सा.का.नि. 900(अ).—के न्द्रीय सरकार, पर्यावरण (संरक्षण) अधिनियम, 1986 (1986 का 29) की धारा 6,8 और 25 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त नियमों के नियम 5 के उप-नियम (3) के खंड (क) के अधीन नोटिस की अपेक्षा को समाप्त करते हुए जन-हित में परिसंकटमय और अन्य अपशिष्ट (प्रबंधन और सीमापारीय संचलन) नियम, 2016 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. (1) संक्षिप्त नाम और प्रारंभ (1) इन नियमों का संक्षिप्त नाम परिसंकटमय और अन्य अपशिष्ट (प्रबंधन और सीमापारीय संचलन) द्वितीय संशोधन नियम, 2022 है।
(2) ये राजपत्र में अपने प्रकाशन की तारीख को प्रवृत्त होंगे।
2. परिसंकटमय और अन्य अपशिष्ट (प्रबंधन और सीमापारीय संचलन) नियम, 2016 के अनुसूची III में, भाग ख में,- (क) बेसल सं. ख 1110 के संदर्भ में, स्तंभ (2) में, प्रविष्टियों के पश्चात, निम्नलिखित अंत:स्थापित किया जाएगा, अर्थात्:-
''पुन: उपयोग के लिए प्रयुक्त गंभीर देखभाल के लिए बने चिकित्सा उपकरण के अलावा हाई एंड और उच्च मूल्य प्रयुक्त चिकित्सा उपकरण (अनुसूची VI, ख 1110 में संबंधित प्रविष्टि पर ध्यान दें)**'';
(ख) टिप्पण से पूर्व, निम्नलिखित अंत:स्थापित किया जाएगा, अर्थात् :-
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] हाई एंड और उच्च मूल्य वाले चिकित्सा उपकरण ऐसे चिकित्सा उपकरण हैं जो समय-समय पर स्वास्थ्य और परिवार कल्याण मंत्रालय द्वारा निदिष्ट किए जाते हैं।''[फा. सं. 23/104/2022-एचएसएम]

NOTIFICATION
New Delhi, the 23rd December, 2022
G.S.R.900(E).—In exercise of powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government, after having dispensed with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rule in public interest, hereby makes the following rules further to amend the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, namely: -
1. Short title and commencement. - (1) These rules may be called Hazardous and Other Wastes (Management and Transboundary Movement) Second Amendment Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, in Schedule III, in Part B, -
(a) against Basel No. B1110, in column (2), after the entries, the following shall be inserted, namely: - "High End and High Value Used Medical Equipment other than Used Critical Care Medical Equipment for re- use (note the related entry in Schedule VI, B1110) **";
(b) Before Note, the following shall be inserted, namely: -
„„** Import permitted in the country by actual user or by Original Equipment Manufacturers (OEM) or Indian Subsidiary of OEM or Trader on behalf of actual user;
High End and High Value Medical Equipment is such medical equipment as specified by the Ministry of Health and Family Welfare from time to time.".
