आदेश
नई दिल्ली, 29 दिसम्बर, 2022
का.आ. 6143(अ).—भारतीय मानक ब्यूरो अधिनियम, 2016 (2016 का 11) (जिसे इसके बाद उक्त अधिनियम कहा गया है), की धारा 17 के साथ पठित धारा 16 की उप-धारा (1) और (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्द्र सरकार, यह मत होने के कारण कि यह जनहित में आवश्यक या वांक्षनीय है, भारतीय मानक ब्यूरो के परामर्श से, एततद्वारा निम्नलिखित आदेश देती है, नामत्:-
1. लघु शीर्षक और प्रारंभ तथा आवेदन - (1) इस आदेश को विस्कोस स्टेपल फाइबर (गुणवत्ता नियंत्रण) आदेश, 2022 कहा जाएगा।
(2) उक्त अधिनियम सरकारी राजपत्र में इसके प्रकाशन की तारीख से 30 दिन के बाद लागू होगा।
(3) यह नीचे दी गई तालिका के कॉलम (1) में निदिष्ट वस्तुओं या मदों पर लागू होगा, लेकिन निर्यात के लिए ऐसी वस्तुओं या मदों, जो विदेशी क्रे ता द्वारा आवश्यक विनिर्देश के अनुरूप है, पर लागू नहीं होगा।
2. मानकों की समरुपता और मानक चिन्ह का अनिवार्य प्रयोग - नीचे दी गई तालिका के कॉलम (1) में विनिदिष्ट वस्तुएं या मदें उक्त तालिका के कॉलम (2) में दिए गए तदनुरुपी भारतीय मानक के अनुरुप होगा और भारतीय मानक ब्यूरो (अनुरूपता मूल्यांकन) विनियम, 2018 की अनुसूची-II की योजना-I के अनुसार भारतीय मानक ब्यूरो से लाइसेंस के अंतर्गत मानक चिन्ह धारित करेगा। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3. समरूपता मूल्यांकन, प्रमाणन और प्रवर्तन प्राधिकरी - भारतीय मानक ब्यूरो, तालिका के कॉलम (1) में विनिदिष्ट वस्तुओं या मदों के संबंध में, प्रमाणन और प्रवर्तन प्राधिकारी होगा। इसके अलावा, वस्त्र समिति, वस्त्र मंत्रालय, भारत सरकार का एक अधिकारी, जो सहायक निदेशक के स्तर से कम न हो, भी प्रवर्तन प्राधिकारी होगा। 4. उल्लंघन के लिए दंड - इस आदेश के उपबंधों का उल्लंघन करने वाले व्यक्ति को, उक्त अधिनियम के उपबंधों अंतर्गत दंडित किया जाएगा।

नोट : इस तालिका के प्रयोजनों के लिए, इस संबंध में जारी किए गए संशोधनों सहित भारतीय मानकों का नवीनतम संस्करण, जैसा कि समय-समय पर ब्यूरो द्वारा अधिसूचित किया जाए, इस अधिसूचना की तारीख से लागू होगा।

ORDER
New Delhi, the 29th December, 2022
S.O. 6143(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 16 read with section 17 of the Bureau of Indian Standards Act, 2016 (11 of 2016), (hereinafter referred to as the said Act), the Central Government, after consultation with the Bureau of Indian Standards, being of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following order, namely:-
1. Short title and commencement and application. – (1) This order may be called the Viscose Staple Fibres (Quality Control) Order, 2022.
(2) It shall come into force after thirty days from the date of its publication in the Official Gazette.
(3) It shall apply to goods or articles specified in column (1) of the Table below, but shall not apply to such goods or articles meant for export, which conform to the specification required by the Foreign Buyer.
2. Conformity to standards and compulsory use of Standard Mark. - Goods or articles specified in column (1) of the Table below shall conform to the corresponding Indian Standard given in column (2) of the said Table and shall bear the Standard Mark under a licence from the Bureau of Indian Standards as per Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.
3. Conformity Assessment, Certification and enforcement authority. - The Bureau of Indian Standards shall be the certifying and enforcing authority in respect of the goods or articles specified in column (1) of the Table. In addition, an officer not below the rank of Assistant Director, Textiles Committee, Ministry of Textiles, Government of India shall also be the enforcing authority.
4. Penalty for contravention. - Any person who contravenes the provisions of this order shall be punishable under the provisions of the said Act.

Note : For the purposes of this table, the latest version of Indian Standards including the amendments issued thereof, as may be notified by the Bureau from time to time, shall apply from the date of such notification.
