का.आ. 14(अ).— केन्द्रीय सरकार ने पेट्रोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का अर्जन) अधिनियम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 3 की उप-धारा (1) के अधीन जारी की गई भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसुचना संख्या का.आ. 4725 (इ) तारीख 30 सितंबर 2022 व्दारा उस अधिसुचना से संलग्न अनुसुची में विनिर्दिष्ट भूमि में, मेसर्स रिलायन्स इण्डस्ट्रीज लिमिटेड के आन्ध्रप्रदेश में संरचनाओं से महाराष्ट्र राज्य में, रायगड जिले कें विभिन्न उपभोक्ताओं तक प्राकृतिक गैस के परिवहन के लिए मेसर्स रिलायन्स गैस ट्रान्सपोर्टेशन इन्फ्रास्ट्रक्चर लिमीटेड अभी की पाईपलाईन इन्फ्रास्ट्रक्चर लिमीटेड नाम से ज्ञात द्वारा एक पाइपलाइन बिछाई गई थी;

और उक्त राजपत्र की प्रतियॉं जनता को तारीख 06 अक्तुबर 2022 को उपलब्ध करा दी गई थी;

और पाईपलाईन बिछाने के संबध में जनता की ओर से प्राप्त आक्षेंपों पर सक्षम प्राधिकारी व्दारा विचार कर लिया गया है और अननुज्जात कर दिया गया;

और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है;

और केन्द्रीय सरकार ने, उक्त रिपोर्ट पर विचार करने के पश्चात, और यह समाधान हो जाने पर कि उक्त भूमि पाईपलाईन बिछाई है, उसमें उपयोग के अधिकार का अर्जन का विनीश्चय किया है;

अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि इस अधिसुचना से संलग्न अनुसुची में विनिर्दिष्ट भूमि में पाइपलाइन बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है;

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और केन्द्रीय सरकार उक्त अधिनियम की धारा 6 की उपधारा 4 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार उस घोषणा के प्रकाशन की तारीख से केन्द्रीय सरकार में निहीत होने के बजाए, सभी विल्लंगमों से मुक्त, मेसर्स रिलायन्स इण्डस्ट्रीज लिमिटेड अभी की पाईपलाईन इन्फ्रास्ट्रक्चर लिमीटेड में निहीत होगा।

NOTIFICATION

New Delhi the 28th December, 2022

S.O. 14(E).—Whereas by notification of the Government of India in the Ministry of Petroleum and Natural Gas, number S.O. 4725 (E) dated the 30th September 2022, issued under sub-section (1) of section (3) of the Petroleum & Minerals Pipelines (Acquisition of Right of User in Land) Act,1962 (50 of 1962) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the right of user in the land, specified in the Schedule appended to that notification where a pipeline was laid for transportation of natural gas from the sources in the State of Andhra Pradesh of M/s Reliance Industries Limited, to various consumers in the country by M/s Reliance Gas Transportation Infrastructure Limited, now known as Pipeline Infrastructure Limited.

And whereas, the copies of the said Gazette notification were made available to the public on the 6th October 2022;

And whereas objections received from the public for acquisition of right of user for the said pipeline had been considered and disposed by the Competent Authority:

And whereas the Competent Authority has under sub-section (1) of section (6) of the said Act, submitted report to the Central Government for acquisition of Right of User in lands appended to the Schedule;

And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for the pipeline laid, has decided to acquire the right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule, appended to this notification, are hereby acquired;

And, further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land shall instead of vesting in the Government of India, vest, on the date of the publication of the declaration, in M/s Reliance Gas Transportation Infrastructure Limited, now known as Pipeline Infrastructure Limited, free from encumbrances.
