का.आ. 6003(अ).—यत:, मै. सीमेंस हेल्थके यर प्राइवेट लिमिटेड, ने कर्नाटक राज्य में बैंगलोर जिले के बोम्मासांद्रा गांव अनेकल तालुक में आई.टी./आई.टी.ई.एस. की स्थापना हेतु विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28), (जिसे एतद्पश्चात् उक्त अधिनियम कहा गया है) की धारा 3 के अंतर्गत प्रस्ताव किया है;
और यतः, के न्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप.धारा (8) के अतंर्गत अपेक्षाओं तथा अन्य सबंधित अपेक्षाओं को पूरा कर लिया गया है और उनको उपयु र्क्त विशेष आर्थिक जोन के विकास, प्रचालन एवं रखरखाव हेतू उक्त अधिनियम की धारा 3 की उपधारा (10) के अतंर्गत दिनांक 24 नवम्बर, 2022 को अनुमोदन पत्र प्रदान कर दिया है;
अतः अब, विशेष आर्थिक जोन अधिनियम, 2005 की धारा 4 की उप.धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन अधिनियम, 2006 के नियम 8 के अनुसरण में के न्द्र सरकार, एतद्द्वारा उक्त स्थान के 3.0315 हेक्टेयर के नीचे दी गई तालिका में दिए गए सर्वेक्षण संख्याओं के क्षेत्रों को अधिसूचित करती है, अर्थात्ः- 8572 GI/2022

और अतः, विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28) की धारा 13 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्र सरकार, एतद्द्वारा उक्त अधिनियम की धारा 14 के प्रयोजनार्थ उपयु र्क्त विशेष आर्थिक जोन के लिए एक समिति, जिसे अनुमोदन समिति कहा जाएगा, गठित करती है, जिसके अध्यक्ष और सदस्य निम्नानुसार है, अर्थात्-
| 1. | विशेष आर्थिक जोन का विकास आयुक्त | अध्यक्ष, पदेन |
| 2. | निदेशक अथवा उप-सचिव, भारत सरकार, वाणिज्य एवं उद्योग मंत्रालय, वाणिज्य विभाग या उसका नामिती जिसका स्तर अवर सचिव, भारत सरकार से कम नहीं होगा | सदस्य, पदेन |
| 3. | विशेष आर्थिक जोन पर भू-भागीय क्षेत्राधिकार रखने वाले क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक | सदस्य, पदेन |
| 4. | विशेष आर्थिक जोन पर भू-भागीय क्षेत्राधिकार रखने वाले सीमा-शुल्क आयुक्त या के न्द्रीय उत्पाद शुल्क आयुक्त अथवा उनका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा | सदस्य, पदेन |

और यतः, विशेष आर्थिक जोन अधिनियम 2005 (2005 का 28) की धारा 53 की उप-धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्र सरकार एतद्द्वारा दिनांक 21 दिसम्बर, 2022 को उस तारीख के रूप में निर्धारित करती है जिस तारीख से उपयु र्क्त विशेष आर्थिक जोन को सीमा-शुल्क अधिनियम 1962 (1962 का 52) की धारा 7 के अंतर्गत अंतर्देशीय कं टेनर डिपो माना जाएगा।

NOTIFICATION
New Delhi, the 21st December, 2022
S.O. 6003(E).—Whereas, M/s. Siemens Healthcare Private Limited, has proposed under section 3 of the Special Economic Zones Act, 2005 (28 of 2005), (hereinafter referred to as the said Act) to set up an IT/ITES at Bommasandra Village Anekal Taluk, Bangalore District, in the State of Karnataka;
AND, WHEREAS, the Central Government is satisfied that requirements under sub-section (8) of section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub-section (10) of section 3 of the said Act for development, operation and maintenance of the above Special Economic Zone on 24th November, 2022;
NOW, THEREFORE, the Central Government, in exercise of the powers conferred by sub-section (1) of section 4 of the Special Economic Zones Act, 2005 and in pursuance of rule 8 of the Special Economic Zones Rules, 2006, hereby notifies the 3.0315 hectares area comprising the Survey numbers and the area given below in the table, namely: -

AND, THEREFORE, the Central Government, in exercise of the powers conferred by sub-section (1) of section 13 of the Special Economic Zones Act, 2005 (28 of 2005), hereby constitutes a Committee to be called the Approval Committee for the above Special Economic Zone for the purposes of section 14 of the said Act consisting of the following Chairperson and Members, namely:-
| 1. | Development Commissioner of the Special Economic Zone | Chairperson ex officio; |
| 2. | Director or Deputy Secretary to the Government of India, Ministry of Commerce and Industry, Department of Commerce or his nominee not below the rank of Under Secretary to the Government of India | Member ex officio; |
| 3. | Zonal Joint Director General of Foreign Trade having territorial jurisdiction over the Special Economic Zone | Member ex officio; |
| 4. | Commissioner of Customs or Central Excise having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner | Member ex officio; |
| 5. | Commissioner of Income Tax having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner | Member ex officio; |
| 6. | Director (Banking) in the Ministry of Finance, Banking Division, Government of India | Member ex officio; |
| 7. | Two officers, not below the rank of Joint Secretary, to be nominated by the State Government | Member ex officio; |
| 8. | Representative of the Developer of the zone | Special invitee |
AND, THEREFORE, the Central Government, in exercise of the powers conferred by sub-section (2) of section 53 of the Special Economic Zones Act, 2005 (28 of 2005), hereby appoints the 21st December, 2022 as the date from which the above Special Economic Zone shall be deemed to be Inland Container Depot under section 7 of the Customs Act, 1962 (52 of 1962).
