सं. 690] नई दिल्ली, बृहस्पतिवार, दिसम्बर 22, 2022/पौष 1, 1944 No. 690] NEW DELHI, THURSDAY, DECEMBER 22, 2022/PAUSHA 1, 1944 नई दिल्ली, 7 दिसम्बर, 2022 .—केन्द्रीय विद्युत विनियामक आयोग, अंतरणीय और विक्रय योग्य ऊर्जा बचत प्रमाणपत्रों के विनिमय के लिए ऊर्जा में बाजार के विकास हेतु दिनांक 30 मार्च, 2012 के जी.एस.आर 269(इ) द्वारा विद्युत मंत्रालय, भारत सरकार द्वारा अधिसूचित ऊर्जा संरक्षण (अभिहित उपभोक्ताओं के लिए ऊर्जा खपत सन्नियम और मानक, प्ररूप, समय, जिसके भीतर तैयार करने की रीति और कार्यान्वयन करना, ऊर्जा बचत प्रमाण पत्र जारी करने की प्रक्रिया और खपत की गई ऊर्जा के समतुल्य प्रति मीटरी टन तेल का मूल्य) नियम, 2012 के नियम 12 के उप-नियम (4) और नियम 13 के खंड (ख), राष्ट्रीय विद्युत नीति के पैरा 5.9, विद्युत अधिनियम, 2003 (2003 का 36) की धारा 66 के साथ पठित धारा 178 की उप-धारा (2) के खंड (म) और उप-धारा (1) के अधीन प्रदा शक्तियों और इस निमिा अन्य सभी समथ्र्यकारी शक्तियों का प्रयोग करते हुए, केन्द्रीय विद्युत विनियामक आयोग (ऊर्जा बचत प्रमाण पत्रों में व्यवहार के लिए निबंधन और शर्तें) विनियम, 2016 (इसके बाद "मूल विनियम" के रूप में संदर्भित) को संशोधित करने के लिए निम्नलिखित विनियम बनाता है, अर्थात्- (1) इन विनियमों का संक्षिप्त नाम केन्द्रीय विद्युत विनियामक आयोग (ऊर्जा बचत प्रमाण पत्रों में व्यवहार के लिए निबंधन और शर्तें) विनियम, 2022 है।
(2) ये विनियम शासकीय राजपत्र में उनके प्रकाशन की तारीख से प्रवृा होंगे। मूल विनियम के विनियम 2 के खंड (1) के अधीन उपबंध में फ्लोर कीमत को परिभाषित करने वाला उप-खंड (द) निम्नानुसार शामिल होगाः "(द) से वह न्यूनतम कीमत अभिप्रेत है जिस पर ऊर्जा बचत प्रमाणपत्र पावर एक्सचेंजों में व्यापारित होंगे।" 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] "(3) ऊर्जा संरक्षण नियमों में यथोल्लिखित ऊर्जा बचत प्रमाणपत्रों के व्यापार के लिए फ्लोर कीमत का निर्धारण प्रत्येक प्रदर्शन, प्राप्ति और व्यापार चक्र के लिए शासकीय राजपत्र में अधिसूचना के माध्यम से केन्द्र सरकार द्वारा यथाधिसूचित खपत की गई ऊर्जा के समतुल्य तेल के एक मीट्रिक टन की कीमत के 10 प्रतिशत पर किया जाएगा।" हरप्रीत सिंह प्रुथी, सचिव

2016 को भारत के राजपत्र (असाधारण) सं. 237 के भाग-III, खंड 4 में किया गया था।

AMENDMENT
New Delhi, the 7th December, 2022
No. L-1/97/2016- In exercise of powers conferred under sub-section (1) and clause (y) of sub-section (2) of section 178 read with Section 66 of the Electricity Act, 2003 (36 of 2003), paragraph 5.9 of the National Electricity Policy, sub-Rule (4) of Rule 12 and clause (b) of Rule 13 of the Energy Conservation (Energy Consumption Norms and Standards for Designated Consumers, Form, Time within which, and Manner of Preparation and Implementation of Scheme, Procedure for Issue of Energy Savings Certificate and Value of Per Metric Ton of Oil Equivalent of Energy Consumed) Rules, 2012 notified by the Ministry of Power, Government of India vide G.S.R. 269 (E) dated 30th March 2012, for the development of market in energy for exchange of transferable and saleable Energy Savings Certificates and all other powers enabling it in this behalf, the Central Electricity Regulatory Commission hereby makes the following regulations to amend the Central Electricity Regulatory Commission (Terms and Conditions for Dealing in Energy Savings Certificates) Regulations, 2016 (hereinafter referred to as "the Principal Regulations"), namely:
1. Short title and commencement
(1) These regulations may be called the Central Electricity Regulatory Commission (Terms and Conditions for Dealing in Energy Savings Certificates) (First Amendment) Regulations, 2022.
(2) These regulations shall come into force with effect from the date of their publication in the Official Gazette.
2. Insertion of sub-clause (r) under clause (1) of Regulation 2 of the Principal Regulations:
The provision under clause (1) of Regulation 2 of the Principal Regulations shall include a sub-clause (r) defining the floor price as under:
"(r) "Floor Price" means the minimum price at which the Energy Savings Certificate shall be traded on the power exchanges."
3. Insertion of clause (3) under Regulation 11 of the Principal Regulations:
Clause (3) shall be added after clause (2) of Regulation 11 of the Principal Regulations as under:
" (3) The floor price for the trading of Energy Savings Certificates as mentioned in the Energy Conservation Rules shall be fixed at ten percent of the price of one metric tonne of oil equivalent of energy consumed as may be notified by the Central Government, by notification in the Official Gazette for every Perform, Achieve and Trade Cycle."
