का.आ. 77(अ).—कें द्र सरकार ने, राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) (इसके बाद उक्त अधिनियम के रूप में संदभित) की धारा 3ए की उप-धारा (1) के तहत जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या एस.ओ. 4308(अ) दिनांक 14 सितंबर, 2022, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप खंड (ii) में प्रकाशित की गई थी, द्वारा आंध्र प्रदेश राज्य में एनटीआर जिले में "मौजूदा 2-लेन के 6-लेनिग (i) नंदीगामा बाईपास किमी. 220.700 से किमी. 226.600 (किमी. 220.700 से किमी. 227.480 तक डिजाइन चेनेज) और (ii) कांचीचेरला बाईपास किमी. 238.200 से किमी. 245.400 (किमी. 238.200 से किमी.
245.760 तक डिजाइन चेनेज एनएच-65 पर एनएचडीपी चरण- IV के तहत ईपीसी मोड पर" राष्ट्रीय राजमार्ग संख्या 65 के निर्माण (चौड़ीकरण/6-लेन आदि) के रखरखाव, प्रबंधन और संचालन के लिए उक्त अधिसूचना से जुड़ी अनुसूची में निदिष्ट भूमि का अधिग्रहण करने के इसके इरादे की घोषणा करती है;
और उक्त अधिसूचना का सार उक्त अधिनियम की धारा 3ए की उप-धारा (3) के तहत दिनांक 29-09-2022 को "टाइम्स ऑफ इंडिया" और "प्रजाशक्ति" दोनों में प्रकाशित किया गया है;
और जबकि सक्षम प्राधिकारी द्वारा किसी भी व्यक्ति से कोई आपत्ति प्राप्त नहीं हुई है;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और जबकि, उक्त अधिनियम की धारा 3डी की उप-धारा (1) के अनुसरण में, सक्षम प्राधिकारी ने अपनी रिपोर्ट कें द्र सरकार को प्रस्तुत कर दी है;
इसलिए, अब, सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त होने पर और उक्त अधिनियम की धारा 3डी की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार एतद्द्वारा घोषित करती है कि उक्त अनुसूची में निदिष्ट भूमि पूर्वोक्त उद्देश्य के लिए अधिग्रहित किया जाना चाहिए;
और आगे, उक्त अधिनियम की धारा 3डी की उप-धारा (2) के अनुसरण में, कें द्र सरकार एतदद्वारा घोषणा करती है कि आधिकारिक राजपत्र में इस अधिसूचना के प्रकाशन पर, उक्त अनुसूची में निदिष्ट भूमि, सभी बंधनों से मुक्त बिल्कु ल कें द्र सरकार में निहित होगी।

NOTIFICATION
New Delhi, the 5th January, 2023
S.O. 77(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways, number S.O.4308(E) dated 14th September, 2022 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intension to acquire the land specified in the Schedule annexed to the said notification for building (widening /6-laning etc.,) maintenance, management and operations of National Highway No. 65, in the stretch for "6-laning of existing 2-lane (i) Nandigama Bypass from Km. 220.700 to Km. 226.600 (Design Chainage from Km. 220.700 to Km. 227.480) and (ii) Kanchikacherla Bypasses from Km. 238.200 to Km. 245.400 (Design Chainage from Km. 238.200 to Km. 245.760) on NH-65 under NHDP Phase-IV on EPC Mode" in the District of NTR in the State of Andhra Pradesh;
And whereas the substance of the said notification has been published in "The Times of India" and "Prajashakti" both dated 29-09-2022 under sub-section (3) of section 3A of the said Act;
And whereas no objections have been received from any person by the Competent Authority;
And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the Competent Authority has submitted its report to the Central Government;
Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
