सा.का.नि. 398(अ).— के न्द्रीय सरकार, भारत-तिब्बत सीमा पुलिस बल अधिनियम, 1992 (1992 का 35) की धारा 156 की उप-धारा (2) के खंड (ख) के साथ पठित उपधारा (1), द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत- तिब्बत सीमा पुलिस बल में द्वितीय कमान (इंजीनियर), समूह 'क' के पद पर भर्ती के पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभ.— (1) इन नियमों का संक्षिप्त नाम गृह मंत्रालय, भारत-तिब्बत सीमा पुलिस बल, द्वितीय कमान (इंजीनियर), समूह 'क' पद भर्ती नियम, 2022 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. पद-संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर: उक्त पद की संख्या, उसका वर्गीकरण और वेतन मैट्रिक्स में उसका स्तर वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिदिष्ट हैं ।
3. भर्ती की पद्धति, आयु-सीमा और अर्हताएं आदि : भर्ती की पद्धति, आयु-सीमा, अर्हताएँ और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिदिष्ट हैं।
4. अधिवषिता— ऐसे अधिकारी जो द्वितीय कमान (इंजीनियर) का उक्त रैंक धारण किए हुए हैं, उस मास के जिसमें वे साठ वर्ष की आयु प्राप्त करते हैं, अंतिम दिन के अपराह्न में सेवानिवृत्त होंगे।
परन्तु यह कि वह व्यक्ति, जिसके जन्म की तारीख किसी मास की पहली तारीख है, अर्थात् साठ वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अंतिम दिन के अपराह्न से सेवानिवृत्त होगा।

(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह का संविदा की है; या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है।
उक्त पद पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदि कें द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुञेयेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।
6. चिकित्सक दृष्टया योग्यता.— इन नियमों में अंतविष्ट किसी बात के होते हुए भी, के वल वे व्यक्ति जो के न्द्रीय सशस्त्र पुलिस बलों के चिकित्सा देख-रेख पद्धति में यथाविनिदिष्ट चिकित्सा प्रवर्ग शेप-1 में हैं, प्रोन्नति और नियुक्ति जिसके अन्तर्गत इन नियमों के उपबंधों के अधीन प्रतिनियुक्ति या पुननियोजन पर भी नियुक्ति भी है, के लिए पात्र होंगे । 7. शिथिल करने की शक्ति: जहॉं के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।
8. गैर भारतीय नागरिकों की अपात्रता.- कोई भी व्यक्ति को, जो भारत का नागरिक नहीं है, लिखित में के न्द्रीय सरकार की पूर्व अनुमति के बिना, इन नियमों के अधीन नियुक्त नहीं किया जाएगा:
परन्तु इन नियम में अंतविष्ट किसी बात के होते हुए भी बल में नेपाल या भूटान की प्रजा को नियुक्ति या नियोजन में मना नहीं किया जाएगा।
9. व्यावृति.— इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

| प्रोन् नति द्वारा: भारत-तिब् बत सीमा पुलिस बल में स् तर-11 में ऐसे उप कमांडेंट(इंजीनियर) में से जिन् होंने उस श्रेणी में पॉंच वर्ष नियमित सेवा के साथ इंजीनियरी काडर में समूह 'क' में कु ल दस वर्ष सेवा की है और जिन् होंने विहित पूर्व- प्रोन् नतीयतीय पाठ्यक्रम को सफलतापूर्वक पूरा किया हो। |

| समूह 'क' विभागीय प्रोन्नति समिति (प्रोन् नति के संबंध में विचार करने के लिए) जिसमें निम् नलिखित होंगे: - 1. महानिदेशक या अपर महानिदेशक, भारत-तिब्बत सीमा पुलिस बल - अध्यक्ष; 2. संयुक् त सचिव, गृह मंत्रालय - सदस्य; 3. महानिरीक्षक, भारत-तिब्बत सीमा पुलिस बल - सदस् य; 4. महानिरीक्षक(इंजीनियर) या उप महानिरीक्षक (इंजीनियर), भारत-तिब्बत सीमा पुलिस बल - सदस् य। |

NOTIFICATION
New Delhi, the 26th May, 2022
G.S.R. 398(E).—In exercise of the powers conferred by sub section (1) read with clause (b) of sub- section (2) of section 156 of the Indo-Tibetan Border Police Force Act, 1992 (35 of 1992), the Central Government hereby makes the following rules regulating the method of recruitment to the post of Second- in-Command (Engineer), Group 'A' post in the Indo-Tibetan Border Police Force, namely :-
1. Short title and commencement.—(1) These rules may be called the Ministry of Home Affairs, Indo-Tibetan Border Police Force, Second-in-Command (Engineer), Group 'A' Post, Recruitment Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and level in the pay matrix.— The number of said post, its classification and the level in the pay matrix attached thereto, shall be such as specified in Columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit and other qualifications, etc..— The method of recruitment, age-limit, qualifications and other matters relating thereto, shall be as specified in Columns (5) to (13) of the aforesaid Schedule.
4. Superannuation.— Officers holding the said rank of Second-in-Command(Engineer) shall retire from service in the afternoon of the last day of the month in which they attain the age of Sixty years.
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]Provided that the person whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of superannuation i.e. Sixty years.
5. Disqualification.— No person,—
(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Medical Fitness.—Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, as specified in Health Care System in Central Armed Police Forces, shall be eligible for promotion and appointment including appointment on deputation or re-employment under the provisions of these rules.
7. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
8. Ineligibility of non-citizens of India.—No person who is not a citizen of India shall, except with the prior permission of Central Government in writing, be appointed under these rules:
Provided that nothing contained in this rule shall debar the appointment or employment of a subject of Nepal or Bhutan in the Force.
9. Saving.— Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

| By Promotion: From amongst Deputy Commandant (Engineer) of Indo-Tibetan Border Police Force in level 11 with five years regular service in the grade with total ten years Group 'A' service in the Engineering cadre and having successfully completed the prescribed pre-promotional course. Note : Where juniors who have completed their qualifying or eligibility service are being considered for promotion their senior would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher level in the pay matrix along with their juniors who have already completed such qualifying or eligibility service. |
