का.आ. 2347(अ).—मोटरयान अधिनियम, 1988 की धारा 58 की उपधारा (3) एवं धारा 110 की उपधारा (3) (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्र सरकार इस अधिसूचना के जारी होने की तारीख से बारह महीने की अवधि के लिए, दो 'एलएलडीपीई / एचडीपीई रिएक्टर' का, मेसर्स टेक्नोप्रोसेस इक्विपमेंट्स (इंडिया) प्राइवेट लिमिटेड, भरूच, गुजरात से एचपीसीएल रिफाइनरी, पचपदरा, बाड़मेर, राजस्थान, तक सड़क मार्ग से परिवहन के लिए, जिनका अधिकतम सुरक्षित लदान भार/कु ल सकल भार और आकार संलग्न अनुसूची में उल्लिखित है, अनुमोदन प्रदान करती है।

अनुसूची

1. मेसर्स रेशमसिह एंड कं पनी प्राइवेट लिमिटेड उपरोक्त प्रचालन में दो 'एलएलडीपीई / एचडीपीई रिएक्टर' के परिवहन के लिए, मेसर्स टेक्नोप्रोसेस इक्विपमेंट्स (इंडिया) प्राइवेट लिमिटेड का ट्रांसपोर्टर है।

2. निम्नलिखित प्राइम मूवर्स, खेप की आवाजाही में इस्तेमाल किए जाएगें, जैसा कि नीचे दिया गया है:-

3. उपरोक्त प्रचालन के लिए निम्नलिखित स्वतंत्र रेजिस्ट्रीकृ त माडुलर हाईड्रोलिक ट्रैलर्स इस्तेमाल किए जाएगें:-

4. यान और भार विन्यास:- लदी स्थिति में धुरी का सकल यान भार (जीवीडब्ल्यू) और खेप का समग्र आयाम होगा: -

5. उपरोक्त छू ट इन शर्तों के अधीन है कि:-

(i) उपरोक्त कन्साइनमेंट का परिवहन, विशिष्ट मार्ग मेसर्स टेक्नोप्रोसेस इक्विपमेंट्स (इंडिया) प्राइवेट लिमिटेड, भरूच, गुजरात से एचपीसीएल रिफाइनरी, पचपदरा, बाड़मेर, राजस्थान, तक इस सड़क मार्ग के जरिए होगा-

टेक्नोप्रोसेस इक्विपमेंट इंडिया प्राइवेट लिमिटेड, भरूच से सड़क मार्ग से आईएसजीईसी दहेज जेट्टी;

आईएसजीईसी जेट्टी से मु ंद्रा बंदरगाह तक डंब बार्ज से; और

मु ंद्रा पोर्ट से एचपीसीएल-राजस्थान रिफाइनरी:- मु ंद्रा पोर्ट - अंजर- गांधीधाम रोड – भचाऊ - सांखियाली-संथालपुर – सुइगाम – सांचौर - रामजी का गोल – गुडामलानी – बलोतरा - एचपीसीएल रिफाइनरी पचपदरा, राजस्थान ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) लोक निर्माण विभाग/स्थानीय प्राधिकारियों/भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभिन्न सड़कों के लिए विनिदिष्ट भार प्रतिबंधों का अनुपालन किया जाएगा और यानों को सड़कों पर लाने से पहले, ऐसे प्राधिकारियों से अनुमति ली जाएगी। सुरक्षा की दृष्टि से ट्रैलरों का प्रत्येक प्रचालन राज्य/संघ शासित प्रदेश/भारतीय राष्ट्रीय राजमार्ग प्राधिकरण के संबंधित परिवहन विभाग द्वारा अनुमोदित किया जाएगा और उस पर कड़ी निगरानी रखी जाएगी।

(iii) ट्रांसपोर्टर इस तरह के प्रतिबंधों का पालन करेगा जैसा कि राज्य / कें द्र शासित प्रदेश सरकार / भारतीय राष्ट्रीय राजमार्ग प्राधिकरण इस संबंध में आदेश द्वारा निदिष्ट कर सकता है।

(iv) ट्रांसपोर्टर, यानों को सड़कों पर लाने से पहले, किसी भी वस्तु जैसे होडिग्स, पोल, साइनबोर्ड, डिवाइडर को हटाने के लिए, ट्रांसमिशन लाइन बंद कराना इत्यादि के लिए, राज्य/संघ राज्य क्षेत्र सरकार के संबंधित विभागों से आवश्यक पूर्व अनुमति प्राप्त करेगा और इस तरह के प्रतिबंधों का पालन करेगा जैसा कि राज्य / कें द्र शासित प्रदेश सरकार / भारतीय राष्ट्रीय राजमार्ग प्राधिकरण इस संबंध में आदेश द्वारा विनिदिष्ट करता है। राज्य/संघ राज्य क्षेत्र सरकार द्वारा अनुमत, किसी भी वस्तु को हटाने और पुनविकास कराने की लागत मेसर्स रेशमसिह एंड कं पनी प्राइवेट लिमिटेड द्वारा वहन की जाएगी। (v) ट्रांसपोर्टर बड़े आकार के कार्गो को देखते हुए, ऐसे यानों की प्रत्येक आवाजाही के संबंध में राज्य सरकार/भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा इस संबंध में निदिष्ट प्राधिकरण या अधिकारी को कम से कम दस दिन पहले सूचना देगा। ऐसे प्रत्येक गमनागमन के लिए संबंधित प्राधिकारी द्वारा समय निर्धारित किया जाना चाहिए।

(vi) यदि ऐसा किसी राज्य/संघ राज्य क्षेत्र/भारतीय राष्ट्रीय राजमार्ग प्राधिकरण के लोक निर्माण विभाग द्वारा निर्देशित किया जाता है, तो लोडेड यानों को उस राज्य/संघ राज्य क्षेत्र में सड़कों पर पुलों के ऊपर या नीचे से गुजरने की अनुमति नहीं दी जाएगी और ऐसे मामलों में आवेदकों को नदियों/नालों को पार करने के लिए अपनी व्यवस्था स्वयं करनी होगी। (vii) ट्रांसपोर्टर राज्य / कें द्र शासित प्रदेश / भारतीय राष्ट्रीय राजमार्ग प्राधिकरण या किसी अन्य प्रभावित व्यक्ति को ऐसी राशि का भुगतान करने के लिए उत्तरदायी होगा जहां सड़कों या सड़क संरचनाओं / अन्य सड़क उपयोगकर्ताओं / व्यक्ति को प्रत्यक्ष या अप्रत्यक्ष रूप से कोई नुकसान ट्रेलरों की आवाजाही के कारण होता है।

(viii) सड़क की लंबाई के साथ ट्रेलरों के युग्मन की अनुमति के वल उपरोक्त आवाजाही के लिए होगी।

(ix) उक्त यानों का परिवहन, यातायात के सामान्य प्रवाह में बिना किसी बाधा के होना चाहिए।

(x) यान पर खतरे संबंधी सभी झंडियां और बत्तियां लगी होनी चाहिए, बेहतर यह होगा कि लदे यानों के आगे तथा पीछे एक-एक यान स्पष्ट रूप से यह दर्शाता हुआ चले कि भारी लदा हुआ यान गुजर रहा है।

(xi) सड़क पर चलने के लिए ट्रैलरों की अधिकतम गति 5 कि.मी./घंटा से अधिक नहीं होनी चाहिए।

(xii) ट्रैलरों की संपूर्ण चैड़ाई में अगले एवं पिछले हिस्से पर पीले एवं काले रंग से जेबरा पट्टी बनाई जाएगी और उस पर रात्रि के समय चलाने/ पाकिग के लिए आगे और पीछे समुचित रूप से लाल बत्ती होनी चाहिए तथा दिन में दोंनों ओर लाल झण्डी लगाई जाएगी, जिससे यान की सही-सही स्थिति का स्पष्ट रूप से पता चल सके ।

(xiii) ट्रांसपोर्टर यह सुनिश्चित करेगा कि उपरोक्त आवाजाही के दौरान उपयोग किए जाने वाले सभी यानों के संबंध में रोड टैक्स का भुगतान किया गया है, फिटनेस प्रमाण पत्र, बीमा कवर (तृतीय पक्ष बीमा सहित), राष्ट्रीय परमिट और पीयूसी प्राप्त किया गया है। 5 [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण

(xiv) ट्रेलरों और प्राइम मूवर्स के रेजिस्ट्रीकरण प्रमाणपत्रों में कोई बदलाव नहीं किया जाएगा क्योंकि वे पहले से ही हरियाणा, कर्नाटक, गुजरात और महाराष्ट्र राज्य में रेजिस्ट्रीकृ त हैं।

(xv) किसी यान (यानों) या अन्य रेजिस्ट्रीकृ त स्वामियों से प्राप्त यान (यानों) के भाग से उत्पन्न होने वाले मुद्दे की स्थिति में, ट्रांसपोर्टर स्वयं जिम्मेदार होगा।

(xvi) खेप के परिवहन के दौरान उत्पन्न होने वाली किसी भी प्रकृ ति का कोई भी मुद्दा, ट्रांसपोर्टर की जिम्मेदारी होगी।

NOTIFICATION

New Delhi, the 20th May, 2022

S.O. 2347(E).— In exercise of the powers conferred by sub-section (3) of Section 58 and sub-Section 3(a) of Section 110 of the Motor Vehicles Act, 1988, the Central Government hereby accords approval for period of twelve months from the date of issue of this notification for transportation of two 'LLDPE/HDPE Reactors' from M/s Technoprocess Equipments (India) Private Limited, Bharuch, Gujarat to HPCL Refinery, Pachpadra, Barmer, Rajasthan by road with maximum safe laden weight/Gross Vehicles Weight and dimensions, as mentioned in the schedule appended hereto.

SCHEDULE

1. M/s Reshamsingh and Company Private Limited is the transporter of M/s Technoprocess Equipments (India) Private Limited for transportation of two 'LLDPE/HDPE Reactors' for the aforesaid movement.

2. Following Prime Movers will be utilized in the movement of the subject consignment as detailed below:-

3. The following independently registered modular hydraulic Trailers will be utilized in the above movements:-

4. Vehicle and Load Configuration:- Gross Vehicle Weight (GVW) of the axles in laden condition and overall dimension of consignment will be:-

5. The above relaxation is subject to the conditions that:-

i. The specific route for transportation of the consignment will be from M/s Technoprocess Equipments (India) Private Limited, Bharuch, Gujarat to HPCL Refinery, Pachpadra, Barmer, Rajasthan by road through-

Technprocess Equipment India Pvt.Ltd.,Bharuch to ISGEC Dahej Jetty by Road; ISGEC Jetty to Mundra Port by Dumb Barge; and From Mundra Port to HPCL- Rajasthan Refinery:- Mundra Port - Anjar - Gandhidham Road – Bhachau - Samkhiyali – Santalpur – Suigam – Sanchore - Ramji Ka Gol – Gudamalani – Balotra- HPCL Refinery Pachpadra, Rajasthan.

ii. Load restrictions on various roads stipulated by the Public Works Department/Local Authorities/National Highway Authority of India will be observed and permission of such authorities will be obtained before the vehicles are put on the roads. Movement of the trailers will be approved and closely monitored by the concerned road authorities in State/Union Territory/National Highway Authority of India from safety point of view.

iii. The transporter will observe such restrictions as the State/Union Territory Government/National Highway Authority of India may by order specify in this behalf.

iv. The transporter will obtain necessary prior permissions, from the concerned Departments of the State/Union Territory Government for the removal of any objects like hoardings, poles, signboards, divider, transmission line shutdown etc. and follow such restrictions as the State/Union Territory Government/National Highway Authority of India may by order specify in this behalf, before the vehicles are put on road. Cost of removal and relocation of any object, permitted by the State/Union Territory Government shall be borne by the M/s Reshamsingh and Company Private Limited.

v. The transporter will give intimation at least ten days in advance and would need to obtain permission before commencement of transit, from concerned authority of State or Union Territory Authorities/National Highway Authority of India en-route, in view of the oversized cargo. For each such movement, the timing should be prescribed by the concerned authority.

vi. If so directed by the Public works Department of a State/Union Territory/National Highway Authority of India, the loaded vehicles will not be allowed to pass over or under the bridges on the roads in that State/Union Territory and in such cases applicants will have to make their own arrangements to cross the rivers/drains.

vii. The transporter would be liable to pay such amount to the Government of State/Union Territory/National Highway Authority of India or any other affected person where any damage is caused to the roads or road structures/other road users/persons directly or indirectly due to the movement of the trailers.

viii. Coupling of the trailers along the length of the road will be permissible only for above movements.

ix. The said vehicles should be moved without any hindrance to the normal flow of traffic.

x. The vehicles should display all danger flags and lights, the vehicles should be preceded and followed by a vehicle displaying prominently that a heavy load is passing.

xi. The maximum speed of the trailers for movement on the road shall not exceed 5 km/hr.

xii. The trailers shall be painted for the entire width by yellow and black zebra stripes on the front and rear sides duly marked for night time driving/parking suitably by red lamps at the front and rear and red flags on both the sides during day time to indicate the extreme position of the vehicle clearly.

xiii. The transporter will ensure that road taxes have been paid, fitness certificate, insurance cover(including Third Party Insurance), National Permit, and PUC have been obtained in respect of all the vehicles to be utilized during the above movement.

xiv. No change will be made in the Registration Certificates of the Trailers and Prime Movers as they are already registered in the state of Haryana, Karnataka, Gujarat and Maharashtra.

xv. In case of issues arising of any vehicle(s) or part of vehicle(s) out sourced from other registered owners, the transporter shall bear responsibility for the same.

xvi. Any issue of any nature arising during the transportation of subject consignment shall be the responsibility of the transporter.
