] जयपुर, 13 मई 2022 .—केन्द्रीय सरकार, रेल अधिनियम, 1989 (1989 का 24) (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 20क की उप-धारा (1) के अधीन जारी, भारत के राजपत्र, असाधारण, भाग II, खण्ड 3, उप-खण्ड (ii) तारीख 14 फरवरी 2022 में प्रकाशित, भारत सरकार के रेल मंत्रालय [उत्तर पश्चिम रेलवे (इंजीनियरींग विभाग)] की अधिसूचना संख्याक का.आ. 653(अ), तारीख 14 फरवरी, 2022, द्वारा उक्त अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि को, राजस्थान राज्य के चित्तौड़गढ़ जिले में विशेष रेल परियोजना, अर्थात्‌ " के निष्पादन, अनुरक्षण, प्रबंधन और प्रचालन के प्रयोजन के लिए अर्जित करने के अपने आशय की घोषणा की थी ;

और उक्त अधिसूचना का सार, उक्त अधिनियम की धारा 20क की उपधारा (4) के अधीन दैनिक स्थानीय समाचार पत्रों, अर्थात्‌, ''राजस्थान पत्रिका'' और ''दैनिक भास्कर'' में तारीख 18 फरवरी 2022 को प्रकाशित कर दिया गया था ;

और सक्षम प्राधिकारी द्वारा कोई आक्षेप प्राप्त नहीं किया गया है ;

और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 20ड़ की उपधारा (1) के अनुसरण में अपनी रिपोर्ट सौंप दी है ;

अतः अब, केन्द्रीय सरकार, सक्षम प्राधिकारी से रिपोर्ट प्राप्त होने पर और उक्त अधिनियम की धारा 20ड़ की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जाएगी ;

और यह कि, केन्द्रीय सरकार उक्त अधिनियम की धारा 20ड़ की उपधारा (2) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशित होने पर इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर केन्द्रीय सरकार में आत्यंतिक रूप से निहित हो जायेगी। 3257 GI/2022 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] राजस्थान राज्य के जिला चित्तौड़गढ़ में विशेष रेल परियोजना, अर्थात " संरचना सहित या बिना संरचना के अधिग्रहण की जाने वाली भूमि का संक्षिप्त विवरण।

NOTIFICATION

Jaipur, the 13th May, 2022

S.O 2223(E).—Whereas, by the notification of the Government of India, in the Ministry of Railways [North Western Railway (Engineering Department)], number S.O. 653(E), dated the 14th February, 2022 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the14 February, 2022 issued under sub-section (i) of section 20A of the Railway Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the schedule annexed to the said notification for the purpose of execution, maintenance, management and operation of the Special Railway Project namely, "Ajmer Division - Road under bridges on level crossings (65 Nos.)", for Road under bridge at Level Crossing No. 39 in district of Chittourgarh in the State of Rajasthan;

And whereas, the substance of the said notification has been published in the daily local newspapers namely, "Rajasthan Patrika" and "Dainik Bhaskar" dated the 18 February, 2022 under sub-section (4) of section 20A of the Said act;

And whereas, no objection has been received by the Competent Authority:

And whereas, in pursuance of sub-section (1) of section 20E of the said act, the Competent Authority has submitted its report to the Central Government;

Now therefore, upon receipt of the report of the Competent Authority and in exercise of the powers conferred by sub-section (1) of section 20E of the said Act, the Central Government hereby declares that the land specified in the schedule annexed hereto shall be acquired for the aforesaid purpose;

And further, in pursuance of sub-section(2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the official Gazette, the land specified in the schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
