सं. बीईई/एस एवम् एल/ वॉटर हीटर/ 3/2022-23.—ऊर्जा संरक्षण अधिनियम, 2001 (2001 का 52) की धारा 58 की उपधारा (1) के अधीन यथाअपेक्षित, प्रारूप अधिसूचना, ऊर्जा दक्षता ब्यूरो (स्टेशनरी भंडारण प्रकार के विधुत् जल हीटर पर प्रदर्शन के विवरण और विधि) विनियम, 2022, अधिसूचना संख्यांक बीइई/एसएण्डएल/वाटर हीटर/3/2015- 16 द्वारा प्रकाशित किए गए थे, जिसमें उन सभी व्यक्तियों से, जिससे उनके प्रभावित होने की संभावना थी, उसके प्रकाशन तारीख से तीस दिनों विनिदिष्ट अवधि में समाप्ति से पूर्व आक्षेप और सुझाव आमंत्रित किए गए थे;
और, उक्त प्रारूप विनियम की प्रतियां जनता को 27 जून, 2022 को उपलब्ध करा दी गई थीं;
और, उपयु र्क्त अवधि के भीतर उक्त प्रारूप विनियमों के संबंध में सुझाव प्राप्त हुए हैं;
और, इस संबंध में प्राप्त सुझावों पर विचार किया गया है;
अत: अब, ऊर्जा संरक्षण अधिनियम, 2001 (2001 का 52) की धारा 13 की उपधारा (2) के खंड (ढ़) और धारा 14 का खंड (घ) के साथ पठित धारा 58 के उपधारा (2) के खंड (i) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्रीय सरकार के पूर्व अनुमोदन से ऊर्जा दक्षता ब्यूरो (स्टेशनरी भंडारण प्रकार के विधुत् जल हीटर पर प्रदर्शन के विवरण और विधि) विनियम, 2016, संशोधन करने के लिए निम्नलिखित नियम बनाता बनाती है, अर्थात्:-

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 1. लघु शीर्षक और आरम्भ .- (1) इन विनियमों का संछिप्त नाम ऊर्जा दक्षता ब्यूरो (स्टेशनरी भंडारण प्रकार विधुत् जल हीटर पर प्रदर्शन के विवरण और विधि) (संशोधन) विनियम, 2022 है।
(2) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।
2. ऊर्जा दक्षता ब्यूरो (स्टेशनरी भंडारण प्रकार के विधुत् जल हीटर पर प्रदर्शन के विवरण और विधि), (संशोधन), विनियम, 2022 (जिससे इसमें इसके पश्चात उक्त विनियम कहा जाएगा), "इलेक्ट्रिक वॉटर हीटर" और "वॉटर हीटर शब्दों के स्थान पर, जहां कहीं भी ये प्रयुक्त होते हैं, "स्टोरेज वाले स्टेशनरी इलेक्ट्रिक वाटर हीटर" शब्दों को रखा जाएगा। 3. उक्त विनियमों में विनियम 4 के स्थान पर निम्नलिखित विनियम रखा जाएगा, अर्थात्:-
"4. लेबल प्रदशित करने की समय सीमा.-
(1) स्वैच्छिक से अनिवार्य व्यवस्था में परिवर्तन - विनियम 3 में निदिष्ट सभी विवरणों वाला एक लेबल इन विनियमों के लागू होने की तारीख से छह महीने की अवधि के भीतर प्रत्येक स्टोरेज वाले स्टेशनरी प्रकार के विधुत् जल हीटर पर प्रदशित किया जाएगा।
(2) अनिवार्य ऊर्जा खपत मानकों का पुनरीक्षण - अधिनियम की धारा 14 के खंड (क) के अधीन के न्द्रीय सरकार द्वारा अधिसूचित संशोधित ऊर्जा खपत मानकों के प्रारंभ होने पर, प्रत्येक अनुज्ञाधारी या व्यापारी या विक्रे ता, -
(क) पिछले ऊर्जा खपत मानकों के साथ स्टोरेज वाले स्टेशनरी विधुत् जल हीटर का उत्पादन नहीं करेगा;
(ख) स्टोरेज वाले स्टेशनरी विधुत् जल हीटर संशोधित ऊर्जा खपत मानक और संशोधित ऊर्जा खपत मानकों के साथ सिक्रनाइज़ेशन में स्टोरेज वाले स्टेशनरी विधुत् जल हीटर के निर्माण वर्ष के साथ संशोधित स्टार स्तर और लेबल अवधि प्रदशित करेगा;
(ग) डीलरों, खुदरा व्यापारियों को जानकारी देने के लिए, उनको शिक्षित करने के साथ ही उपभोक्ताओं को शिक्षित करने के लिए अपेक्षित प्रचार-प्रसार सहित सभी प्रारंभिक कदम समय रहते उठाए जाने चाहिए।
4. उक्त विनियमों के विनियम 6 के स्थान पर निम्नलिखित विनियम रखा जाएगा, अर्थात्:
"6. लेबल प्रदशित करने की अनुज्ञा - (1) ब्यूरो की पूर्व अनुमति प्राप्त किए बिना स्टेशनरी स्टोरेज प्रकार के विधुत् जल हीटर पर कोई स्टार लेबल नहीं लगाया जाएगा।
(2) ब्यूरो की अनुज्ञा प्राप्त करने के प्रयोजनों के लिए, प्रत्येक ब्रांड को एक लाख रुपए के लेबल प्रतिभूति शुल्क के साथ, अलग से रजिस्ट्रीकृ त किया जाएगा जैसा कि प्ररूप I - (क) में विनिदिष्ट किया गया है, भुगतान के इलेक्ट्रानिक मोड द्वारा देय है:
(3) उपविनियम (2) के अधीन अनुज्ञाधारक के प्रत्येक आवेदन के साथ-
(क) भुगतान के इलेक्ट्रॉनिक मोड द्वारा देय प्रति मॉडल दो हजार रुपए का आवेदन शुल्क; तथा (ख) इलेक्ट्रॉनिक मोड द्वारा देय एक लाख रुपये का एक लेबल सुरक्षा शुल्क:
परन्तु लघु उद्योग के मामले में लेबल सुरक्षा शुल्क पच्चीस हजार रुपए होगा; तथा
(ग) प्ररूप I में विनिदिष्ट दस्तावेज।
5. उक्त विनियमों के विनियम 7 में, -
(क) उपविनियम (1) के स्थान पर, निम्नलिखित उपविनियम को रखा जाएगा, अर्थात् -3 [भाग III—खण्ड 4] भारत का राजपत्र : असाधारण ''(1) विनियम के खंड 6 के अधीन कोई आवेदन प्राप्त होने पर और इससे संतुष्ट होने पर कि इसमें दी गई सभी अपेक्षाओं का पालन किया गया है, ब्यूरो मानक और लेबलिग पर ऐसी प्राप्ति की तारीख से ब्यूरो मानक और लेबलिग के मैनुअल में विनिदिष्ट अवधि के अंदर, विनियम 8 में यथा विनिदिष्ट नियमों एवं शर्तों के अध्यधीन अनुज्ञा प्रदान करता है,- (क) प्ररूप II-(क) में इलेक्ट्रॉनिक रूप में ब्रांड रजिस्ट्रीकृ त करना; या
(ख) प्ररूप II में इलेक्ट्रॉनिक रूप में स्टोरेज वाले स्टेशनरी इलेक्ट्रिक वाटर हीटर पर लेबल लगाने की अनुज्ञा देना।
(ख) उप विनियम (4) के स्थान पर निम्नलिखित उप विनियम रखा जाएगा।
"(4) स्टार रेटिग योजना के पुनरीक्षण के मामले में, अनुज्ञा के नवीनीकरण के लिए एक आवेदन अनुज्ञाधारी द्वारा इसकी समाप्ति से एक माह पहले नहीं किया जाएगा और इसके साथ ऊर्जा दक्षता ब्यूरो नई दिल्ली के पक्ष में इलेक्ट्रॉनिक मोड में देय एक हजार रुपए का शुल्क देय होगा।
परन्तु स्टार रेटिग योजना के विस्तार के मामले में, एक हजार रुपये के उक्त नवीनीकरण शुल्क से छू ट दी जाएगी।" 6. उक्त विनियमों में, -
(क) प्ररूप I में, शब्द और अक्षर, "डीडी नंबर द्वारा", दोनों स्थानों पर, शब्द "इलेक्ट्रॉनिक मोड द्वारा" रखा जाएगा। (ख) प्ररूप I के पश्चात्, निम्नलिखित प्ररूप और उपाबंध जोड़ा जाएगा, अर्थात्: -

मैं/हम स्टेशनरी भंडारण प्रकार विद्युत वॉटर हीटर का विनिर्माता /के विनिर्माता,............................(पूरा व्यावसायिक पता) में ....................शीर्षक से संचालित व्यवसाय (व्यक्ति या कं पनी का पूरा नाम) के लिये ब्यूरो द्वारा विनिदिष्ट ऊर्जा दक्षता ब्यूरो (स्टेशनरी भंडारण प्रकार के विधुत् जल हीटर पर प्रदर्शन के विवरण और विधि) विनियमन 2022, के अनुसार स्टेशनरी भंडारण प्रकार विद्युत जल हीटर पर लेबल लगाने की अनुमति के लिये आवेदन करना चाहता हूं /हैं।
उपकरण, कं पनी, विनिर्माण कें द्र और भुगतान के बारे में जानकारी का विवरण उपाबंध में दिया गया है। कं पनी रजिस्ट्रार या सोसायटी या उद्योग निदेशक (लघु इकाईयों के संदर्भ में) द्वारा जारी प्रमाणपत्र की फोटो प्रति या कं पनी और इसके विनिर्माण परिसरों की पुष्टि करने वाले समान अन्य दस्तावेज संलग्न हैं।
(क) आवेदक/अधिकृ त व्यक्तिः ..........................(नाम और पद), कं पनी/फर्म की ओर से या अन्य प्राधिकरणों की ओर से आवेदन करने के लिये अधिकृ त है और वह आवेदन के साथ दी गयी जानकारी की सत्यता के लिये भी उत्तरदायी होगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) संपर्क व्यक्तिः ............................(नाम और पद) इस आवेदन और लेबल के उपयोग के संदर्भ में ब्यूरो के साथ समन्वय के लिये संपर्क व्यक्ति बनने के लिये अधिकृ त है।

3. उक्त उपकरण के विनिर्माण और बिक्री तथा मूल्य संबंधी आंकड़ें मेरी/हमारी सर्वोत्तम जानकारी और अनुमान के आधार पर इस प्रकार हैः

6. मैं/हम ब्यूरो द्वारा निदिष्ट सभी नियम और शर्तें मानने के लिये और ब्यूरो को उसके द्वारा की जाने वाली किसी भी जांच की स्थिति में आवश्यक सहायता/सहयोग उपलब्ध कराने के लिये सहमत हैं।
7. मैं/हम ऊर्जा दक्षता ब्यूरो को पुष्टि और चुनौती परीक्षण के उद्देश्य से नमूनों के चयन के लिये अधिकृ त करते हैं और इस बारे में ब्यूरो के निर्देशों के पालन के लिये सहमत हैं।
8. मैं/हम वचन देते हैं कि इस आवेदन में दिया गया विवरण हमारी सर्वोत्तम जानकारी के अनुसार सही है, और यदि कोई भी जानकारी गलत पायी जाये तो आवेदन रद्द कर दिया जाये।

6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]1. ऊर्जा दक्षता ब्यूरो (स्टेशनरी भंडारण प्रकार के विधुत् जल हीटर पर प्रदर्शन के विवरण और विधि), (संशोधन), विनियमन 2022 के प्रावधानों के अनुसार ब्यूरो आपको अपना ब्रैंड इस पत्र के उपाबंध में निर्धारित अनुमोदनों के विवरण के अनुसार रजिस्ट्रीकृ त कराने की अनुमति देता है।
2. यह अनुमति निम्नलिखित के अधीन हैः-
(क) लेबल पर लगाया गया स्टार लेबल अधिनियम की धारा 14 के खंड (क) के अधीन अधिसूचित स्टेशनरी स्टोरेज टाईप इलेक्ट्रिक वॉटर हीटर के ऊर्जा उपभोग मानकों और विनियमन के नियमों और शर्तों के अनुरूप होना चाहिये;
(ख) लेबल की मुहर के वल ऐसे स्टेशनरी भंडारण प्रकार विद्युत जल हीटर पर लगायी जाये जिसके लिये अनुमति दी गयी है;
(ग) स्टेशनरी भंडारण प्रकार विद्युत जल हीटर पर लेबल की छपाई और लगाये जाने का खर्च अनुमति प्राप्त कर्ता द्वारा वहन किया जायेगा;
(घ) अनुमति प्राप्त कर्ता को सुनिश्चित करना होगा कि स्टेशनरी भंडारण प्रकार विद्युत जल हीटर पर लगाया गया स्टार लेबल हर समय बना रहे;
(ङ) अनुमति प्राप्तकर्ता ब्यूरो द्वारा विनिदिष्ट लेबल शुल्क करे;
(च) अनुमति प्राप्तकर्ता ब्यूरो के पास एक बयान जमा करेगा जिसमें लेबलयुक्त उपकरण के विनिर्माण और वित्तीय वर्ष की प्रत्येक तिमाही के बाद वाले महीने में प्रत्येक तिमाही के प्रोद्भूत लेबल शुल्क का ब्योरा होगा। यह समान जानकारी एक स्वचालित प्रणाली के माध्यम से भी ब्यूरो में जमा करायी जायेगी;
(छ) अनुमति प्राप्तकर्ता अनुमति मंजूर करने वाले ब्यूरो द्वारा मांगे जाने पर स्टेशनरी भंडारण प्रकार विद्युत जल हीटर के अन्य विवरण भी उपलब्ध करायेंगे;
3. अनुमति प्राप्तकर्ता ब्यूरो की पूर्व अनुमति के सिवाय सत्यापन अवधि के दौरान रजिस्ट्रीकृ त ब्रैंड और स्टेशनरी भंडारण प्रकार विद्युत जल हीटर बाजार से नहीं हटाय़ेंगे।
4. ब्रैंड के लिये ऊर्जा दक्षता ब्यूरो द्वारा प्रदत्त विशिष्ट लेबल श्रृ ंखला ............है और इसे अनुमोदित डिजाईन के अनुसार लेबल पर दर्शाया जाना चाहिये।

No.BEE/S&L/WaterHeater/3/2022-23.- Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage type Electric Water Heater) Regulations, 2022, were published vide notification number BEE/S&L/Water Heater/3/2015-16 as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the specified period of thirty days from the date of publication of the said notification in the Official Gazette;
And whereas, copies of the said draft regulations were made available to the public on 27th June, 2022;
And whereas, suggestions have been received with respect to the said draft regulations within the period aforesaid;
And whereas, the suggestions received in this regard have been taken into consideration;
12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations to amend the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage type Electric Water Heater) Regulations, 2016, namely:-
1. Short title and commencement.- (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage Type Electric Water Heater), (Amendment) Regulations, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage type Electric Water Heater), (Amendment) Regulations, 2022 (hereinafter referred to as the said regulations), for the words ―Electric Water Heater‖ and ―Water Heater, wherever they occur, the words ―Stationary Storage type Electric Water Heater‖ shall be substituted.
3. For regulation 4 of the said regulations, the following regulation shall be substituted, namely:-
―4. Time limit for display of labels.—
(1) Transition from Voluntary to Mandatory regime.- A label containing all the particulars specified in regulation 3 shall be displayed on every stationary storage type electric water heater within a period of six months from the date of coming into force of these regulations.
(2) Revision of Mandatory Energy Consumption Standards.- On and from the commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller, —
(a) shall not produce the stationary storage type electric water heater with the previous energy consumption standards;
(b) the stationary storage type electric water heater shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the stationary storage type electric water heater in synchronization with revised energy consumption standards;
(c) all preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken in advance.‖
4. For regulation 6 of the said regulations, the following regulation shall be substituted, namely:
"6. Permission for display of label. - (1) No star label shall be affixed on a Stationary Storage type Electric Water Heater without obtaining the prior permission of the Bureau.
(2) For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees, payable by electronic mode of payment.
(3) Every application of the permittee under sub-regulation (2) shall be accompanied by—
(a) an application fee of two thousand rupees per model, payable by electronic mode a n d (b) a label security fee of one lakh rupees, payable by electronic mode:
Provided that in case of small scale industry label security fee shall be twenty -five thousand rupees;
and
(c) documents specified in Form I .
5. In regulation 7 of the said regulations,-
(a) For sub-regulation (1), the following sub-regulation shall be substituted, namely:-
― (1) On receipt of an application under clause no. 6 of the regulation and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its Manual on standards and labelling, subject to such terms and conditions as specified in regulation 8, –
(a) grant permission to register the brand in Form II-(A) or in electronic form; and13 [भाग III—खण्ड 4] भारत का राजपत्र : असाधारण (b) grant permission for affixing label on stationary storage type electric water heater in Form II or in electronic form.''
(b) for sub-regulation (4), the following sub-regulation shall be substituted, namely:-
―(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.
Provided that in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.‖
6. In the said regulations,-
(a) In Form I, for the word and letter, ―by DD NO‖, occurring at both the places, the words ―by Electronic mode‖ shall be substituted.
(b) after Form I, the following Form and annexure shall be inserted, namely:--

1. Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage Type Electric Water Heater) Regulations, 2022, the Bureau hereby permits you to register your brand as per details of approvals set out in Annexure to this letter.
2. This permission is subject to—
(a) the star level displayed on the label of the Stationary Storage Type Electric Water Heater shall conform to energy consumption standards for Stationary Storage Type Electric Water Heater notified under clause (a) of section 14 of the Act and terms and conditions provided in the aforesaid regulations;
(b) the stamping of the label only on such model Stationary Storage Type Electric Water Heater for which permission has been granted;
(c) the printing and affixture of the label on the Stationary Storage Type Electric Water Heater at the cost of the permittee;
(d) the permittee ensuring that the star level displayed on the Stationary Storage Type Electric Water Heater shall be maintained at all time;
(e) the permittee paying the label fee as specified by the Bureau;

(g) the permittee making available such other details of Stationary Storage type Electric Water Heater as and when sought by the Bureau of which the permission has been granted.
3. The permittee shall not withdraw the registered brand and the Stationary Storage type Electric Water Heater from the market during the validity period except with the prior approval of the Bureau.
4. The unique label series code assigned by the Bureau of Energy Efficiency for the brand is............. and should appear on the label as per the approved design.
