सा.का.नि. 393(अ).—औषधि नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों के निम्नलिखित प्रारूप, जिसे कें द्रीय सरकार औषधि तकनीकी सलाहकार बोर्ड के परामर्श से औषधि और प्रसाधन सामग्री अधिनियम, 1940 (23 के 1940) की धारा 12 की उप-धारा (1) और धारा 33 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इसके द्वारा प्रभावित होने की संभावना वाले सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है और एतद् द्वारा सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से तीस दिनों की अवधि समाप्त होने पर या उसके पश्चात् विचार किया जाएगा जिस तारीख को इन प्रारूप नियमों वाले भारत के राजपत्र की प्रतियां जनता को उपलब्ध कराई जाएगी;
कें द्रीय सरकार द्वारा उपयु र्क्त निदिष्ट अवधि के भीतर किसी भी व्यक्ति से प्राप्त होने वाली आपत्तियों और सुझावों पर विचार किया जाएगा;
आपत्तियां और सुझाव, यदि कोई हों, तो अवर सचिव (औषधि), स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार, कमरा सं. 434, सी विग, निर्माण भवन, नई दिल्ली - 110011 को अग्रेषित किया जाए अथवा drugsdiv- [email protected] पर ई-मेल किया जाए।

प्रारूप नियम
1. (1) इन नियमों को औषधि (....संशोधन) नियम, 2022 कहा जाएगा।
(2) नियम राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रभावी होंगे।
2. औषधि नियम 1945 में, अनुसूची ट में, क्रम संख्यांक 39 और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्यांक और प्रविष्टि अंतःस्थापित की जाएगी, अर्थात्:—

"40. निम्नलिखित औषधि की वैध अनुज्ञप्ति के अधीन ओवर-द-काउं टर अधिनियम के अध्याय IV और इसके अधीन नियमों
के उपबंधों में प्रावधान है कि इन औषधियों की (ओटीसी) खुदरा बिक्री की जानी है:
निम्नलिखित शर्तों के अधीन एक रजिस्ट्रीकृ त (1) पोवीडोन आयोडीन 5% डब्ल्यू/वि सौलूशन संघटन: पोवीडोन
चिकित्सक (आरएमपी) के नुस्खे के बिना ओवर-द- आयोडीन 5% डब्ल्यू/वि (एंटीसेप्टिक और कीटाणुनाशक एजेंट)
काउं टर खुदरा बिक्री की जा सकती है, अर्थात्:—
(2) क्लोरहेक्सिडिन माउथवॉश
(क) उपचार / उपयोग की अधिकतम अवधि पांच संघटन: क्लोरहेक्सिडिन ग्लूकोनेट 0.2% (मसूड़े की सूजन के
दिनों से अधिक नहीं होनी चाहिए । उपचार के लिए)
(ख) यदि लक्षण हल नहीं होते हैं तो रोगी को (3) क्लोट्रिमेज़ोल क्रीम
रजिस्ट्रीकृ त चिकित्सक से परामर्श लेना संघटन: क्लोट्रिमेज़ोल 1% डब्ल्यू/ डब्ल्यू क्रीम (एंटीफ़ं गल)
चाहिए ।
(4) क्लोट्रिमेज़ोल डस्टिग पाउडर
(ग) पैक साइज पांच दिनों के लिए अनुशंसित संघटन: क्लोट्रिमेज़ोल 1% डब्ल्यू / डब्ल्यू पाउडर (एंटीफं गल)
अधिकतम खुराक से अधिक नहीं हो ।
(घ) औषधि के प्रत्येक पैक के साथ रोगी सूचना पत्रक (5) डेक्स्ट्रोमेथोर्फ न हाइड्रोब्रोमाइड लोज़ेंजेस (5एमजी) (खांसी)
(पीआईएल) संलग्न होना चाहिए । (6) डाइक्लोफे नाक ऑइंटमेंट / क्रीम / जेल
(ड़) दावा किया गया संके त वही होना चाहिए जो प्रत्येक ग्राम जेल में 10 मिलीग्राम डाइक्लोफे नाक सोडियम (11.6
उल्लिखित श्रेणियों के लिए नियम 21(ख) के मिलीग्राम डाइक्लोफे नाक डायइथाइलआमोनियम के बराबर)
अधीन अनुज्ञापन प्राधिकरण द्वारा पहले से ही होता है। (एनाल्जेसिक)
अनुमोदित है ।"
(7) डाइफे नहाइड्रामाइन कै प्सूल 25 मिलीग्राम
(एंटीहिस्टामिनिक/एंटीएलजिक)
(8) पैरासिटामोल टैबलेट्स 500 मिलीग्राम (एंटीपायरेटिक)
(9) सोडियम क्लोराइड नेसल स्प्रे - 0.9% (नेसल डीकं जस्टेन्ट)
(10) ऑक्सीमेटाज़ोलिन नेसल सौलूशन 0.05% (नेसल डीकं जस्टेन्ट)
(11) के टोकोनाज़ोल शैम्पू 2% डब्ल्यू/वि (एंटी डैंड्रफ)
(12) लैक्टुलोज सौलूशन 10 ग्राम/15 मिली (लैक्सेटिव)
(13) बेंज़ोयल पेरोक्साइड 2.5 डब्ल्यू/ डब्ल्यू (मु ँहासे के लिए
जीवाणुरोधी)
(14) कै लामाइन लोशन (एंटी सेप्टिक)
(15) जाइलोमेटाज़ोलिन हाइड्रोक्लोराइड 0.05% डब्ल्यू/वि (नेसल
डीकं जस्टेन्ट)
(16) बिसाकोडील टैबलेट्स 5 मिलीग्राम (लैक्सेटिव)

NOTIFICATION
New Delhi, the 25th May, 2022
G.S.R. 393(E).—The following draft of certain rules further to amend the Drugs Rules, 1945, which the Central Government proposes to make, in exercise of the powers conferred by sub-section (1) of section 12 and sub- section (1) of section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) and in consultation with the Drugs Technical Advisory Board is hereby published for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration on or after the expiry of a period of thirty days from the date on which the copies of the Gazette of India containing these draft rules are made available to public;
Objections and suggestions which may be received from any person within the period specified above will be considered by the Central Government;
Objections and suggestions, if any, may be addressed to the Under Secretary (Drugs), Ministry of Health and Family Welfare, Government of India, Room No. 434, C Wing, Nirman Bhavan, New Delhi - 110011 or emailed at [email protected].
DRAFT RULES
1. (1) These rules may be called the Drugs (…..Amendment) Rules, 2022.
(2) These rules shall, unless specified otherwise, come into force on the date of their final publication in the Official Gazette.
2. In the Drugs Rules, 1945, in Schedule K after serial no. 39 and entries relating thereto, the following serial number and entries shall be inserted, namely:—
Class of Drugs ―40. The following drugs to be sold Over-The-Counter (OTC) by retail under the valid licence:
(1) Povidone Iodine 5% w/v solution Composition: Povidone
Iodine 5% w/v (Antiseptic and disinfectant agent)
Extent and conditions of Exemptions The provisions of Chapter IV of the Act and Rules thereunder to provide that these drugs can be sold by retail Over-The-Counter without prescription of a Registered Medical Practitioner (RMP), subject to the following conditions, namely:—
(2) Chlorohexidine Mouth wash Composition: Chlorohexidine Gluconate 0.2% (For the treatment of gingivitis)
(a) The maximum duration of treatment/use should not exceed five days.
(3) Clotrimazole cream Composition: Clotrimazole 1% w/w
cream (Antifungal)
(4) Clotrimazole dusting powder Composition: Clotrimazole
(b) If the symptoms do not resolve the patient should consult Registered Medical Practitioner.

(5) Dextromethorphan Hydrobromide Lozenges (5mg)
(Cough)
(c) Pack size may not exceed the maximum doses recommended for five days.
(6) Diclofenac ointment/cream/gel Each gram of gel contains 10 mg of diclofenac sodium (equivalent to 11.6 mg of diclofenac diethylammonium) (Analgesic)
(d) Each pack of the drug may be accompanied with Patient Information Leaflet (PIL).
(7) Diphenhydramine Capsules 25 mg (Antihistaminic/Antiallergic)
(e) The indication claimed should be same as already approved by the Licensing Authority under Rule 21(b) for the categories mentioned.‖
(8) Paracetamol tabs 500 mg (Antipyretic)
(9) Sodium Chloride Nasal spray – 0.9% (Nasal
Decongestant)
(10) Oxymetazoline nasal solution 0.05% (Nasal
Decongestant)
(11) Ketoconazole shampoo 2% w/v (Anti dandruff)

(14) Calamine Lotion (Anti septic)
