सा.का.नि. 396(अ).—भारतीय विमानपत्तन आथिक विनियामक प्राधिकरण अधिनियम, 2008 (2008 का अधिनियम 27) की धारा 51 की उप-धारा (2) के खंड (ड.) के साथ पठित धारा 9 की उप-धारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और विमानपत्तन आथिक विनियामक प्राधिकरण (सचिव), भर्ती नियम, 2012 को, अधिक्रमित करते हुए, इस अधिक्रमण से पूर्व किए गए कार्यों और किए जाने वाले विलोपों को छोड़कर, कें द्रीय सरकार, विमानपत्तन आथिक विनियामक प्राधिकरण के सचिव के पद से संबंधित सेवा शर्तों को विनियमित करते हुए निम्नलिखित नियम बनाती है, नामत:-
1 लघु शीर्ष और प्रारंभन– (1) इन नियमों का नाम विमानपत्तन आथिक विनियामक प्राधिकरण (सचिव), भर्ती नियम, 2022 है।
(2) ये नियम शासकीय राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।
2. पद की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर – पद की संख्या, इसका वर्गीकरण और इससे जुड़े वेतन मैट्रिक्स में इसका स्तर, इन नियमों के साथ अनुबंधित अनुसूची के कॉल (2) से (4) में यथा वनिदिष्ट होगा।
3. भर्ती का तरीका, आयु-सीमा, अन्य अर्हताएं आदि- भर्ती का तरीका, अर्हता, अनुभव, योग्यता और इससे संबंधित अन्य मामले, उक्त अनुसूची के कॉलम (5) से (13) में यथा विनिदिष्ट होंगे।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. अयोग्यता.- कोई भी व्यक्ति, -
(क) जो ऐसे किसी व्यक्ति के साथ विवाह कर चुका हो अथवा ऐसा विवाह करने की औपचारिक सहमति दी हो, जिसका/जिसकी पति/पत्नी जीवित है; या
(ख) जो जीवित पति/पत्नी के होते हुए किसी व्यक्ति के साथ विवाह कर चुका हो अथवा या ऐसा विवाह करने पर औपचारिक सहमति दी हो
उक्त पद पर नियुक्ति के लिए अर्हक नहीं होगा:
परंतु यह कि कें द्रीय सरकार, यदि इस बात से संतुष्ट हो कि ऐसा विवाह ऐसे व्यक्ति और विवाह के दूसरे पक्षकार के लिए लागू वैयक्तिक विधि के अंतर्गत अनुमत्य है और यह कि ऐसा करने के अन्य आधार हैं, तो वह किसी भी व्यक्ति को इस नियम के लागू किए जाने से छू ट दे सकती है।
5. शिथिल करने की शक्ति.- जहां कें द्रीय सरकार का यह मत हो कि ऐसा करना आवश्यक या उचित है, तो वह लिखित में अभिलेखबद्ध कारणों से और आदेश द्वारा, किसी भी श्रेणी या वर्ग के व्यक्तियों के संबंध में इन नियमों के किसी भी प्रावधान को शिथिल कर सकती है।
6. छू ट.- इन नियमों की कोई भी बात, कें द्रीय सरकार द्वारा इस संबंध में समय समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, पूर्व-सैनिकों और अन्य पिछड़े वर्गों और अन्य विशेष श्रेणी के व्यक्तियों को प्रदान किए जाने के लिए अपेक्षित किसी भी आरक्षण, आयु-सीमा की छू ट या अन्य कोई रियायत को प्रभावित नहीं करेगी।

| प्रतिनियुक्ति : क ें द्र सरकार के अधिकारी (क) (i) मूल कै डर या विभाग में नियमित आधार पर समकक्ष पद धारण किए हों; अथवा (ii) पे मैट्रिक्स के लेवल 13ए (रु. 1,31,100 - 2,16,600/-) के पद पर दो वर्ष की नियमित सेवा की हो; अथवा (iii) पे मैट्रिक्स के लेवल 13 (रु. 1,23,100 - 2,15,900) में तीन वर्ष की नियमित सेवा की हो; (ख) जो निम्नलिखित आवश्यक शैक्षिक योग्यता और अनुभव रखते हो – मान्यताप्राप्त विश्वविद्यालय से स्नातक की डिग्री (ऐसे अधिकारियों को प्राथमिकता दी जाएगी जिन्हें विमानन के क्षेत्र में पूर्व अनुभव हो अथवा जिन्होंने विनियमन तथा अवसंरचना प्रबंधन में कार्य किया हो)। नोट: प्रतिनियुक्ति की अवधि, जिसमें कें द्र सरकार के उसी या किसी अन्य संगठन या विभाग में, इस नियुक्ति से ठीक पहले धारित किसी अन्य बाह्य-संवर्ग पद पर प्रतिनियुक्ति की अवधि शामिल है, आमतौर पर पाँच वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति के द्वारा नियुक्ति के लिए अधिकतम आयु सीमा, आवेदन प्राप्त करने की अंतिम तिथि को छप्पन वर्ष से अधिक नहीं होगी। | |

NOTIFICATION
New Delhi, the 24th May, 2022
G.S.R. 396(E).—In exercise of the powers conferred by sub-section (3) of section 9 read with the clause (e) of sub - section (2) of section 51 of the Airports Economic Regulatory Authority of India Act, 2008 (Act 27 of 2008), and in supersession of the Airports Economic Regulatory Authority (Secretary), Recruitment Rules, 2012, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the terms and conditions of service relating to the post of Secretary in the Airports Economic Regulatory Authority, namely:
1 Short title and commencement. – (1) These rules may be called the Airports Economic Regulatory Authority (Secretary) Recruitment Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and level in the pay matrix. – The number of post, its classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, other qualifications, etc.- The method of recruitment, eligibility, experience, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification.- No person, -
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operations of this rule.
5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of provisions of these rules with respect to any class or category of persons.
6. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-Servicemen, and Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other Organization or Department of the Central Government shall ordinarily not exceed five years. The maximum age limit for appointment by deputation shall be not exceeding fifty-six years as on the closing date of receipt of the applications. | ||
