सा.का.नि. 857(अ).—कें द्रीय सरकार विद्युत अधिनियम, 2003 (2003 का 36) की धारा 176 की उप-धारा (2) के खंड (ध) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विद्युत अपील अधिकरण के अधिकारियों और कर्मचारियों के वेतन, भत्ते और सेवा की अन्य शतें नियम, 2004 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थातः 1. (1) इन नियमों का संक्षिप्त नाम विद्युत अपील अधिकरण के अधिकारियों और कर्मचारियों के वेतन, भत्ते और सेवा की अन्य शतें (संशोधन) नियम, 2022 है।
(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. विद्युत अपील अधिकरण के अधिकारियों और कर्मचारियों के वेतन, भत्ते और सेवा की अन्य शतें नियम, 2004 (जिसे इसमें इसके पश्चात् उक्त नियम कहा है) में, अनुसूची-II में, पैरा 1 में, खंड (ग) के स्थान पर, निम्नलिखित खंड रखा जाएगा, अर्थात्:

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] "(ग) "पैनलीकृ त अस्पताल और नैदानिक कें द्र" सेस्वास्थ्य एवं परिवार कल्याण मंत्रालय के समय-समय पर यथा संशोधित तारीख 7.9.2001 के कार्यालय ज्ञापन सं. 24/2001/जेडी(एम)/सीजीएचएस/दिल्ली/ सीजीएचएस (पी) द्वारा मान्यता प्राप्त विशिष्ट और साधारण प्रयोजन के उपचार और नैदानिक प्रयििाओं के लिए कें द्र सरकार स्वास्थ्य योजना के अधीन सभी मान्यता प्राप्त निजी अस्पतालों या नैदानिक कें द्रों सहित सरकारी अस्पताल या नैदानिक कें द्र, अभिप्रेत हैं।"
3. उक्त नियमों की अनुसूची में, पैरा 1 में, खंड (घ) के स्थान पर, निम्नलिखित खंड रखा जाएगा, अर्थात्:-
"(घ) "परिवार" से यथा स्थिति किसी सरकारी कर्मचारी की पत्नी या पति, और माता-पिता, बहनें, विधवा बहनें, विधवा पुत्रियां, अव्यस्क भाई, बच्चे, सौतेली संतान अथवा विवाह-विच्छेदित या पृथक हो चुकी पुत्रियां तथा सरकारी कर्मचारी पर पूर्णतः निर्भर और सरकारी कर्मचारी के साथ सामान्य रूप से रह रही सौतेली मां, अभिप्रेत है।"
4. उक्त नियमों की अनुसूची में, पैरा 5 के स्थान पर निम्नलिखित पैरा रखा जाएगा, अर्थात्:-
5. "कर्मचारी समय-समय पर यथा संशोधित कें द्र सरकार स्वास्थ्य योजना की दरों के अनुसार चिकित्सा व्यय की प्रतिर्पूर्त के हकदार होंगे।"

पीयूष सिंह, संयुक्त सचिव टिप्पणी:-मूल नियम तारीख 28 अक्तूबर, 2004 की संख्या जी.एस.आर.721(अ) द्वारा प्रकाशित किए गए थे और तत्पश्चात् तारीख 6 मई, 2005 की संख्या जी.एस.आर. 281(अ); तारीख 22 जुलाई, 2008 की संख्या सा.का.नि. 548(अ); तारीख 20 जुलाई, 2011 की संख्या सा.का.नि. 558(अ) और तारीख 16.1.2017 की संख्या जी.एस.आर. 39(अ) द्वारा संशोधित किए गए थे।

NOTIFICATION
New Delhi, the 29th November, 2022
G.S.R. 857(E).—In exercise of the powers conferred by clause(s) of sub-section (2) of section 176 of the Electricity Act, 2003(36 of 2003), the Central Government hereby makes the following rules further to amend the Appellate Tribunal for Electricity Salary, Allowances and other Conditions of Service of the Officers and Employees Rules, 2004, namely:-
1. (1) These rules may be called the Appellate Tribunal for Electricity Salary, Allowances and other Conditions of Service of the Officers and Employees (Amendment) Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Appellate Tribunal for Electricity Salary, Allowances and other Conditions of Service of the Officers and Employees Rules, 2004 (hereinafter referred to as the said rules), In Schedule II, in paragraph 1, for clause (c), the following clause shall be substituted, namely:-
"(c) empanelled hospital and diagnostic centre" means the Government Hospitals or Diagnostic Centers including all recognized Private Hospital or Diagnostic Centers under Central Government Health Scheme for Specialized and General Purpose Treatment and Diagnostic Procedures recognized vide Ministry of Health and Family Welfare O.M. No. 24/2001/JD(M)/CGHS/Delhi/CGHS(P), dated 7.9.2001 as amended from time to time."
3. In the Schedule to the said rules, in paragraph 1, for clause (d), the following clause shall be substituted, namely:-

"(d) "Family" means a Government servant's wife or husband, as the case may be, and parents, sisters, widowed sisters, widowed daughters, minor brothers, children, stepchildren divorced or separated daughters and stepmother wholly dependent upon the Government servant and are normally residing with the Government servant."
4. In the Schedule to the said rules, for paragraph 5, the following paragraph shall be substituted, namely:-:
5. "The employees shall be entitled to the reimbursement of medical expenses as per Central Government Health Scheme rates as amended from time to time".
