का.आ. 2371(अ).—जबकि, विदेशी मुद्रा संरक्षण और तस्करी गतिविधि निवारण अधिनियम, 1974 (1974 का 52) की धारा 3 की उप-धारा (1) के तहत विशेष रूप से अधिकार-प्राप्त संयुक्त सचिव, भारत सरकार द्वारा उक्त उप-धारा के तहत जारी आदेश सं.पीडी-12001/09/2022- कोफे पोसा दिनांक 01.02.2022 में यह निदेश दिया गया था कि अतुल गुप्ता उर्फ पिटू, निवासी मकान सं. 132, गली घी मंडी, पहाड़गंज, नई दिल्ली-110055 को हिरासत में लिया जाए और तिहाड़ के न्द्रीय जेल, नई दिल्ली में रखा जाए ताकि भविष्य में उन्हें माल की तस्करी करने, माल की तस्करी को बढ़ावा देने और तस्करी के माल का परिवहन करने या छिपाने या रखने से रोका जा सके ।

2. जबकि कें द्र सरकार के पास यह विश्वास करने के कारण हैं कि पूर्वोक्त व्यक्ति भगोड़ा है या अपने को छिपाए हुए है ताकि आदेश का पालन न किया जा सके ।

3. अत:, अब, उक्त अधिनियम की धारा 7 की उप-धारा (1) के खंड (ख) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार, एतद् द्वारा पूर्वोक्त व्यक्ति को निदेश देती है कि सरकारी राजपत्र में इस आदेश के प्रकाशन की तारीख से 7 दिनों के अंदर वह पुलिस आयुक्त, दिल्ली के सामने उपस्थित हो।[फा. सं. पीडी-12001/09/2022 – कोफे पोसा] रवि प्रताप सिह, संयुक्त सचिव 3472 GI/2022 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF FINANCE (Department of Revenue)

ORDER

New Delhi, the 24th May, 2022

S.O. 2371(E).—Whereas the Joint Secretary to the Government of India, specially empowered under sub-section (1) of Section 3 of the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974 (52 of 1974) issued Order No. PD-12001/09/2022-COFEPOSA dated 01.02.2022 under the said sub-section directing that Atul Gupta alias Pintu, R/o House No.132, Gali Ghee Mandi, Paharganj, New Delhi -110055 be detained and kept in Tihar Central Jail, New Delhi with a view to prevent him from smuggling of goods, abetting the smuggling of goods and engaging in transporting or concealing or keeping smuggled goods in future.

2. Whereas the Central Government has reasons to believe that the aforesaid person has absconded or has been concealing himself so that the Order cannot be executed.

3. Now, therefore, in exercise of the powers conferred by clause (b) of sub-section (1) of Section 7 of the said Act, the Central Government hereby directs the aforesaid person to appear before the Commissioner of Police, Delhi within 7 days of the publication of this Order in the Official Gazette.
