का.आ. 6012(अ).—जबकि, के न्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन भाराराप्रा को सौंपने के लिए जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की [अधिसूचना संख्या का. आ. 721(अ) दिनांक 27 जुलाई, 2000] द्वारा महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग 4बी (नया राष्ट्रीय राजमार्ग-348) के (ए1-ई सेक्शन किमी 3.600 से किमी 27.270 तक, डी-जी सेक्शन किमी 0.000 से किमी 4.492 {अब एनएच-548}) एसएच-54 (किमी 5.300 से किमी 14.850) और अमरा मार्ग (0.000 किमी से किमी 6.200 तक) का खंड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को (जिसे इसके पश्चात् "प्राधिकरण" कहा गया है) सौंपा है;
अतः अब के न्द्र सरकार, राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम, 2008 (जिसे इसके पश्चात "नियम'' कहा जाए) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए महाराष्ट्र राज्य में प्रस्तावित नवी मु ंबई अंतर्राष्ट्रीय हवाई अड्डा की सीमाओं पर 34.800 किमी सड़क खंड की निवल लंबाई के लिए और समकक्ष संरचना लंबाई (जिसकी लंबाई 60 मी से अधिक है) 91.120 किमी (जिसकी लंबाई 9.112 किमी है) के मौजूदा राष्ट्रीय राजमार्ग 4बी (नया राष्ट्रीय राजमार्ग-348)(ए 1-ई सेक्शन किमी 3.600 से किमी 27.270 तक, डी-जी सेक्शन किमी 0.000 से किमी 4.492 {अब एनएच-548}) एसएच -54 (किमी 5.300 से किमी 14.850) और अमरा मार्ग (0.000 किमी से किमी 4.492 तक 5.360 [एसएच -54 और अमरा मार्ग को हाल ही में एनएच -348ए के रूप में नया घोषित किया गया है] के 6/8 लेन में चौड़ीकरण हेतु यांत्रिक वाहनों पर सारणी 8585 GI/2022

1. नीचे उद्ग्रहीत एवं संग्रहीत शुल्क, निम्नलिखित शुल्क प्लाजा पर, ऐसे शुल्क प्लाजा (प्लाजाओं) के लिए विनिदिष्ट सड़क की निवल लम्बाई हेतु शोध्य और संदेय होगा अर्थात् :

3. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त हुआ हो और वह शुल्क प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता/ रहती हो, उसके लिए वर्ष 2022-23 के लिए मासिक पास की दर 315/-रुपए (तीन सौ पंद्रह रुपए मात्र) होगी और उक्त नियमों के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा।

5. जिस जिले में शुल्क प्लाजा स्थित है, उसमें पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के लिए वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सविस सड़क अथवा वैकल्पिक सड़क उपलब्ध न हो।
6. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक अथवा मालिक अथवा प्रभारी व्यक्ति को ऐसे अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संग्रहण एजेंसी को राष्ट्रीय राजमार्ग शुल्क नियमावली के नियम 10 के उप नियम 1ए में उल्लिखित शुल्क के बराबर शुल्क का भुगतान करना होगा और उसे राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए।
7. यांत्रिक वाहनों की श्रेणी, उनके लिए अनुज्ञेय भार, छू ट-प्राप्त वाहनों की श्रेणी, सविस सड़क, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं उक्त नियमों में विनिदिष्ट परिभाषाओं के अनुसार होंगी।
8. उक्त नियमों के नियम 12 के अनुसार उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरें प्रदशित की जाएंगी। 9. ऊपर सारणी-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंड की पूर्ण हुई लम्बाई के आधार पर की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वाषिक तौर पर संशोधन किया जाएगा तथा इसे तदनुसार अंग्रेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।
10. इस परियोजना की अनुमानित पू ंजीगत लागत 3668.294 करोड़ रुपए है। (पू ंजीगत लागत में परिवर्तन हो सकता है क्योंकि भूमि अर्जन, जन-उपयोगिता सेवाओं का स्थान बदलने, पेड़ों की कटाई आदि जैसे क्रियाकलाप अभी पूरे किए जाने5 [भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण शेष हैं और अंतिम पू ंजीगत लागत को अलग से अधिसूचित किया जाएगा)। प्राधिकरण द्वारा प्रयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पू ंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पू ंजीगत लागत की वसूली हो जाने के पश्चात, लगाए जाने वाले शुल्क की दरों को घटाकर 40% कर दिया जाएगा और उक्त नियमों के अनुसार इस में वाषिक तौर पर संशोधन किया जाएगा।

S.O. 6012(E).—Whereas, by notification of the Government of India in the Ministry of Road Transport and Highways[ number S.O 721 (E) dated 27 July 2000] issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), for entrustment to NHAI, the Central Government has entrusted the section of National Highway from (A1-E section from Km. 3.600 to Km. 27.270, D-G section from Km. 0.000 to km. 4.492 {Now NH- 548}) SH-54 (from Km. 5.300 to Km. 14.850) and Amra Marg (from Km. 0.000 to Km. 6.200) of National Highway No. 4B {New NH-348} in the state of Maharashtra to the National Highways Authority of India (hereinafter referred to as the "Authority");
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length of 34.800 km and for equivalent structure length (having length more than 60m) of 91.120 km (having length of 9.112 km) of Widening of existing NH-4B {New NH- 348} (A1-E section from Km. 3.600 to Km. 27.270, D-G section from Km. 0.000 to km. 4.492 {Now NH-548}) SH- 54 (from Km. 5.300 to Km. 14.850) and Amra Marg (from Km. 0.000 to Km.5.360) [SH-54 and Amra Marg are newly declared as NH-348 A] to 6/8 lanes on boundaries of proposed Navi Mumbai International Airport in the state of Maharashtra and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:—

3. The rate of monthly pass for person who owns a mechanical vehicle registered for non-commercial purposes and resides with is a distance of twenty kilometers from the fee plaza is Rs. 315 (Rupees Three Hundred and Fifteen Only) for the year 2022-23 is subject to revision every year as per the provisions of the said rules.
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely.

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.
8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
9. Based on the base rate of fee per kilometre for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.
10. The estimated capital cost of the project is Rs. 3668.294 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
