सा.का.नि. 383(अ).—औषधि नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों के निम्नलिखित प्रारूप, जिसे कें द्रीय सरकार औषधि तकनीकी सलाहकार बोर्ड के परामर्श से औषधि और प्रसाधन सामग्री अधिनियम, 1940 (23 के 1940) की धारा 12 की उप-धारा (1) और धारा 33 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इसके द्वारा प्रभावित होने की संभावना वाले सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है और एतद् द्वारा सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से सात दिनों की अवधि समाप्त होने पर या उसके पश्चात् विचार किया जाएगा जिस तारीख को इन प्रारूप नियमों वाले भारत के राजपत्र की प्रतियां जनता को उपलब्ध कराई जाएंगी;

कें द्रीय सरकार द्वारा उपयु र्क्त निदिष्ट अवधि के भीतर किसी भी व्यक्ति से प्राप्त होने वाली आपत्तियों और सुझावों पर विचार किया जाएगा;

आपत्तियां और सुझाव, यदि कोई हों, तो अवर सचिव (औषधि), स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार, कमरा सं. 434, सी विग, निर्माण भवन, नई दिल्ली - 110011 को अग्रेषित किया जाए अथवा drugsdiv- [email protected] पर ई-मेल किया जाए।

प्रारूप नियम

1. (1) इन नियमों को औषधि (....संशोधन) नियम, 2022 कहा जाएगा। (2) ये नियम राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रभावी होंगे। 3439 GI/2022 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. औषधि नियम 1945 में, अनुसूची ट के क्रम संख्यांक 39 में, "छू ट की सीमा और शर्तें" शीर्षक के अधीन स्तंभ में, अंत में, निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्:—

"परंतु शर्त (घ), तारीख 30.11.2022 को या उससे पूर्व विनिमित औषधियों पर लागू नहीं होगी।"

NOTIFICATION

New Delhi, the 23rd May, 2022

G.S.R. 383(E).—The following draft of certain rules further to amend the Drugs Rules, 1945, which the Central Government proposes to make, in exercise of the powers conferred by Sub-section (1) of section 12 and Sub-section (1) of section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940), is hereby published in consultation with the Drugs Technical Advisory Board for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration on or after the expiry of a period of seven days from the date on which copies of the Gazette of India containing these draft rules are made available to public;

Objections and suggestions which may be received from any person within the period specified above will be considered by the Central Government;

Objections and suggestions, if any, may be addressed to the Under Secretary (Drugs), Ministry of Health and Family Welfare, Government of India, Room No. 434, C Wing, Nirman Bhavan, New Delhi - 110011 or emailed at [email protected].

DRAFT RULES

1. (1) These rules may be called the Drugs (......Amendment) Rules, 2022.

(2) These rules shall come into force on the date of their final publication in the Official Gazette.

2. In the Drugs Rules, 1945, in Schedule K, in serial number 39, in column under heading "Extent and Conditions of Exemptions", at the end, the following proviso shall be inserted, namely:─ "Provided that the condition(d) shall not be applicable for the drugs manufactured on or before 30.11.2022."
