विषय: चीन जन.गण. के मूल के अथवा वहां से निर्यातित हाइड्रोफ्लूओरो कार्बन (एचएफसी) कं पोनेंट आर-32 के आयातों से संबंधित पाटनरोधी जांच की दिनांक 23 सितंबर, 2021 की अंतिम जांच परिणाम अधिसूचना सं. 6/33/2020-डीजीटीआर में उत्पादक/निर्यातक के नाम में परिवर्तन ।
1. फा.सं. 07/04/2022—डीजीटीआर.— समय-समय पर यथासंशोधित सीमाशुल्क टैरिफ अधिनियम, 1975 (जिसे आगे ''अधिनियम'' भी कहा गया है) और समय-समय पर यथासंशोधित सीमाशुल्क टैरिफ (पाटित वस्तुओं की पहचान, उन पर पाटनरोधी शुल्क का आकलन और संग्रहण तथा क्षतिनिर्धारण) नियमावली, 1995 (जिसे आगे नियमावली भी कहा गया है) को ध्यान में रखते हुए;

2. व्यापार उपचार महानिदेशालय (''प्राधिकारी'') ने चीन जन.गण. (''संबद्ध देश'') के मूल के अथवा वहां से निर्यातित हाइड्रोफ्लूओरो कार्बन (एचएफसी) कं पोनेंट आर-32 (''संबद्ध वस्तु'') के आयातों से संबंधित पाटनरोधी जांच की थी और अपनी अंतिम जांच परिणाम अधिसूचना सं. 6/33/2020-डीजीटीआर दिनांक 23 सितंबर, 2021 (''अंतिम जांच परिणाम'') के माध्यम से निश्चयात्मक पाटनरोधी शुल्क लगाने की सिफारिश की थी । इस सिफारिश को वित्त मंत्रालय द्वारा स्वीकृ त किया गया था और सीमाशुल्क अधिसूचना सं. 75/2021-सीमाशुल्क 3171 GI/2022

3. उक्त जांच में दो कं पनियों अर्थात झेजियांग क्यूझोऊ जुक्सिन फ्लूओरीन कै मिकल कं . लि., चीन जन.गण. (जांच के अधीन संबद्ध वस्तु का उत्पादक) और झेजियांग क्यूहुआ फ्लूओर- कै मिस्ट्री कं ., लि., चीन जन.गण. (जांच के अधीन संबद्ध वस्तु का व्यापारी-सह-निर्यातक) ने भागीदारी और सहयोग किया था । झेजियांग क्यूझोऊ जुक्सिन फ्लूओरीन कै मिकल कं . लि., (जुक्सिन) द्वारा उत्पादित संबद्ध वस्तु को उसकी संबंधित व्यापारी सह निर्यातक झेजियांग कु हुआ फ्लूओर- कै मिस्ट्री कं ., लि., (कु हुआ) द्वारा भारत को निर्यातित किया गया था । प्राधिकारी ने उत्पादक जुक्सिन के लिए अलग शुल्क की सिफारिश की थी । चू ंकि प्राधिकारी ने के वल उत्पादक के संबंध में शुल्क की सिफारिश की है, इसलिए के वल जुक्सिन के नाम को अंतिम जांच परिणाम अधिसूचना सं. 06/33/2020- डीजीटीआर दिनांक 23 सितंबर, 2021 की शुल्क तालिका के कं .सं. 2 में शामिल किया गया था ।
4. ये दोनों भागीदार कं पनियां अर्थात झेजियांग क्यूझोऊ जुक्सिन फ्लूओरीन कै मिकल कं . लि., तथा झेजियांग कु हुआ फ्लूओर- कै मिस्ट्री कं ., लि., अपनी मूल कं पनी झेजियांग जुहुआ कं . लि. (''जुहुआ'') के पूर्ण स्वामित्व में थीं। जुहुआ चीन जन.गण. में एक सार्वजनिक रूप से सूचीबद्ध कं पनी है । 23 जुलाई, 2021 को आठवीं निदेशक बोर्ड की 13वीं बैठक में जुहुआ ने अपनी पूर्णस्वामित्व वाली सहायक कं पनियों - जुक्सिन और कु हुआ के विलय की घोषणा की । इसके अनुपालन में जुक्सिन को कु हुआ द्वारा पूर्णत: स्वामित्व में ले लिया गया । कु हुआ के साथ इस विलय के पश्चात जुक्सिन अब अस्तित्व में नहीं है और कु हुआ ने जुक्सिन की सभी परिसंपत्तियों और देयताओं का अधिग्रहण कर दिया है । अत: जुक्सिन और कु हुआ ने प्राधिकारी से उत्पादक झेजियांग क्यूझोऊ जुक्सिन फ्लूओरीन कै मिकल कं . लि., चीन जन. गण. के नाम को बदलकर व्यापार सूचना सं. 12/2018 दिनांक 17 सितंबर, 2018 के अनुसार अंतिम जांच परिणाम की शुलक तालिका में मै. झेजियांग कु हुआ फ्लूओर-कै मिस्ट्री कं . लि. करने का अनुरोध किया है ।
ख. प्रक्रिया
5. 17 जनवरी, 2022 को जुक्सिन और कु हुआ ने सहयोगी उत्पादक मै. झेजियांग क्यूझोऊ जुक्सिन फलूओरीन कं पनी लिमिटेड के नाम को व्यापार सूचना सं. 12/2018 दिनांक 17.9.2018 के अनुसार अंतिम जांच परिणाम की शुल्क तालिका में बदल कर मै. झेजियांग कु हुआ फ्लूओर-कै मिस्ट्री कं . लि. करने का अनुरोध करते हुए एक विधिवत रूप से साक्ष्यांकित आवेदन दायर किया ।
6. अनुरोध की प्रकृ ति पर विचार करते हुए और व्यापार सूचना सं. 12/2018 दिनांक 17 सितंबर, 2018 के अनुसार प्राधिकारी ने जांच में भाग लेने वाले हितबद्ध पक्षकारों को आवेदन का अगोपनीय अंश परिचालित किया और किए गए अनुरोध पर उनके विचार मांगे ताकि इस अनुरोध पर उचित ढंग से विचार किया जा सके और मध्यावधि समीक्षा (''एमटीआर'') करने की आवश्यकता का मूल्यांकन किया जा सके । प्राधिकारी ने हितबद्ध पक्षकारों को टिप्पणियां प्रस्तुत करने के लिए 3 मार्च, 2022 तक का समय दिया । हितबद्ध पक्षकारों द्वारा किए गए अनुरोधों पर प्राधिकारी द्वारा आवश्यक समझी गई सीमा तक विचार किया गया है ।
7. दिनांक 31 मार्च, 2022 को प्राधिकारी द्वारा एक मौखिक सुनवाई की गई थी । भागीदारों द्वारा किए गए अनुरोध नीचे दर्ज हैं और उन पर प्राधिकारी द्वारा विचार किया गया है ।
ग. अनुरोध
आवेदकों - झेजियांग क्यूझोऊ जुक्सिन फ्लूओरिन कै मिकल कं . लि. और झेजियांग कु हुआ फ्लूओर-कै मिस्ट्री कं ., लि., के विचार
8. जुक्सिन और कु हुआ ने संबद्ध वस्तु के आयातों से संबंधित संबद्ध पाटनरोधी जांच में भागीदारी की थी । जुक्सिन और कु हुआ को संबद्ध जांच के अनुपालन में प्राधिकारी द्वारा जारी दिनांक 23 सितंबर, 2021 की अंतिम जांच परिणाम अधिसूचना में सहयोगी कं पनी के रूप में निर्धारित किया गया था । 3 [भाग I—खण्ड 1] भारत का राजपत्र : असाधारण
9. जुक्सिन चीन जन.गण. में संबद्ध वस्तु का आयातक था और उसने जांच अवधि (''पीओआई'') के दौरान अपनी संबंधित कं पनी कु हुआ के माध्यम से असंबंधित भारतीय ग्राहकों को संबद्ध वस्तु का निर्यात किया था । कु हुआ पी ओआई के दौरान संबद्ध वस्तु का के वल निर्यातक/व्यापारी था । कु हुआ पीओआई के दौरान संबद्ध वस्तु के उत्पादन में शामिल नहीं था । पी ओ आई के दौरान भारत को कु हुआ द्वारा निर्यातित समस्त संबद्ध वस्तु को उसके संबंधित उत्पादक जुक्सिन से खरीदा गया था ।
10. दोनों भागीदार कं पनियां कु हुआ और जुक्सिन अपनी मूल कं पनी जेझियांग जुहुआ कं . लि. के पूर्ण स्वामित्व में थीं । जुहुआ चीन जन. गण. में एक पब्लिक लिस्टेड कं पनी है । 23 जुलाई, 2021को 8वें निदेशक बोर्ड की 13वीं बैठक में जुहुआ ने अपनी पूर्ण स्वामित्व वाली सहायक कं पनियों –कु हुआ और जुक्सिन के विलय की घोषणा की । इसके अनुपालन में कु हुआ द्वारा जुक्सिन का पूर्ण अधिग्रहण कर लिया गया । जुक्सिन अब कोई विधिक कं पनी नहीं है और कु हुआ ने जुक्सिन की सभी परिसंपत्तियों और देयताओं का अधिग्रहण कर लिया है ।
11. कु हुआ और जुक्सिन दोनों का मुख्य व्यापार फ्लूओरीन रेफ्रीजरेशन उत्पादों का है । आवेदकों ने नोट किया था कि यह विलय जुहुआ फ्लूओरीन रेफ्रीजरेंट व्यापार विशेषञताता की प्राप्ति और के न्द्रित प्रचालन के लिए; संसाधनों के आवंटन को उच्चतम बनाने और प्रबंधन की लागतों को कम करने; आंतरिक सौदा लागतों में कमी करने; प्रबंधन की दक्षता और कार्यकु शलता में सुधार करने और प्रतिस्पधात्मक में वृद्धि करने के लिए अनुकू ल था । यह विलय संसाधनों को ईष्टतम बनाने और व्यापार को कु शलता से संचालित करने के लिए था ।
12. कु हुआ और जुक्सिन द्वारा दायर प्रश्नावली का उत्तर जांच के समय पूर्ण था । कु हुआ और जुक्सिन ने बाजार अर्थव्यवस्था के दर्जे का दावा नहीं किया था और सर्वोत्तम उपलब्ध सूचना के आधार पर परिकलित सामान्य मूल्य अपरिवतित बना हुआ है । यह अनुरोध के वल नाम परिवर्तन की श्रेणी में आता है और व्यापार की मूल प्रकृ ति में कोई परिवर्तन नहीं हुआ है ।
13. कु हुआ के साथ जुक्सिन के विलय के बाद जुक्सिन का पूरा स्वामित्व कु हुआ के पास आ जाएगा । व्यापार के आंतरिक पुनर्गठन के कारण पाटन और क्षति माजिन में कोई परिवर्तन नहीं हुआ है ।
घरेलू उद्योग और हितबद्ध पक्षकारों के विचार
14. घरेलू उद्योग ने अनुरोध किया है कि संबद्ध नाम परिवर्तन आवेदन के बारे में उसे कोई आपत्ति नहीं है। घ. प्राधिकारी द्वारा जांच
15. आवेदकों द्वारा किए गए अनुरोधों की जांच की गई है और निम्नलिखित अवलोकन किए जा रहे हैं । 16. शुलक तालिका में उत्पादक के नाम में परिवर्तन की आवश्यकता उत्पादक झेजियांग क्यूझोऊ जुक्सिन फ्लूओरीन कै मिकल कं . लि. और निर्यातक झेजियांग कु हुआ फ्लूओर-कै मिस्ट्री कं ., लि. के बीच विलय के कारण हुई है । दोनों भागीदार कं पनियां कु हुआ और जुक्सिन अपनी मूल कं पनी झेजियांग जुहुआ कं ., लि., चीन जन.गण. के पूर्ण स्वामित्व में थीं
17. प्राधिकारी नोट करते हैं कि घरेलू उद्योग ने आवेदकों द्वारा नाम में परिवर्तन के अनुरोध पर कोई आपत्ति नहीं की है ।
18. जांच के समय उनके द्वारा प्रस्तुत प्रश्नावली का उत्तर पूर्ण था । आवेदकों ने तर्क संगत समय में विलय के तथ्य को प्राधिकारी के नोटिस में लाया है । अंतिम जांच परिणाम की जांच से पता चलता है कि आवेदकों को बाजार अर्थव्यवस्था का दर्जा नहीं दिया गया था और सामान्य मूल्य का परिकलन सर्वोत्तम उपलब्ध सूचना के आधार पर किया गया था । निर्यात कीमत को मानक समायोजनों के अनुसार निर्धारित किया गया था । अत: पाटन संबंधी मापदंडों के पुन: आकलन की कोई जरूरत नहीं है ।
19. जांच से यह भी पता चलता है कि यह अनुरोध के वल नाम परिवर्तन की श्रेणी में आता है और स्वामित्व में ऐसा कोई परिवर्तन नहीं हुआ है जो व्यापार की मूल प्रकृ ति को बदलता हो । यह अनुरोध व्यापार सूचना के दायरे में शामिल है । घरेलू उद्योग या किसी अन्य हितबद्ध पक्षकार ने कोई आपत्ति नहीं जताई है ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 20. सभी पहलुओं पर विचार करने के बाद प्राधिकारी अंतिम जांच परिणाम अधिसूचना सं. 6/33/2020-डीजीटीआर दिनांक 23 सितंबर, 2021 के पैरा सं. 109 में शुल्क तालिका में निम्नलिखित परिवर्तन की सिफारिश करते हैं :
'' क्र. सं. 2 के कॉलम 6 में उत्पादक ''झेजियांग क्यूझोऊ जुक्सिन फ्लूओरीन कै मिकल कं ., लि.'' के नाम को ''झेजियांग कु हुआ फ्लूओर-कै मिस्ट्री कं ., लि.'' के रूप में पढ़े जाने के लिए संशोधित किया जाए ।
21. तद्नुसार प्राधिकारी सीमाशुल्क अधिसूचना सं. 75/20221-सीमाशुल्क (एडीडी) दिनांक 21 दिसंबर, 2021 में भी नाम में उक्त परिवर्तन की सिफारिश करते हैं ।
22. इस अधिसूचना से उत्पन्न के न्द्र सरकार के आदेशों के विरूद्ध कोई अपील अधिनियम के अनुसार, सीमाशुल्क, उत्पाद शुल्क और सेवाकर अपीलीय न्यायाधिकरण के समक्ष की जाएगी ।

AMENDMENT NOTIFICATION

Subject: Change in name of producer/exporter in the final findings notification no. 06/33/2020-DGTR
dated 23rd September 2021 of Anti-dumping investigation concerning imports of Hydrofluorocarbon
(HFC) Component R-32 originating in or exported from China PR.
1. F. No. 07/04/2022-DGTR.—Having regard to the Customs Tariff Act 1975, as amended from time to time (hereinafter referred to as "the Act") and the Customs Tariff (Identification, Assessment and Collection of Anti- Dumping Duty on Dumped Articles and for Determination of Injury) Rules 1995, as amended from time to time (hereinafter referred to as "the Rules") thereof;
A. BACKGROUND
2. The Directorate General of Trade Remedies ("Authority") had conducted an anti-dumping investigation concerning imports of Hydrofluorocarbon (HFC) Component R-32 ("subject goods") originating in or exported from China PR ("subject country") and recommended imposition of the definitive anti-dumping duty vide its final findings notification no. 06/33/2020-DGTR dated 23rd September, 2021 ("Final Findings"). The recommendation was accepted by the Ministry of Finance and definitive duty was imposed vide Customs Notification No. 752021-Customs (ADD) dated 21st December, 2021 ("Customs Notification").
3. In the said investigation, two companies, namely, Zhejiang Quzhou Juxin Fluorine Chemical Co., Ltd., China PR (producer of the subject goods in the impugned investigation) and Zhejiang Quhua Fluor-Chemistry Co., Ltd., China PR (trader-cum-exporter of the subject goods in the impugned investigation) had participated and cooperated. The subject goods produced by Zhejiang Quzhou Juxin Fluorine Chemical Co., Ltd. (Juxin) had been exported to India by its related trader-cum-exporter Zhejiang Quhua Fluor-Chemistry Co., Ltd. (Quhua).
The Authority had recommended individual duty for the producer Juxin. Since the Authority recommends duty only in respect of the producer, the name of only Juxin was incorporated in SN 2 of the Duty Table of the final findings notification no. 06/33/2020-DGTR dated 23rd September, 2021.
4. Both these participating companies, i.e., Zhejiang Quzhou Juxin Fluorine Chemical Co., Ltd. and Zhejiang Quhua Fluor-Chemistry Co., Ltd. were fully owned by their parent company Zhejiang Juhua Co., Ltd.("Juhua"). Juhua is a public listed company in China PR. On 23rd July 2021, at the 13th Meeting of the Eighth Board of Directors, Juhua announced the merger of its wholly owned subsidiaries - Juxin and Quhua.
Pursuant to this, Juxin was completely absorbed by Quhua. After its merger with Quhua, Juxin is no longer in existence and Quhua has taken over all the assets and liabilities of Juxin. Therefore, Juxin and Quhua have requested the Authority for change of name of the producer Zhejiang Quzhou Juxin Fluorine Chemical Co., Ltd., China PR to M/s Zhejiang Quhua Fluor-Chemistry Co., Ltd in the Duty Table in the final findings, in 5 [भाग I—खण्ड 1] भारत का राजपत्र : असाधारण
accordance with the Trade Notice No. 12/2018 dated 17th September, 2018.
B. PROCEDURE
5. On 17th January, 2022, Juxin and Quhua filed a duly substantiated application requesting for change of name of the cooperating producer from M/s Zhejiang Quzhou Juxin Fluorine Chemical Co., Ltd. to M/s Zhejiang Quhua Fluor-Chemistry Co., Ltd in the duty table of the final findings, in accordance with the Trade notice No. 12/2018 dated 17.09.2018.
6. Considering the nature of the request and in terms of Trade Notice No. 12/2018 dated 17th September, 2018, the Authority circulated the non-confidential version of the application to the interested parties which had participated in the investigation and sought their views on the request made so that the request could be considered appropriately and the need of undertaking a Mid-Term Review ("MTR") could be evaluated. The Authority granted time till 3rd March, 2022 to the interested parties to provide their comments. The submissions made by the interested parties have been considered by the Authority to the extent deemed necessary.
7. An oral hearing was conducted by the Authority on 31st March, 2022. The submissions made by the participants are recorded below and have been considered by the Authority.
C. SUBMISSIONS
A VIEWS OF THE APPLICANTS - ZHEJIANG QUZHOU JUXIN FLUORINE CHEMICAL CO., LTD.
AND ZHEJIANG QUHUA FLUOR-CHEMISTRY CO., LTD.
8. Juxin and Quhua had participated in subject anti-dumping investigation concerning imports of the subject goods. Juxin and Quhua were determined as cooperating entities in the final findings notification dated 23rd September, 2021 issued by the Authority pursuant to the subject investigation.
9. Juxin was the producer of the subject goods in China PR and had exported the subject goods to unrelated Indian customers through its related company Quhua during the period of investigation ("POI"). Quhua was only an exporter/trader of the subject goods during the POI. Quhua did not engage in the production of the subject goods during the POI. All the subject goods exported by Quhua to India during the POI were purchased from its related producer Juxin.
10. Both the participating companies, Quhua and Juxin were fully owned by the parent company Zhejiang Juhua Co., Ltd. Juhua is a public listed company in China PR. On 23rd July 2021, at the 13th Meeting of the Eighth Board of Directors, Juhua announced the merger of its wholly owned subsidiaries - Quhua and Juxin. Pursuant to this, Juxin was completely absorbed by Quhua. Juxin is no longer a legal entity and Quhua has taken over all the assets and liabilities of Juxin.
11. The main businesses of both Quhua and Juxin is of fluorine refrigeration products. The applicants had noted that this merger was conducive to the realization of Juhua's fluorine refrigerant business specialization and concentrated operation; optimizing resource allocation and reducing management costs; reduction in internal transaction costs; improved management efficiency and effectiveness and enhanced competitiveness. The merger has been carried out to optimize the resources and the efficient conduct of business.
12. The questionnaire responses filed by Quhua and Juxin were complete at the time of the investigation. Quhua and Juxin had not claimed market economy status and the normal value constructed on the basis of the best available information remains unchanged. The request falls within the category of name change only and there is no change in the basic nature of the business.
13. After the absorption of Juxin with Quhua, Juxin will be completely inherited by Quhua. There are no changes in the dumping and injury margin owing to internal re-organisation of business.
VIEWS OF THE DOMESTIC INDUSTRY & INTERESTED PARTIES
14. The domestic industry has submitted that it has no objections pertaining to the subject name change application.
D. EXAMINATION BY THE AUTHORITY
15. The submissions made by the applicants have been examined and the following observations are being made.
16. The need for change in the name of the producer in the duty table has emerged from the merger between the6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] producer Zhejiang Quzhou Juxin Fluorine Chemical Co., Ltd. and exporter Zhejiang Quhua Fluor-Chemistry Co., Ltd. Both the participating companies, Quhua and Juxin were fully owned by their parent company Zhejiang Juhua Co., Ltd., China PR.
17. The Authority notes that the domestic industry has not objected to the requested change in the name by the applicants.
18. The questionnaire responses filed by them at the time of investigation were complete. The applicants have brought the fact of merger to the notice of the Authority in reasonable time. The examination of the final findings indicates that the applicants were not given market economy status and normal value was constructed on the basis of the best available information. The export price was determined as per the standard adjustments.
Therefore, there is no need to reassess the dumping parameters.
19. The examination further reveals that the request falls in the category of name change only and there is no change in the ownership in a manner that alters the basic nature of the business. The request is covered in the scope of the trade notice. There is no objection by the domestic industry or any other interested party.
20. Having considered all aspects, the Authority recommends following change in the Duty Table in para no. 109 of the final finding notification no. 6/33/2020-DGTR dated 23rd September, 2021:
"At SN 2, in Column 6, the name of the producer "Zhejiang Quzhou Juxin Fluorine Chemical Co., Ltd" be amended to read as "Zhejiang Quhua Fluor-Chemistry Co., Ltd."
21. Accordingly, the Authority recommends the above change in the name in the Customs Notification No. 75/2021-Customs (ADD) dated 21st December, 2021 as well.
22. An appeal against the orders of the Central Government arising out of this notification shall lie before the Customs, Excise, and Service Tax Appellate Tribunal in accordance with the Act.
