यह अधिसूचना दिनांक 22-11-2022 को प्रकाशित अधिसूचना संख्या का.आ. 5405(अ) का अधिक्रमण करती है का.आ. 12(अ).—कें द्रीय सरकार, रेल अधिनियम, 1989 (1989 का 24) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 20क के उपखंड (I) के अधीन भारत के राजपत्र, असाधारण भाग II, खण्ड 3, उप-खण्ड (ii) में प्रकाशित भारत सरकार के रेल मंत्रालय (पश्चिम रेलवे निर्माण संगठन) की अधिसूचना का. आ. 3886 (अ) दिनांक 18.08.2022 में प्रकाशित भारत सरकार के रेल मंत्रालय (पश्चिम रेलवे निर्माण संगठन) की अधिसूचना में विनिर्दिष्ट भूमि को मध्य प्रदेश राज्य के खरगोन जिले में रतलाम- इंदौर- डा. अम्बेडकर नगर- खंडवा आमान परिवर्तन परियोजना नाम की विशेष रेल परियोजना के निष्पादन के लिये आवश्यक है, ऐसी भूमि के अर्जन करने के आशय की घोषणा की गई थी । और उक्त अधिनियम की धारा 20 (क) की उप-धारा (4) के तहत, उक्त अधिसूचना का सार स्थानीय समाचार पत्रों हिन्दी भाषा, दैनिक भास्कर, खण्डवा में बलवाड़ा, पड़ालीखुर्द गांवों के लिए दिनांक 20-08-2022 को, खोड़ी, सिरलाय, बड़वाह गांवों के लिए दिनांक 21-08-2022 को और बलवाड़ा, खोड़ी गांवों के लिए संशोधन दिनांक 11-09-2022 को, नई दुनिया इन्दौर में कु रावद, लालपुरा गांवों के लिए दिनांक 20-08-2022 को, लोहारपुरा गांव के 21 GI/2023
(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] लिए दिनांक 21-08-2022 को, पत्रिका खण्डवा में झिगड़ी गांव के लिए दिनांक 20-08-2022 को, मनिहार गांव के लिए दिनांक 21-08-2022 को प्रकाशित किया गया था तथा उक्त अधिनियम की धारा 20 (क) की उप-धारा (4) के तहत, उक्त अधिसूचना का सार, अंग्रेजी समाचार पत्र, टाईम्स ऑफ इंडिया में प्रकाशित अधिसूचना (बलवाड़ा, कु रावद, झिगड़ी, लालपुरा, पड़ालीखुर्द) गांवों के लिए दिनांक 20-08-2022 को, (मनिहार, खोड़ी, लोहारपुरा, सिरलाय, बड़वाह) गांवों के लिए दिनांक 21-08-2022 को, सिरलाय, बड़वाह गांवों के लिए संशोधन, दिनांक 11-09-2022 प्रकाशित किया गया था और सक्षम प्राधिकारी को किसी भी व्यक्ति का कोई आक्षेप प्राप्त नहीं हुआ है और, सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 20 (ड.) की उप-धारा (1) के अनुसरण में अपनी रिपोर्ट कें द्र सरकार को सौंप दी है ।
अतः अब, कें द्रीय सरकार सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त होने पर और रेल अधिनियम 1989 की धारा 20(ड.) की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित कि जाएगी।
और यह कि, के न्द्रीय सरकार उक्त अधिनियम की धारा 20(ड.) की उपधारा (2) के अनुसरण में यह और घोषणा करती है कि, इस अधिसूचना के राजपत्र में प्रकाशित होने पर इससे उपाबध्द अनुसूची में विनिर्दिष्ट भूमि सभी विल्लन्गमो से मुक्त होकर के न्द्रीय सरकार में आत्यन्तिक रुप से निहित हो जाएगी ।

CORRIGENDUM NOTIFICATION
Mumbai, the 3rd January, 2023
This notification supersedes the Notification S.O. 5405(E), published on 22/11/2022
S.O. 12(E).—Whereas by the notification of the Government of India in the Ministry of Railways (Railway Board) (Published in the Gazette of India, Extra Ordinary part II Section-3 Sub-section (II)) (here in after referred to as the said notification) under subsection(I) of section 20A of the Railway Act 1989 (24 of 1989) (hereinafter referred to as the said Act) the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification 3886-E Dated 18-08-2022 for execution, maintenance, management and operation of the Special Railway Project, namely Ratlam – Indore - Dr. Ambedkar Nagar - Khandwa Gauge Conversion Project in the State of Madhya Pradesh.
And whereas under sub-section (4) of section 20(A) of the said Act, notification was published in the local newspapers in Hindi language, Dainik Bhaskar, Khandwa for villages Balwada, Padalikhurd on dated 20-08-2022, Khodi, Sirlai, Barwaha villages on 21-08-2022 and Amendment on 11-09-2022 for Balwada, Khodi villages, on 20- 08-2022 for Kurawad, Lalpura villages, on 21-08-2022 for Loharpura village in Nai Duniya Indore, in Hindi newspaper, Patrika, Khandwa, on 20-08-2022 for Jhigri village, on 21-08-2022 for Manihar village and section 20(A) of the said Act under sub-section (4), the abstract of the said notification, published in the English newspaper, The Times of India Indore, notification dated 20-08-2022 for the villages (Balwada, Kurawad, Jhigdi, Lalpura, Padalikhurd), (Manihar, Khodi, Loharpura, Sirlai, Barwaha) villages on 21-08-2022, for Sirlai, Barwah villages, the amendment was published on 11-09-2022 and whereas the competent authority has not been received any objection for any person and whereas, in pursuance of sub-section (1) of section 20(E) of the said Act, the Competent Authority has submitted its report to the Central Government .
Now, therefore, upon receipt of the said report of the competent authority, and in exercise of the powers conferred by sub-section (1) of section 20E of the said Act, the Central Government hereby declares that the land specified in the schedule annexed hereto shall be acquired for the aforesaid purpose;
And, further, in pursuance of sub-section (2) of section 20E of the said Act, the Central government here by declares that on publication of this notification in the official Gazette the land specified in the schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
The Land Plans and other details of the land covered under this notification are available and can be inspected by the interested person aforesaid Office of the Competent Authority.
