act provides that with effect from such date as the Central Government may, by notification, appoint in this behalf, there shall be constituted a Commission to be called the National Commission for Allied and Healthcare Professions for exercising such powers and discharging such duties as may be laid down under the Act.
AND WHEREAS sub-section (1) of section 20 of the Act provides that the Central Government shall, as soon as may be but within sixty days from the date on which the Act receives the assent of the President, constitute an Interim Commission, for three years or until a regular Commission is constituted under section 3 of the Act, whichever is earlier.
AND WHEREAS due to the second wave of the Covid pandemic in India, the Interim Commission could not be constituted within the stipulated period and because of that difficulties have arisen regarding compliance with the said provisions of section 20 of the Act.
NOW, THEREFORE, in exercise of the powers conferred by section 69 of the National Commission for Allied and Healthcare Professions Act, 2021 (14 of 2021), the Central Government hereby makes the following Order, to remove the above said difficulties, namely:
1. Short title and commencement:
(1) This Order may be called the National Commission for Allied and Healthcare Professions 1st (Removal of Difficulties) Order, 2021.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. It is hereby clarified that the Central Government shall, as soon as may be but within six months from the date on which the Act receives the assent of the President, constitute an Interim Commission, for three years or until a regular Commission is constituted under section 3 of the Act, whichever is earlier.
