सा.का.नि. 387(अ).—जहां कि चीन जनवादी गणराज्य (एतश्मिन पश्चात जिसे विषयगत देश से संदभित किया गया है) में मूलत: उत्पादित या वहां से निर्यातित और भारत में आयातित "डिकोर पेपर" (एतश्मिन पश्चात जिसे उक्त विषयगत वस्तु से संदभित किया गया है), जो कि सीमाशुल्क टैरिफ अधिनियम, 1975 (1975 का 51) (एतश्मिन पश्चात जिसे उक् त सीमाशुल्क टैरिफ अधिनियम से संदभित किया गया है) की प्रथम अनुसूची के टैरिफ मद 4805 91 00 या 4802 20 90 के अंतर्गत आता है, के मामले में विनिदिष्ट प्राधिकारी अधिसूचना संख्या फा. सं. 06/38/2020-डीजीटीआर, दिनांक 28 सितम्बर, 2021, जिसे दिनांक 28 सितम्बर, 2021 को भारत के राजपत्र, असाधारण, के भाग ।, खंड 1 में प्रकाशित किया गया था, के तहत अपने अंतिम निष्कर्षों में विषयगत देश में मूलत: उत्पादित या वहां निर्यातित और भारत में आयातित विषयगत वस्तु के आयात पर प्रतिपाटन शुल्क लगाए जाने की सिफारिश की है;

और जहां कि उक्त विनिदिष्ट प्राधिकारी के उपुर्यक्त निष्कषों के आधार पर के न्द्र सरकार ने भारत सरकार, वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना संख्या 77/2021-सीमाशुल्क (एडीडी), दिनांक 27 दिसम्बर, 2021, जिसे सा.का.नि. 882 (अ), दिनांक 27 दिसम्बर, 2021 के तहत भारत के राजपत्र, असाधारण, के भाग ।।, खंड 3, उप खंड (i) में प्रकाशित किया गया था, के तहत उक्त विषयगत वस्तु पर प्रतिपाटन शुल्क लगाया था;

और जहां कि उक्त विनिदिष्ट प्राधिकारी ने अधिसूचना संख्या फा. सं. 06/38/2020-डीजीटीआर, दिनांक 10 अप्रैल, 2022, जिसे दिनांक 10 अप्रैल, 2022 को भारत के राजपत्र, असाधारण, के भाग ।, खंड 1 में प्रकाशित किया गया 3468 GI/2022

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] था, के तहत अपने अंतिम निष्कर्षों में अधिसूचना संख्या फा. सं. 06/38/2020-डीजीटीआर, दिनांक 28 सितम्बर, 2021, जिसे दिनांक 28 सितम्बर, 2021 को भारत के राजपत्र, असाधारण, के भाग ।, खंड 1 में प्रकाशित किया गया था, के तहत जारी किए गए अपने अंतिम निष्कर्षों की शुल्क तालिका को बदले जाने की सिफारिश की थी ।

अत: अब, सीमा शुल्क टैरिफ (पाटित वस्तुओं की पहचान, उनका मूल्यांकन और उन पर प्रतिपाटन शुल्क का संग्रहण तथा क्षति निर्धारण) नियमावली, 1995 के नियम 18 और 20 के साथ पठित उक्त सीमा शुल्क टैरिफ अधिनियम की धारा 9क की उपधारा (1) और (5) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्र सरकार, उक्त विनिदिष्ट प्राधिकारी के उपयु र्क्त अंतिम निष्कर्षों पर विचार करने के पश्चात, एतदद्वारा, भारत सरकार, वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना संख्या 77/2021-सीमाशुल्क (एडीडी), दिनांक 27 दिसम्बर, 2021, जिसे सा.का.नि. 882 (अ), दिनांक 27 दिसम्बर, 2021 के तहत भारत के राजपत्र, असाधारण, के भाग ।।, खंड 3, उप खंड (i) में प्रकाशित किया गया था, में निम्नलिखित संशोधन करती है ।

उक्त अधिसूचना में, सारणी और उससे सम्बंधित प्रविष्टियों के स्थान पर निम्नलिखित सारणी को प्रतिस्थापित किया जाएगा, यथा:-

सारणी

*40-130 जीएसएम के रील फार्म के रूप में अनकोटेड पेपर जिनकी क्लेम अवशोषकता कम से कम 12 मिमी प्रति 10 मिनट हो, टेनसाइल स् ट्रेंथ 6-12 एन/15 मिमी हो और गुर्ली पोरोसिटी 10-40 सेकेंड/100 मिलीलीटर, जिसमें टाइटेनियम डाइऑक्साइड या पिगमेंट्स फिलर के रूप में मौजूद हों । इसमें हाई प्रेशर के बेस पेपर (एचपीएल) या लो-प्रेशर डेकोरेटिव लेमिनेट्स (एलपीएल) आते हैं, जिन् हें डिकोर पेपर, डेकोरेटिव बेस पेपर, हाई-प्रेशर के डेकोरेटिव पेपर या लो- प्रेशर लैमिनेट्स, कोटिग बेस पेपर और प्रिट बेस पेपर के नाम से भी जाना जाता है । लेकिन इसमें रेडी-टू-यूज़ डिकोर पेपर नहीं आते हैं ।

प्रश् नगत उत्पाद में विभिन्न प्रकार के डिकोर पेपर जैसे कि सरफेसिग पेपर (व्हाइट/ऑफ-व्हाइट), लाइनर (व्हाइट/ऑफ- व्हाइट), बैरियर पेपर, शटरिग बेस, ओवरले पेपर और प्रिट बेस पेपर (रंगीन/सफेद) आते हैं । इनका वैक्सिग, कोटिग और इंप्रेग् नेशन के लिए बेस पेपर के रूप में; प्रिटिग के बेस पेपर के रूप में; डेकोरेटिव इंडस् ट्री और बैरियर पेपर में प्रयोग किए जाने के लिए बेस पेपर के रूप में आयात किया जा सकता है, और यह विभिन् न आकार के जैसे कि 95 सेमी, 96 सेमी, 102 सेमी, 123 सेमी, 123.5 सेमी, 124 सेमी, 124.5 सेमी, 125 सेमी, 131 सेमी, 132 सेमी, 183 सेमी, 184 सेमी और 185 सेमी के हो सकते हैं ।

NOTIFICATION

No. 15/2022-Customs (ADD)

G.S.R. 387(E).—Whereas in the matter of 'Décor Paper' (hereinafter referred to as the 'subject goods') falling under tariff item 4805 91 00 or 4802 20 90 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the 'Customs Tariff Act'), originating in, or exported from People's Republic of China (hereinafter referred to as the 'subject country'), and imported into India, the designated authority in its final findings, vide, notification number F. No. 6/38/2020-DGTR, dated the 28th September, 2021, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 28th September, 2021, has recommended imposition of an anti-dumping duty on the imports of subject goods, originating in, or exported from the subject country and imported into India;

And whereas, on the basis of the aforesaid final findings, vide, notification number F. No. 6/38/2020-DGTR, dated the 28th September, 2021 of the designated authority, the Central Government had imposed anti-dumping duty on the subject goods vide notification of the Government of India in the Ministry of Finance (Department of Revenue), No. 77/2021-Customs(ADD), dated the 27th December, 2021 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) of the, vide, number G.S.R. 882(E), dated the 27th December, 2021;

And whereas, the designated authority in its final findings vide notification number 6/38/2020- DGTR, dated the 10th April, 2022, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 10th April, 2022, has recommended substitution of Duty Table in its final findings issued, vide, notification number F. No. 6/38/2020-DGTR, dated the 28th September, 2021, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 28th September, 2021.

Now, therefore, in exercise of the powers conferred by sub-sections (1) and (5) of section 9A of the Customs Tariff Act read with rules 18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government, after considering the said final findings of the designated authority, hereby makes the following amendments in the notification of the Government of India, Ministry of Finance (Department of Revenue), No. 77/2021-Customs(ADD), dated the 27th December, 2021 published in the Gazette of India, Extraordinary Part II, Section 3, Sub-section (i) of, vide, number G.S.R. 882(E), dated the 27th December, 2021, namely :-

In the said notification, for the TABLE and the entries relating thereto, the following Table shall be substituted, namely:-

"TABLE

*uncoated paper in reel form of 40-130 GSM, having klemm absorbency of at least 12 mm per 10

minutes, wet tensile strength of 6-12 N/15 mm, and gurley porosity of 10-40 sec / 100 ml, containing

titanium dioxide or pigments as filler. It includes base paper for high pressure (HPL) or low-

pressure (LPL) decorative laminates, also known as decor paper, decorative base paper, decorative

paper for high-pressure or low-pressure laminates, coating base paper and print base paper, but

excluding printed ready-to-use decor paper.

The subject goods include various types of decor paper, such as surfacing paper (white/off-white),

liner (white / off-white), barrier paper, shuttering base, overlay paper and print base paper (color /

white). It may be imported as base paper for waxing, coating and impregnation; base paper for

printing; base paper for use in decorative industry and barrier paper, and may come in various sizes

as 95 cm, 96 cm, 102 cm, 123 cm, 123.5 cm, 124 cm, 124.5 cm, 125 cm, 131 cm, 132 cm, 183 cm,

184 cm and 185 cm.".
