का.आ. 2249(अ).—जबकि, के न्द्र सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का. आ. 1054(अ), दिनांकित 12 मार्च, 2020 के द्वारा रारा-548डी [महाराष्ट्र राज्य की बीओटी परियोजना के तहत तलेगांव दाभाडे, चाकन, शिकरापुर, नवरा खंड के किमी 0/00 से किमी 83/551 तक को छोडकर] खंड को महाराष्ट्र राज्य सरकार को सुपुर्द कर दिया है;

अत: अब, राष्ट्रीय राजमार्ग फीस (दरों का निर्धारण और संग्रहण) नियम, 2008 और समय समय पर संशोधित (जो इसके आगे 'नियम' के रूप में उल्लिखित है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्र सरकार, एतद्द्वारा महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग 548डी (लंबाई-32.172 किमी) के मंजरसु ंभ से चुम्बली फाटा तक खंड के डिजाइन किमी 137+300 से किमी 169+472 (मौजूदा किमी 45+877 से किमी 13+689) तक 2.2 किमी [चार अथवा अधिक लेन के खंड के उपयोग के लिए] के लिए तालिका 1 के कॉलम (2) में विनिर्दिष्ट दर के 100% पर और 29.972 किमी निवल सड़क खंड लंबाई [पेव्ड शोल्डर सहित दो लेन के खंड के उपयोग के लिए] के लिए तालिका 1 के कॉलम (2) में विनिर्दिष्ट दर के 60% पर नीचे दी गई तालिका 1 के कॉलम (1) में विनिर्दिष्ट वाहनों के प्रकार पर फीस उदगृहीत करती है तथा भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को उसके अधिकारियों अथवा किसी ठेके दार के माध्यम से उक्त फीस के संग्रहण के लिए प्राधिकृ त करती है ,अर्थात् :-

1. इसके अंतर्गत उदगृहीत और संगृहीत फीस ऐसे पथकर प्लाजाओं के अंतर्गत विनिर्दिष्ट दूरी हेतु निम्नलिखित पथकर प्लाजाओं में देय और संदेय होगी:-

2. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किमी की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2021-22 के लिए 285.00 रु. (दो सौ पिचासी रुपए मात्र) है और राष्ट्रीय राजमार्ग शुल्क (दरों का निर्धारण और संग्रहण) नियमावली, 2008 के नियमों के प्रावधानों के अनुसार और प्रतिवर्ष संशोधन के अध्यधीन है।

3. राजमार्ग खंड पर बहुल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्

4. फीस प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए फीस उस श्रेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशर्ते कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई सर्विस रोड या वैकल्पिक सड़क उपलब्ध न हों।

5. संबंधित श्रेणी के वाहनों के लिए विनिर्दिष्ट अनु्ेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश लिए, उक्त नियमों के नियम 10 के उप-नियम 1ए में विनिर्दिष्ट फीस के समतुल्य फीस का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहीं होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहीं जाता। 6. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनु्ेय भार, छू ट प्राप्त वाहनों की श्रेणी, सर्विस रोड, वैकल्पिक सड़क इत्यादि पूर्वोक्त नियमों में विनिर्दिष्ट परिभाषाओं के अनुरूप होंगी।

7. फीस की दरें उक्त नियमों के नियम 12 के अनुसरण में प्रयोक्ताओं के सूचनार्थ प्रदर्शित करनी होंगी।

8. यांत्रिक वाहनों से फीस की वास्तविक राशि उपयु र्क्त तालिका-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी फीस की आधार दर के आधार पर प्रभारित होगी और छू टों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंग्रेजी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।

9. इस परियोजना की प्राक्कलित पू ंजीगत लागत 228.54 करोड़ रु. है। [भूमि अधिग्रहण, सार्वजनिक जन सुविधाओं के स्थानांतरण, पेड़ों को काटने, आदि कार्यकलापों को अभी पूरा किया जाना है इसलिए, पू ंजीगत लागत परिवर्तन के अध्यधीन है और अंतिम पू ंजीगत लागत को पृथक रूप से अधिसूचित किया जाएगा।] प्राप्त प्रयोक्ता फीस के माध्यम से वसूल की गई पू ंजीगत लागत का भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा रिकार्ड रखा जाएगा तथा पू ंजीगत लागत की वसूली के पश्चात् उदग्राह्य फीस घटाकर दरों के 40% तक कर दी जाएगी और कथित नियमों के अनुसरण में वार्षिक रूप से संशोधित की जाएगी।

NOTIFICATION

New Delhi, the 13th May, 2022

S.O. 2249(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1054(E) dated 12th March 2020, issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the stretch NH- 548D [excluding Talegaon Dabhade, Chakan, Shikrapur, Nhavra section from km 0/00 to km 83/551 under BOT project of State Govt. of Maharashtra] is entrusted to the State Government of Maharashtra;

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the "said Rules"), the Central Government hereby levies the fee at rate specified in column (2) in Table 1 below (hereinafter referred to as "base rate") at 100% for net road length of 2.2 km [for use of four and more lane section] and at 60% for net road length of 29.972 km [for use of two lane with paved shoulder section] on the type of vehicles specified in column (1) of Table 1 below for the use of Manjarsumbha to Chumbali Phata from design Km. 137+300 to Km. 169+472 (existing km 45+877 to km 13+689) section of NH- 548D (Length – 32.172 Km) developed to two lane with paved shoulder /4 lane standards in the state of Maharashtra and authorizes the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely: -

1. The fee to be levied and collected hereunder shall be due and payable at the following Fee Plaza for net road length specified for such Fee Plaza:

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 285 (Rupees Two Hundred Eighty Five only) for the year 2021-22 and is subject to revision every year as per the provisions of the said rules.

3. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

5. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, as per Rule 10(1A) of the said rules and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules. 7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

8. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.

9. The estmated capital cost of the project is Rupees 228.54 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The final capital cost will be notified separately. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
