सं. 5829] नई दिल्ली, मंगलवार, दिसम्बर 27, 2022/पौष 6, 1944 No. 5829] NEW DELHI, TUESDAY, DECEMBER 27, 2022/PAUSHA 6, 1944 नई दिल्ली, 27 दिसम्बर, 2022 ( ).—समय-समय पर यथासंशोधित विदेश व्यापार नीति, 2015-2020 के पैरा 1.02 अर 2.01 के साथ पठित विदेश व्यापार (विकास एवं विनियमन) अधिनियम, 1992 की धारा 5 के साथ पठित धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्द्वारा आईटीसी (एचएस), 2018, की अनुसूची-2 (निर्यात नीति) के अध्याय-44 के अंतर्गत रेड सैन्डर्स (टेरोकार्पस सैंटुलाइनस) की नीतिगत शर्त में संशोधन करती है।
2. निर्यात और आयात मदों के आईटीसी (एचएस) वर्गीकरण की अनुसूची-2 के अध्याय 44 में क्रम सं. 188 और 188क के सामने मौजूदा प्रविष्टियों को निम्नानुसार प्रतिस्थापित किया जाएगाः

| 188 | 4403 99 18 4407 99 90 | कि० ग ्रा० | क्रम सं. 188क [निजी भूमि (पट्टा भूमि सहित) से प्राप्त —षि मूल के] और क्रम सं. 189 [वैध स्रोतों से प्राप्त रेड सैन्डर्स वुड क े विनिर्दिष्ट मूल्य वर्धित उत्पाद और रेड सैन्डर्स वुड से बने अन्य हस्तशिल्प] को छोड़कर) किसी भी रुप में रेड सैन्डर्स वुड (आरएसडब्ल्यू), चाहे वे कच्चे, संसाधित या ग ैर-संसाधित हों। | निषिद्ध | निर्यात किए जाने की अनुमति नहीं है। तथापि, बीएसआई नडीएफ रिपोर्ट पर्यावरण, वन एवं जलवायु परिवर्तन मंत्रालय की सिफारि ाों के अनुसार रेड सैन्डर्स (टेरोकार्पस हेतु सैंटुलाइनस) निम्नलिखित वार्षिक निर्यात कोटा अनुमत है क. कृत्रिम रूप से उत्पन्न किए गए रेड सैन्डर्स ह ेतु आन्ध्र प्रदेश के लिए 280 मी.ट. का एक वार्षिक निर्यात कोटा (अप्रैल से मार्च)ः और ख. रेड सैन्डर्स के वन्य नमूने हेतु शून्य निर्यात कोटाः i. राज्य सरकार भू संदर्भित साइटों और एमआईएस के साथ एक डिजिटल प्लेटफॉर्म विकसित करेगी जिसमें पेड़ों की संख्या, उनकी आयु और तने तक की ऊंचाई पर उनक व्यास दिया जाएगा। ii. राज्यों के कार्य योजना दिशानिर्देशों में वन्य और गैर वन्य क्षेत्रों में वृक्षारोपण से रेड सैंडर्स वुड की दीर्घकालिक फसल हेतु अनुमोदित आवर्तन अवधि के साथ विशिष्ट प्रबंधन योजना/फसल योजना शामिल करने की आवश्यकता है। | भारतीय सीआईटीईएस प्रबंधन प्राधिकरण (सीआईटीईएसएमए) भी राज्यों, डीआरआई और सीमा शुल्क द्वारा उठाई गई मांगों के अनुसार चरणबद्ध तरीके से जब्त/कब्जा में लिए गए रेड सैंडर्स के निर्यात की निर्यात के समय सीआईटीईएस की पूर्ति और केवल राज्यों, डीआरआई और सीमा शुल्क द्वारा एमओईएफएंडसीसी को रिपोर्ट की गई अधिकतम मात्रा तक, जैसा कि अनुलग्नक-I (कुल कोटा 13,301.69822 मी.टन) में उल्लिखित है के अधीन अनुमति देगा। तथापि, आन्ध्र प्रदेश सरकार, राजस्व आसूचना निदेशालय (डीआरआई), तमिलनाडु सरकार, महाराष्ट्र और कर्नाटक सरकार को स्वयं अथवा इनके द्वारा इसके लिए प्राधि—त किसी फर्म/फर्मों द्वारा जब्त किए गए/कब्जा में लिए गए भंडार में से क्रमशः 8498. 095 मीट्रिक टन, 1200 मीट्रिक टन, 299.732 मीट्रिक टन, 83.40 मीट्रिक टन तथा 186.588 मीट्रिक टन रेड सैन्डर्स वुड (लट्ठे रुप में) के निर्यात के लिए एककालिक छूट प्रदत्त पूर्व में डीजीएफटी द्वारा जारी की गई अधिसूचना के अनुसार जारी रहेगी। |

| 188क | 4403 99 18 | कि. ग ्रा. | अनन्य रुप से निजी भूमि (पट्टा भूमि सहित) से प्राप्त —षि मूल के लट्ठा रुप में और जड़ रुप मे ं रेड सैन्डर्स वूड | प्रतिबंधित | निम्नलिखित शर्तों/प्रलेखन के अध्यधीन लाइसेन्स के तहत निर्यात की अनुमतिः (i) निर्यात लाइसेन्स के लिए आवेदन पत्रों के साथ उस राज्य के प्रधान मुख्य वन संरक्षक (पीसीसीएफ) द्वारा जारी उद्गम प्रमाण की अभिप्रमाणित प्रतियां संलग्न की जानी चाहिए जहां से स्टॉक खरीदा/निर्यात किया गया जिसमे ं वैध स्रोतों से खरीद की तारीख और खरीदी गई मात्रा का विवरण हो; (ii) इस तरह खरीदे गए और आवेदक के पास उपलब्ध स्टॉक की वर्तमान स्थिति के बारे में इस प्रयोजन के लिए पीसीसीएफ द्वारा नामित प्राधिकारी द्वारा स्टॉक के वास्तविक सत्यापन के बाद दिया गया प्रमाण पत्र भी निर्यात लाइसेंस के लिए आवेदन के साथ होना चाहिए। ( iii) निर्यात लाइसेन्स जारी करने के लिए आवेदन पर ग ुणावगुण के आधार पर विचार किया जाएगा जो अन्य किन्ही शर्तों जैसे एमईपी, साइट्स के अंतर्गत मात्रात्मक सीमा की शर्त आदि जैसाकि समय-समय पर निर्धारित किया जाए, के अध्यधीन होंगे; | निम्नलिखित शर्तों/प्रलेखन के अध्यधीन लाइसेन्स के तहत निर्यात की अनुमतिः (i) निर्यात लाइसेन्स के लिए आवेदन पत्रों के साथ उस राज्य के प्रधान मुख्य वन संरक्षक (पीसीसीएफ) द्वारा जारी उद्गम प्रमाण की अभिप्रमाणित प्रतियां संलग्न की जानी चाहिए जहां से स्टॉक खरीदा/निर्यात किया गया जिसमें वैध स्रोतों से खरीद की तारीख और खरीदी गई मात्रा का विवरण हो; (ii) इस तरह खरीदे गए और आवेदक के पास उपलब्ध स्टॉक की वर्तमान स्थिति के बारे में इस प्रयोजन के लिए पीसीसीएफ द्वारा नामित प्राधिकारी द्वारा स्टॉक के वास्तविक सत्यापन के बाद दिया गया प्रमाण पत्र भी निर्यात लाइसेंस के लिए आवेदन के साथ होना चाहिए। (iii) निर्यात लाइसेन्स जारी करने के लिए आवेदन पर गुणावगुण के आधार पर विचार किया जाएगा जो अन्य किन्ही शर्तों जैसे एमईपी, साइट्स के अंतर्गत मात्रात्मक सीमा की शर्त आदि जैसाकि समय-समय पर निर्धारित किया जाए, के अध्यधीन होंगे; (iv) भारतीय साइट्स प्रबंधन प्राधिकरण की सिफारि ा के अनुसार पर्यावरण, वन एवं जलवायु परिवर्तन मंत्रालय एक वार्षिक कोटा निर्धारित |

Subject: Amendment in Export Policy of Red Sanders wood exclusively sourced from cultivation
origin obtained from private land (including Pattaland) and Confiscated source—regarding
S.O. 6072(E).—In exercise of powers conferred by Section 3 read with section 5 of Foreign Trade (Development & Regulation) Act,1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2015-2020, as amended from time to time, the Central Government hereby amends the policy condition of Red Sanders (Pterocarpussantulinus) under Chapter 44 of ITC (HS), 2018, Schedule — 2 (Export Policy).
2. The existing entries against SI. No. 188 and 188A in Chapter 44 of Schedule 2 of ITC (HS) Classification of Export & Import Items shall be substituted as follows:
