सा.का.नि. 16(अ).—कें द्रीय सरकार, पेट्रोलियम और प्राकृ तिक गैस विनियामक बोर्ड अधिनियम, 2006 (2006 का 19) की धारा 60 की उप-धारा (2) के खंड (क) के साथ पठित धारा 5 की उप-धारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पेट्रोलियम और प्राकृ तिक गैस विनियामक बोर्ड (अध्यक्ष और सदस्यों के वेतन, भत्ते और सेवा की अन्य शर्तें) नियम, 2006 में आगे संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
1. संक्षिप्त नाम- इन नियमों का संक्षिप्त नाम पेट्रोलियम और प्राकृ तिक गैस विनियामक बोर्ड (अध्यक्ष और सदस्यों के वेतन, भत्ते और सेवा की अन्य शर्तें) संशोधन नियम, 2022 है।
2. पेट्रोलियम और प्राकृ तिक गैस विनियामक बोर्ड (अध्यक्ष और सदस्यों के वेतन, भत्ते और सेवा की अन्य शर्तें) नियम, 2006 में, नियम 3 के स्थान पर निम्नलिखित नियम को रखा जाएगा, अर्थात् :-
"3. वेतन - (1) अध्यक्ष को तारीख 1 जुलाई, 2013 से सरकारी आवास और स्टाफ कार की सुविधा के बिना प्रति माह 4,50,000/- रुपए (चार लाख पचास हजार रुपए) के समेकित वेतन का भुगतान किया जाएगा:

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] परन्तु तारीख 1 जुलाई, 2013 को अथवा उसके बाद नियुक्त या सेवा करने वाले अध्यक्ष के समेकित वेतन का भुगतान वित्त मंत्रालय, व्यय विभाग के तारीख 31 अक्टूबर, 2013 के कार्यालय ज्ञापन संख्या 81/1/2008-आईसी और तारीख 10 जनवरी, 2018 के कार्यालय ज्ञापन संख्या 16-1/2017/ई.IIIए के अनुसार किया जाए।
(2) सदस्य को तारीख 1 जुलाई, 2013 से 31 दिसंबर, 2015 तक सरकारी आवास और स्टाफ कार की सुविधा के बिना प्रति माह 3,75,000/- रुपए (तीन लाख पचहत्तर हजार रुपए) के समेकित वेतन और तारीख 01 जनवरी, 2016 से सरकारी आवास और स्टाफ कार की सुविधा के बिना प्रति माह 4,00,000/- रुपए (रुपए चार लाख रुपए) के समेकित वेतन का भुगतान किया जाएगा ।
परन्तु तारीख 1 जुलाई, 2013 को अथवा उसके बाद और 31 दिसंबर, 2015 से पहले नियुक्त या सेवा करने वाले सदस्य के समेकित वेतन का भुगतान वित्त मंत्रालय, व्यय विभाग के तारीख 31 अक्टूबर, 2013 के कार्यालय ज्ञापन संख्या 81/1/2008-आईसी के अनुसार किया जाए।
परन्तु तारीख 01 जनवरी, 2016 को अथवा उसके बाद नियुक्त अथवा सेवा करने वाले सदस्य के समेकित वेतन का भुगतान वित्त मंत्रालय, व्यय विभाग के तारीख 10 जनवरी, 2018 के कार्यालय ज्ञापन संख्या 16-1/2017/ई.IIIए के अनुसार किया जाए।

नवनीत मोहन कोठारी, संयुक्त सचिव स्पष्टीकारक ज्ञापन: चू ंकि अध्यक्षों और सदस्यों की नियुक्ति व्यय विभाग, वित्त मंत्रालय द्वारा उनके तारीख 31 अक्तूबर, 2013 कार्यालय ज्ञापन संख्या 81/1/2008-आईसी और तारीख 10 जनवरी, 2018 के कार्यालय ज्ञापन संख्या 16-1/2017/ई.IIIए द्वारा अनुमोदित समेकित वेतन पैके ज पर की गई थी अत: ये संशोधन भूतलक्षी प्रभाव से लागू हैं। यह प्रमाणित किया जाता है कि इस संशोधन को भूतलक्षी प्रभाव से लागू करने से किसी व्यक्ति पर प्रतिकू ल प्रभाव नहीं पड़ रहा है।
टिप्पण: मूल नियम को तारीख 15 सितंबर, 2006 की अधिसूचना संख्या सा.का.नि. 570(अ) द्वारा भारत के राजपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में प्रकाशित किया था और अंतिम बार तारीख 24 मई, 2007 की अधिसूचना संख्या जी.एस.आर.405 (अ) द्वारा संशोधित किया गया था।

NOTIFICATION
New Delhi, the 6th January, 2023
G.S.R. 16(E).—In exercise of the powers conferred by sub-section (4) of section 5 read with clause (a) of sub-section (2) of section 60 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Central Government hereby makes the following rules further to amend the Petroleum and Natural Gas Regulatory Board (Salaries, Allowances and other Conditions of Service of Chairperson and Members) Rules, 2006, namely: - 1. Short title.- These rules may be called the Petroleum and Natural Gas Regulatory Board (Salaries, Allowances and Other Conditions of Services of Chairperson and Members) Amendment Rules, 2022.
2. In the Petroleum and Natural Gas Regulatory Board (Salaries, Allowances and Other Conditions of Service of Chairperson and Members) Rules, 2006, for rule 3, the following rule shall be substituted, namely:-
"3. Salary. - (1) The Chairperson shall be paid a consolidated salary of Rs. 4,50,000/- (Rupees Four Lakh Fifty Thousand) per month, without the facility of Government accommodation and staff car with effect from 1st day of July, 2013:

Provided that the consolidated salary of Chairperson appointed or serving on or after the 1st day of July, 2013, shall be paid in accordance with the Ministry of Finance, Department of Expenditure O.M. No. 81/1/2008-IC dated the 31st October, 2013 and O.M. No. 16-1/2017/E.IIIA dated the 10th January, 2018.
(2) The Member shall be paid a consolidated salary of Rs. 3,75,000/- (Rupees Three Lakh Seventy-five Thousand) per month, without the facility of Government accommodation and staff car, with effect from 1st day of July, 2013 to 31st December, 2015 and a consolidated salary of Rs. 4,00,000/- (Rupees Four Lakh) per month, without the facility of Government accommodation and staff car with effect from 1st day of January, 2016:
Provided that the consolidated salary of a Member appointed or serving on or after the 1 st day of July, 2013 and before the 31st December, 2015, shall be paid in accordance with the Ministry of Finance, Department of Expenditure O.M. No. 81/1/2008-IC dated the 31st October, 2013:
Provided further that the consolidated salary of a Member appointed or serving on or after the 1st day of January, 2016 shall be paid in accordance with the Ministry of Finance, Department of Expenditure O.M. No. 16-1/2017/E.IIIA dated the 10th January, 2018.

Explanatory Memorandum: The amendments are retrospectively effective in nature, since the Chairpersons and Members were appointed at the consolidated pay packages approved by the Department of Expenditure, Ministry of Finance vide their O.M. No. 81/1/2008-IC dated the 31st October, 2013 and O.M. No. 16-1/2017/E.IIIA dated the 10th January, 2018. It is certified that no person is being adversely affected by giving retrospective effect to this amendment.
Note: Principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide notification number G.S.R. 570(E), dated 15th September, 2006 and subsequently amended vide notification number G.S.R.405(E) dated 24th May, 2007.
