संख्याः -CPM/RVNL/PATNA/3rd Line/SEB-PTRU/Work Correspondence.—केंद्रीय सरकार, रेलवे अधिनियम, 1989 (रेलवे संषोधित अधिनियम, 2008) (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 20 क की उपधारा (1) के अधीन भारत के राजपत्र, असाधरण, भाग III खंड में प्रकाषित रेल विकास निगम लिमिटेड की अधिसूचना संख्या 2022-CPM/RVNL/PATNA/3rdLINE/SEB-PTRU/Work Correspondence की अधिसूचना नई दिल्ली तारीख 14 अगस्त 2022 (जिसे इसमें इसके पश्चात उक्त अधिसूचना कहा गया है।) से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि को बिहार राज्य के जिला औरंगाबाद तीसरी रेलवे लाइन के निर्माण के विषेष रेल परियोजना के निष्पादन, रख रखाव, प्रबंधन और प्रचालन के लिए लोक प्रयोजन के लिए अर्जित करने के अपने आषय की घोषणा की थी।
उक्त अधिसूचना का सारांष उक्त अधिनियम धारा 20 क की उपधारा (4) के अधीन दैनिक समाचार पत्र प्रभात खबर में तारीख 25 अगस्त 2022 और हिन्दुस्तान टाइम्स 25 अगस्त 2022 में प्रकाषित किया गया था। और, षून्य आपेक्ष प्राप्त हुए और सक्षम प्राधिकारी द्वारा उन पर विचार किया गया तथा अननुज्ञात किया गया और तदानुसार आदेष पारित किया गया।
उक्त अधिनियम की धारा 20 (ड़) की उपधारा (1) के अनुसरन, में सक्षम प्राधिकारी ने अपनी रिपोर्ट केंद्रीय सरकार को प्रस्तुत कर दी है।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] अतः अब केंद्रीय सरकार, सक्षम प्राधिकारी से उक्त रिपोर्ट के प्राप्त होने पर और उक्त अधिनियम की धारा 20 (ड़) की उप धारा (1) द्वारा प्रदत षक्तियो का प्रयोग करते हुए, यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जाएगी।
और यह की केंद्रीय सरकार, उक्त अधिनियम की धारा 20 (ड़) की उप-धारा (2) के अनुसरण में यह घोषणा करती है कि राजपत्र में इस अधिसूचना के प्रकाषित होने पर इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि अनन्य रूप से सभी विलंगमो से मुक्त होकर केंद्रीय सरकार में निहित हो जाएगी।
बिहार राज्य में विशेष रेलवे परियोजना सोन नगर से गढ़वा रोड के बिच तीसरे रेलवे लाइन निर्माण के लिए औरंगाबाद जिले में आने वाली संरचना सहित या उसके बिना भूमिका संक्षिप्त विवरण।

NOTIFICATION
New Delhi, the 16th December, 2022
No: 2022-CPM/RVNL/PATNA/3rd Line/SEB-PTRU/Work Correspondence.—Whereas by the notification of the Rail Vikas Nigam Limited Notification No. 2022 CPM/RVNL/Patna/3rd line/SEB-PTRU/Work correspondence New Delhi Dated 14 August 2022 published in gazette of India, Extra Ordinary, PART III- Section 4 (hereafter referred to as the said notification) under sub-section (1) of section 20 (A) of the Railway Act,1989 (Railway Amendment Act 2008) (hereinafter referred to as the said Act), the Central Government, declared its 3 [भाग III—खण्ड 4] भारत का राजपत्र : असाधारण
intension to acquire the land specified in the schedule annexed to the said notification for execution, maintenance, management and operation of special Railway project construction of Third Railway Line in the District of Aurangabad in the State of Bihar.
And, whereas, the substance of the said notification was published in daily newspaper Prabhat Khabar Dated 25 August 2022 and Hindustan Times 25 August 2022 under sub-section (4) of section 20 A of the said Act. And, whereas, zero nos. of objections were received and the same have been considered/disallowed by the competent authority accordingly orders have been passed.
And, whereas in pursuance of sub-section (1) of section 20 (E) of the said Act, the competent authority has submitted its report to the Central Government.
Now, therefore, upon receipt of the said report of the competent authority, and in exercise of the powers conferred by sub-section (1) of section 20 (E) of the Railway Act, the Central Government hereby declares that the lands specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose.
And, further, in pursuance of sub-section (2) of section 20(E) of the said Act, the Central Government hereby declares that on publication of this notification in the official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
