सा.का.नि. 340(अ).—कें द्रीय मोटर यान नियम, 1989 निम्न्लिखित प्रारूप नियम, जिसे कें द्रीय सरकार, मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 39 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कु छ नियमों में और संशोधन करने का प्रस्ताव करती है, को उक्त अधिनियम की धारा 212 की उप-धारा (1) द्वारा यथापेक्षित उनके द्वारा संभाव्य प्रभावित सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है और एतदद्वारा नोटिस दिया जाता है कि उक्त प्रारूप नियमों पर उस तारीख से जब इस अधिसूचना की प्रतियां, भारत के राजपत्र में यथाप्रकाशित, आम जनता को उपलब्ध कराई जाती हैं, से तीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा। आक्षेप या सुझाव, यदि कोई हों, संयुक्त सचिव (एमवीएल, परिवहन, टोल), सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, संसद मार्ग, नई दिल्ली- 110001 को भेजे जा सकें गे अथवा [email protected]; पर ई-मेल किए जा सकें गे।

आक्षेप या सुझाव, जो किसी व्यक्ति से उक्त प्रारूप नियमों के संबंध में इस प्रकार विनिर्दिष्ट अवधि की समाप्ति के भीतर प्राप्त किए जाते हैं, पर कें द्रीय सरकार द्वारा विचार किया जाएगा;

प्रारूप नियम

1. (1) इन नियमों को कें द्रीय मोटर यान (....... संशोधन) नियम, 2021 कहा जा सकता है।

(2) ये नियम सरकारी राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे।

3090 GI/20222 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. के न्द्रीय मोटर वाहन नियम, 1989 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) में, नियम 33 के स्थान पर, निम्नलिखित नियम को प्रतिस्थापित किया जाएगा, अर्थात्:-

"33. व्यवसाय प्रमाण पत्र की आवश्यकता - व्यवसाय प्रमाण पत्र उन मोटर वाहनों के निर्माताओं या मोटर वाहनों के डीलरों या नियम 126 में निर्दिष्ट परीक्षण एजेंसियों या मोटर वाहनों के आयातकों या कें द्र सरकार द्वारा निर्दिष्ट किसी भी संस्था (ओं) के लिए आवश्यक है, जिनके पास ऐसे वाहन हैं जो न तो पंजीकृ त हैं न ही अस्थायी रूप से पंजीकृ त हैं। " 3. उक्त नियमों में, नियम 33 के पश्चात्, निम्नलिखित नियम अंत:स्थापित किए जाएंगे, अर्थात् –

"33ए. पंजीकरण से छू ट की शर्त -

धारा 39 के परंतुक के प्रयोजन के लिए, नियम 33 में निर्दिष्ट किसी संस्था (ओं) के कब्जे में का मोटरयान रजिस्ट्रीकरण की आवश्यकता से इस शर्त के अधीन छू ट प्राप्त होगी कि वह उस रजिस्ट्रीकर्ता प्राधिकारी से व्यवसाय प्रमाणपत्र प्राप्त करता है जिसकी उस क्षेत्र में अधिकारिता है जिसमें संस्थाओं को इस अध्याय के अनुसार कारोबार का स्थान है।

4.उक्त नियमों में, नियम 34 में,-

(i) उप नियम (1) में, -

(क) शब्दों "व्यापार प्रमाण पत्र बनाया जाएगा" के बाद शब्द "इलेक्ट्रॉनिक रूप से वाहन पोर्टल पर" अंत:स्थापित किए जाएंगे।

(ख) शब्दों "नियम 81 में विनिर्दिष्ट फीस" के बाद शब्द "वाहन पोर्टल पर इलेक्ट्रॉनिक रूप से प्रस्तुत" अंत:स्थापित किए जाएंगे।

(ii) उप नियम (2) में, "पृथक् " शब्द का विलोपन किया जाएगा।

(iii) उप नियम (2) के बाद, निम्नलिखित उप नियम अंतःस्थापित किया जाएगा, अर्थात्:-

"(3) आवश्यक व्यवसाय प्रमाण पत्र चिन्हों की संख्या आवेदन में निर्दिष्ट की जाएगी।"

5. उक्त नियमों में, नियम 35 के स्थान पर, निम्नलिखित नियम अंत:स्थापित किए जाएंगे, अर्थात्:-

"35. व्यवसाय प्रमाणपत्र का अनुदान या नवीनीकरण। -

(1) किसी यान के संबंध में किसी व्यवसाय प्रमाणपत्र के दिए जाने या नवीनीकरण के लिए किसी आवेदन की प्राप्ति पर रजिस्ट्रीकर्ता प्राधिकारी, यदि संतुष्ट हो जाता है, ऐसे आवेदन की प्राप्ति की तारीख से पंद्रह दिनों के भीतर फॉर्म 17 में आवेदक को व्यवसाय प्रमाण पत्र, पोर्टल पर इलेक्ट्रॉनिक रूप से, डाउनलोड करने योग्य और प्रिंट करने योग्य रूप, में जारी कर सकता है।

व्यवसाय प्रमाणपत्र संख्या इस प्रकार होगी -

एबी 12 ए 1234 टीसी

एबी- राज्य कोड दर्शाता है,

12- आरटीओ कोड दर्शाता है,

ए. - नियम 34(2) में निर्धारित वाहन की श्रेणी की क्रम संख्या दर्शाता है अर्थात ए से जे तक,

1234- चार अंकों की विशिष्ट पहचान संख्या दर्शाता है जिसे संबंधित प्राधिकारी द्वारा व्यवसाय प्रमाण पत्र धारक को सौंपा जाना है,

टीसी- व्यवसाय प्रमाणपत्र दर्शाता है,

एक व्यवसाय रजिस्ट्रीकरण चिन्ह और संख्यांक होगा जिसके बाद चार अंकों के अंक 0001 से 9999 तक निम्नानुसार होंगे- एबी 12 ए 1234 टीसी 00013 [भाग II—खण्ड ³(i)] भारत का राजपत्र : असाधारण (2) व्यवसाय प्रमाणपत्र के लिए किसी भी आवेदन को पंजीकरण प्राधिकारी द्वारा तब तक अस्वीकार नहीं किया जाएगा जब तक कि आवेदक को सुनवाई का अवसर नहीं दिया जाता है और लिखित रूप में इस तरह के इनकार के कारण नहीं दिए जाते हैं।"

6. उक्त नियमों में, नियम 35 के बाद, निम्नलिखित नियम अंत:स्थापित किए जाएंगे, अर्थात्:-

(i) "35क. अतिरिक्त व्यवसाय रजिस्ट्रीकरण चिह्न के लिए आवेदन। -

1. अतिरिक्त व्यवसाय रजिस्ट्रीकरण चिह्न प्रदान करने के लिए आवेदन प्रपत्र 17ए में पोर्टल पर इलेक्ट्रॉनिक रूप से पंजीकरण प्राधिकारी को किया जाएगा जिसने व्यवसाय प्रमाणपत्र प्रदान किया था और नियम 81 में निर्दिष्ट उचित शुल्क के साथ होगा। शुल्क पोर्टल पर इलेक्ट्रॉनिक रूप से जमा किया जाएगा।

2. एक व्यवसाय प्रमाण पत्र के संबंध में अतिरिक्त व्यवसाय पंजीकरण चिह्न प्रदान करने के लिए एक आवेदन प्राप्त होने पर, अगर पंजीकरण प्राधिकारी इस बात से संतुष्ट है कि आवेदक के पास एक वैध व्यवसाय प्रमाण पत्र है और अतिरिक्त व्यवसाय पंजीकरण चिह्न की आवश्यकता है, आवेदक को इस तरह के आवेदन की प्राप्ति की तारीख से सात दिनों के भीतर फॉर्म 17बी में अतिरिक्त व्यवसाय पंजीकरण चिह्न जारी कर सकता है।"

(ii) "35ख. व्यवसाय प्रमाण पत्र में व्यवसाय के स्थान के पते में परिवर्तन की सूचना —

1. यदि व्यवसाय प्रमाण पत्र में विनिर्दिष्ट व्यवसाय का स्थान बदल जाता है, तो व्यवसाय प्रमाण पत्र धारक नियम 81 में विनिर्दिष्ट उचित शुल्क के साथ पोर्टल पर इलेक्ट्रॉनिक रूप से फॉर्म 17सी में तुरंत इस तरह के परिवर्तन के बारे में उस प्राधिकारी को सूचित करेगा जिसने व्यवसाय प्रमाण पत्र प्रदान किया है।

2. व्यवसाय के स्थान में परिवर्तन की सूचना प्राप्त होने पर, पंजीकरण प्राधिकारी, यदि संतुष्ट हो कि आवेदक के पास एक वैध व्यवसाय प्रमाण पत्र है, व्यवसाय प्रमाण पत्र में नया पता दर्ज कर सकता है।

7. उक्त नियमों के , नियम 37 में, "बारह महीने" शब्दों के लिए "पांच वर्ष" शब्दों को अंत :स्थापित किया जाएगा । 8. उक्त नियमों के , नियम 38 को विलोपित किया जाएगा।

9. उक्त नियमों के , नियम 39 में, -

(i) उप -नियम ) 1 (में, "ऑटोमोबाइल या ऑटोमोबाइल सहायक के डीलर या निर्माता या नियम 126 में विनिर्दिष्ट एक परीक्षण एजेंसी" शब्दों को "व्यवसाय प्रमाण पत्र धारक" शब्दों द्वारा प्रतिस्थापित किया जाएगा। (ii) उप-नियम (2) को निम्नलिखित उप-नियम द्वारा प्रतिस्थापित किया जाएगा, अर्थात्:-

"(2) व्यवसाय रजिस्ट्रीकरण चिह्न नियम 51 में विनिर्दिष्ट आयामों के अनुसार लाल पृष्ठभूमि पर सफे द रंग में होगा और मोटर यान के आगे और पीछे प्रदर्शित किया जाएगा।"

10. उक्त नियमों के , नियम 40 के शीर्षक में "व्यवसाय प्रमाण पत्र या व्यवसाय रजिस्ट्रिकरण चिन्ह और संख्यांक के उपयोग पर निर्बंधन" शब्दों को "व्यवसाय रजिस्ट्रिकरण चिन्ह के उपयोग पर निर्बंधन" शब्दों द्वारा प्रतिस्थापित किया जाएगा। 11. उक्त नियमों के , नियम 40 में,

(क) "प्रमाण पत्र" शब्दों को "रजिस्ट्रीकरण चिन्ह" शब्दों द्वारा प्रतिस्थापित किया जाएगा।

(ख) "प्रमाण पत्र या संख्यांक" शब्दों को "व्यवसाय रजिस्ट्रीकरण चिन्ह" शब्दों द्वारा प्रतिस्थापित किया जाएगा। 12. उक्त नियमों के , नियम 41 में, "उद्देश्य जिसके लिए व्यवसाय प्रमाण पत्र के साथ मोटर वाहन का उपयोग किया जा सकता है" शब्दों को "उद्देश्य जिसके लिए व्यवसाय रजिस्ट्रीकरण चिह्न वाले मोटर वाहन का उपयोग किया जा सकता है" शब्दों द्वारा प्रतिस्थापित किया जाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 13. उक्त नियमों के , नियम 41 में,

(क) "व्यवसाय प्रमाण पत्र" शब्दों को "व्यवसाय रजिस्ट्रिकरण चिन्ह" शब्दों द्वारा प्रतिस्थापित किया जाएगा। (ख) उपवाक्य (ज) को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा, अर्थात्: -

"(ज) मोटरयान या किसी ऐसे अन्य स्थान की प्रदर्शनी को जहां यान विक्रय के लिए प्रस्थापित किये जाते हैं या किये जा रहे हैं, अग्रसर होने या उससे वापसी के लिए; या।"

14. उक्त नियमों के , नियम 43 के शीर्षक में, "व्यवसाय प्रमाणपत्र का रजिस्टर" शब्दों को "व्यवसाय रजिस्ट्रीकरण चिह्नों का रजिस्टर" शब्दों द्वारा प्रतिस्थापित किया जाएगा।

15. उक्त नियमों के , नियम 43 के पश्चात्, निम्नलिखित नियम अंत:स्थापित किए जाएंगे, अर्थात्:-

"43क. इन्वेंट्री का रजिस्टर- व्यवसाय प्रमाण पत्र रखने वाले मोटर वाहन के प्रत्येक डीलर को पोर्टल पर फॉर्म 19क में इलेक्ट्रॉनिक रूप से मोटर वाहनों की इन्वेंट्री का एक रजिस्टर रखना होगा।

16. उक्त नियमों के , नियम 44, को निम्नलिखित नियमों द्वारा प्रतिस्थापित किया जाएगा, अर्थात्:-

"44. व्यवसाय प्रमाण पत्र का निलम्बन या रद्द किया जाना – यदि रजिस्ट्रीकर्ता प्राधिकारी के पास यह विश्वास करने का कारण है कि किसी व्यवसाय प्रमाणपत्र के धारक ने नियम 39 से 43क तक के उपबन्धों का अनुपालन नहीं किया है,यथोचित प्रमाणों के साथ धारा 213 के अधीन स्थापित मोटरयान विभाग के विभागाध्यक्ष को उक्त प्रावधानों के गैर-अनुपालन के तथ्य को रिपोर्ट कर सके गा। विभागाध्यक्ष व्यवसाय प्रमाण पत्र धारक को सुनवाई का अवसर देने के पश्चात्, उसके द्वारा धारित व्यवसाय प्रमाणपत्र को निलंबित या रद्द कर सके गा।." 17. उक्त नियमों के , नियम 45 में, "धारा 213 के अधीन स्थापित मोटरयान विभाग के प्रमुख" शब्दों को "राज्य परिवहन अपीलीय न्यायाधिकरण या संबंधित राज्यों / संघ राज्य क्षेत्रों द्वारा इस संबंध में तय किए गए किसी भी प्राधिकरण" शब्दों द्वारा प्रतिस्थापित किया जाएगा।

18. उक्त नियमों के , नियम 81 में,

क. तालिका में, क्रमांक 1 के स्थान पर, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, अर्थात्:

ख. तालिका में, क्रमांक 2 के स्थान पर निम्नलिखित क्रमांक रखा जाएगा, अर्थात्:

19. उक्त नियमों में, प्रपत्र 16 में, -

(क) शीर्षक में , "व्यवसाय प्रमाण पत्र के अनुदान या नवीनीकरण के लिए आवेदन पत्र" शब्दों के पश्चात "और व्यवसाय पंजीकरण चिह्न" शब्द अंतःस्थापित किये जायेगें।5 [भाग II—खण्ड ³(i)] भारत का राजपत्र : असाधारण (ख) पैरा 1 में , "प्रमाणपत्रों" शब्दों के स्थान पर "प्रमाणपत्र" शब्द प्रतिस्थापित किए जाएंगे।

(ग) क्रम संख्या के बाद 3, निम्नलिखित क्रमांक सं. अंतःस्थापित किए जाएंगे अर्थात्:-

"3क .व्यवसाय के स्थान का पता"

(घ) क्रम संख्या 4 में, "ऑटोमोबाइल के निर्माता या डीलर" शब्दों के लिए "मोटर वाहनों के निर्माता या मोटर वाहनों के डीलर" शब्दों को प्रतिस्थापित किया जाएगा।

(ड.) क्रम संख्या 4 में , "उक्त नियमों के नियम 126 के तहत निर्दिष्ट एक परीक्षण एजेंसी" शब्दों से पहले "या ऑटोमोबाइल सहायक" शब्द विलोप किये जायेगें।

(च) क्रम संख्या 4 में, "उक्त नियमों के नियम 126 के तहत निर्दिष्ट एक परीक्षण एजेंसी" शब्दों के बाद और कोष्ठक में "या मोटर वाहनों के आयातक या कें द्र सरकार द्वारा निर्दिष्ट किसी भी इकाई, (यदि आवेदक के पास वाहन निर्माता द्वारा जारी प्राधिकरण पत्र मोटर वाहन के डीलर के पास है तो इसे को आवेदन के साथ प्रस्तुत किया जाएगा)" अंतःस्थापित किया जायेगा।

(छ) क्रम संख्या 4 में, शब्द और अंक "मोटर वाहनों में, वाहनों के स्वीकृ त मरम्मतकर्ता, वाहनों के लिए ढाँचा निर्माण में लगे हुए, भाड़े की खरीद / पट्टे / वाहनों को गिरवी रखना के व्यवसाय में लगे हुए हैं।" शब्दों का विलोप किया जायेगा। (ज) क्रम संख्या 5, 6, 7 और 8 विलोप कर दिए जायेगे।

(झ) "घोषणा" शब्दों के पहले निम्नलिखित तालिका अंतःस्थापित की जाएगी, अर्थात्:-

(त्र) "आवेदक के हस्ताक्षर" शब्दों के बाद "या आवेदक के डिजिटल/ई हस्ताक्षर" शब्द और चिन्ह जोड़े जाएंगे। 20. उक्त नियमों में, प्रपत्र 17 में, -

(क) शीर्षक में , "व्यवसाय पंजीकरण का प्रपत्र" शब्दों के बाद "और व्यवसाय रजिस्ट्रेशन चिन्ह" शब्द अंतःस्थापित किया जायेगा।

(ख) शीर्षक में , शब्द, चिन्ह और कोष्ठक "(70 मिलीमीटर के व्यास के आकार में मुद्रित किए जाने के लिए)" का विलोप किया जाएगा।

(ग) क्रम संख्या 1 में, "प्रमाणपत्र की क्रम संख्या" शब्दों के स्थान पर "व्यवसाय प्रमाणपत्र संख्या" शब्द अंतःस्थापित किया जायेगा।

(घ) क्रम संख्या 2 पश्चात, निम्नलिखित क्रमांक सं. अंतःस्थापित किए जायेगे, अर्थात्:-

"2ए .व्यवसाय के स्थान का पता"

(ड.) क्रम संख्या 3, 4, 6 और 7 विलोप किए जाएंगे।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (च) क्रम संख्या 5 के बाद निम्नलिखित तालिका अंतःस्थापित की जाएगी, अर्थात्: -

(छ) शब्द, चिन्ह "क्षेत्र/" का विलोप किया जाएगा ।

(ज) "राज्य के रजिस्ट्रेंशन प्राधिकरण" शब्दों के पश्चात , शब्द और कोष्ठक "(डिजिटल रूप से हस्ताक्षरित)" अंतःस्थापित किया जाएगा।

( i ) क्यूआर कोड प्रपत्र 17 में अंतःस्थापित किया जाएगा

21. उक्त नियमों में, प्रपत्र 17 में, अनुसूची, और इसके तहत सदृश प्रविष्टियों का विलोप किया जाएगा।

22. उक्त नियमों में, प्रपत्र 17 के बाद, निम्नलिखित प्रपत्रों को अंत:स्थापित किया जाएगा, अर्थात्: -

G.S.R. 340(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 39 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public. Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL, Transport & Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the email: [email protected];

The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government.

Draft Rules

1. (1) These rules may be called as Central Motor Vehicles (…. Amendment) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), for Rule 33, following rule shall be substituted, namely: -

"33. Necessity of Trade certificate- Trade certificate is necessary for those manufacturers of motor vehicles or dealers of motor vehicles or test agencies specified in rule 126 or importers of motor vehicles or any entity(s) specified by central government, who possess vehicles which are neither registered nor temporarily registered." 3. In the said rules, after Rule 33, following Rules shall be inserted, namely –9 [भाग II—खण्ड ³(i)] भारत का राजपत्र : असाधारण

"33A. Condition for exemption from registration. —

For the purpose of the proviso to section 39, a motor vehicle in the possession of any of the entity(s) referred in rule 33, shall be exempted from the necessity of registration subject to the condition that such entity(s) obtain a trade certificate from the registering authority having jurisdiction in the area in which entity(s) have places of business, in accordance with the provisions of this Chapter.

4. In the said rules, in Rule 34, -

(i) in sub rule (1), -

(a) after the words "trade certificate shall be made" the words "electronically on the VAHAN portal" shall be inserted.

(b) after the words "fee as specified in rule 81" the words "submitted electronically on the VAHAN Portal" shall be inserted.

(ii) in sub rule (2), the words "separate" shall be omitted.

(iii) after sub rule (2), following sub rule shall be inserted, namely: -

"(3) Numbers of Trade registration marks required shall be specified in the application."

5. In the said rules, for Rule 35, following rule shall be substituted, namely: -

"35. Grant or renewal of trade certificate. —

(1) On receipt of an application for the grant or renewal of a trade certificate in respect of a vehicle, the registering authority may, if satisfied, issue to the applicant Trade certificate, electronically on portal, in downloadable and printable form, in Form 17 within fifteen days from the date of receipt of such an application.

Trade certificate number shall be as follows -

AB 12 A 1234 TC

AB—Represents State Code,

12—Represents RTO Code,

A. - Represents serial number of class of vehicle as prescribed in Rule 34(2) i.e. from A to J, 1234- Represents four digit unique identification number to be assigned by the concerned authority to the holder of a trade certificate,

TC—Represent trade certificate,

A trade registration mark will be trade certificate number followed by four digit numerals starting from 0001 to 9999 as follows-

AB 12 A 1234 TC 0001

(2) No application for trade certificate shall be refused by the registering authority unless the applicant is given an opportunity of being heard and reasons for such refusal are given in writing."

6. In the said rules, after rule 35, the following rules shall be inserted, namely: -

(i) "35A. Application for additional Trade registration mark. —

1. An application for the grant of additional Trade registration mark shall be made electronically on portal in Form 17A to the registering authority which granted the trade certificate and shall be accompanied by the appropriate fee as specified in rule 81. The fees shall be submitted electronically on portal.

2. On receipt of an application for the grant of additional Trade registration mark in respect of a Trade certificate, the registering authority may, if satisfied that the applicant holds a valid Trade certificate and requires additional Trade registration mark, issue to the applicant additional Trade registration mark, in Form 17B within seven days from the date of receipt of such an application"10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(ii) "35B. Intimation of change of address of place of business in trade certificate—

1. If the place of business specified in the trade certificate is changed, then the holder of trade certificate shall immediately intimate to the authority which granted the trade certificate, about such change, electronically on portal in Form 17C accompanied by the appropriate fee as specified in rule 81.

2. On receipt of intimation of change of place of business, the registering authority may, if satisfied that the applicant holds a valid Trade certificate, record new address in the trade certificate."

7. In the said rules, in Rule 37, for the words "twelve months" the words "five years" shall be inserted.

8. In the said rules, rule 38 shall be omitted.

9. In the said rules, in Rule 39, -

(i) in sub rule (1), for the words "the dealer or manufacturer of automobiles or automobiles ancillaries or a test agency specified in rule 126" the words "the holder of trade certificate" shall be substituted.

(ii) for sub rule (2), the following sub rule shall be substituted, namely: -

"(2) The trade registration mark shall be in white colour on red background as per dimensions specified in rule 51 and shall be exhibited on front and rear of motor vehicle."

10. In the said rules, in the heading of Rule 40, for the words "Restrictions on use of trade certificate or trade registration mark and number" the words "Restrictions on use of trade registration mark" shall be substituted.

11. In the said rules, in Rule 40,

(a) for the word "certificate" the words "registration mark" shall be substituted.

(b) for the words "certificate or the number" the words "trade registration mark" shall be substituted.

12. In the said rules, in the heading of Rule 41, for the words "Purposes for which motor vehicle with trade certificate may be used" the words "Purposes for which motor vehicle with trade registration mark may be used" shall be substituted.

13. In the said rules, in Rule 41,

(a) for the words "trade certificate", the words "trade registration mark" shall be substituted.

(b) for clause (h) following clause shall be substituted, namely: -

"(h) for proceeding to or returning from the place of demonstration of vehicle for sale purpose or for keeping vehicle for display at such place of demonstration."

14. In the said rules, in the heading of Rule 43, for the words "Register of trade certificate" the words "Register of trade registration marks" shall be substituted.

15. In the said rules, after rule 43, the following rules shall be inserted, namely: -

"43A. Register of inventory—Every dealer of motor vehicle holding a trade certificate shall maintain a register of inventory of motor vehicles electronically in Form 19A on the portal."

16. In the said rules, for rule 44, the following rules shall be substituted, namely: -

"44. Suspension or cancellation of trade certificate. - If the registering authority has reason to believe that the holder of any trade certificate has not complied with the provisions of rules 39 to 43A, it shall report the fact of non-compliance of the said provisions along with reasonable proof, to the head of the Motor Vehicles Department established under section 213. The head of the department may, after giving the holder of trade certificate an opportunity of being heard, suspend or cancel the trade certificate held by him."

17. In the said rules, in Rule 45, for the words "head of the Motor Vehicles Department established under section 213" the words "state transport appellate tribunal or any authority decided by the respective states/UTs in this respect" shall be substituted.

18. In the said rules, in rule 81,

(a) in the heading, after the words "FORM OF APPLICATION FOR GRANT OR RENEWAL OF TRADE CERTIFICATE" the words "AND TRADE REGISTRATION MARKS" shall be inserted.

(b) in para 1, for the words "certificate(s)" the words "certificate" shall be substituted.

(c) after serial no. 3, the following serial no. shall be inserted, namely: -

"3A. Address of place of business"

(d) In serial no. 4, for the words "manufacturer or dealer of automobiles" the words "manufacturer of motor vehicles or dealer of motor vehicles" shall be substituted

(e) in serial no. 4, before the words "a test agency specified under rule 126 of the said rules" the words "or automobile ancillary" shall be omitted.

(f) in serial no. 4, after the words "a test agency specified under rule 126 of the said rules" the words and bracket "or importer of motor vehicles or any entity specified by central government, (In case applicant is dealer of motor vehicles letter of authority issued by vehicle manufacturer shall be submitted with application)" shall be inserted.

(g) in serial no. 4, the words and figure "in motor vehicles, approved repairer of vehicles, engaged in building bodies to vehicles, engaged in the business of hire purchase / lease / hypothecation of vehicles." shall be omitted.

(h) serial no. 5, 6, 7 and 8 shall be omitted.

(i) before the words "Declaration" following table shall be inserted namely:-

(j) after the words "signature of applicant" the words and figure "or digital/e signature of applicant" shall be inserted.

20. In the said rules, in Form 17, -

(a) in the heading, after the words "FORM OF TRADE CERTIFICATE" the words "AND TRADE REGISTRATION MARKS" shall be inserted.

(b) in the heading, the words, figures and brackets "(To be printed in diameter shape of 70 millimetres)" shall be omitted.

(c) in serial no. 1, for the words "Serial number of certificate" the words "Trade certificate number" shall be substituted.

(d) after serial no. 2, following serial no. shall be inserted, namely: -

"2A. Address of place of business"

(e) serial no. 3, 4, 6 and 7 shall be omitted.

(f) after serial no. 5, following table shall be inserted, namely: -

(g) the words, figures "Region/" shall be omitted.

(h) after the words "Registering Authority of State", the words and brackets "(Digitally signed)" shall be inserted (i) QR code shall be inserted in Form 17

21. In the said rules, in Form 17, SCHEDULE, and corresponding entries under it, shall be omitted.

22. In the said rules, after Form 17, the following Forms shall be inserted, namely: -
