सा.का.नि. 20.—के न्द्रीय सरकार, सीमा सुरक्षा बल अधिनियम, 1968 (1968 का 47) की धारा 141 की उपधारा (2) के खंड (ढ)द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सीमा सुरक्षा बल, मुख्य विधि अधिकारी और विधि अधिकारी भर्ती और सेवा की शर्तें नियम, 1999 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, सीमा सुरक्षा बल में मुख्य विधि अधिकारी, अपर मुख्य विधि अधिकारी और विधि अधिकारी के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-
1. संक्षिप्त नाम और प्रारम्भ.- (1) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल, मुख्य विधि अधिकारी, अपर मुख्य विधि अधिकारी और विधि अधिकारी भर्ती और सेवा की शर्ते नियम, 2023 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. लागू होना – ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ (1) में विनिर्दिष्ट पदों पर लागू होंगे। 265 GI/2023
(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर- पदों की संख्या, उनका वर्गीकरण और इसमें संलग्न वेतन मैट्रिक्स स्तर वे होंगे जो उक्त अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं।
4. भर्ती की पद्धति, आयु-सीमा और अर्हताएं, आदि - उक्त पदों पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी, जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिर्दिष्ट हैं।
5. निरर्हता- वह व्यक्ति -
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है, या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,
उक्त पदों पर नियुक्ति का पात्र नहीं होगा :
परंतु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुञेयेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।
6. अधिवर्षिता- मुख्य विधि अधिकारियों और विधि अधिकारियों की अधिवर्षिता की आयु 60 वर्ष होगी और जिस मास में वे 60 वर्ष की आयु प्राप्त करते हैं, उस मास के अंतिम दिन के अपराह्न को वे सेवा से निवृत्त होंगे:
7. ज्येष्ठता :- विधि अधिकारियों की ज्येष्ठता निम्नलिखित नियमों के अनुसार अवधारित की जाएगी, अर्थात्:-
(1) ऐसे सभी अधिकारी, जो उच्चतर रैंक धारण किए हुए हैं, निम्नतर रैंक धारण करने वाले अधिकारियों से ज्येष्ठ होंगे।
(2) किसी विशिष्ट रैंक में, किसी पद पर नियुक्त अधिकारियों की ज्येष्ठता उस पद पर नियुक्ति के लिए चयन के अनुक्रमानुसार अवधारित की जाएगी।
(3) उप-नियम (2) के उपबंधों के अधीन रहते हुए, समान रैंक धारण करने वाले अधिकारियों में से परस्पर ज्येष्ठता निम्नानुसार होगी:-
(क) एक ही दिन में प्रोन्नत किए गए अधिकारियों की ज्येष्ठता उसी क्रम में अवधारित होगी जिसमें उन्हें उस रैंक में प्रोन्नति के लिए चयनित किया गया है;
(ख) सीधे भर्ती किए जाने वाले व्यक्तियों की परस्पर ज्येष्ठता 'संयुक्त' ज्येष्ठता के क्रमानुसार व्यवस्थित की जाएगी, जिसमें सीमा सुरक्षा बल द्वारा आयोजित प्रतियोगिता परीक्षा में उनके द्वारा अभिप्राप्त अंकों को जोड़ने के बाद और सीमा सुरक्षा बल के बुनियादी व्यावसायिक पाठ्यक्रम 50:50 के अनुपात में अवधारित की जाएगी;
(ग) सीधे भर्ती किए जाने वाले व्यक्तियों की दशा में, नियुक्ति की तारीख नियुक्ति के प्रस्ताव में उल्लिखित स्थान में शामिल होने की तारीख होगी;
(घ) यदि दो या दो से अधिक अधिकारियों ने संयुक्त योग्यता में समान अंक प्राप्त किए हैं, तो उनकी योग्यता के क्रम को उनकी जन्म की तारीख के क्रम के अनुसार माना जाएगा;
3 [भाग II—खण्ड 3(i)] भारत का राजपत्र : असाधारण(ङ) चयन के बाद प्रशिक्षण के लिए रिपोर्ट करने में देरी के मामले में ज्येष्ठता निम्नानुसार होगी: - (i) मंत्रालय या विभाग द्वारा जारी किया गया नियुक्ति का प्रस्ताव, नियुक्ति के प्रस्ताव में उल्लिखित कार्यभार ग्रहण करने की तारीख से चार सप्ताह की अवधि के लिए विधिमान्य होगा, जिसके बाद नियुक्ति प्रस्ताव स्वतः समाप्त हो जाएगा;
(ii) यदि, चार सप्ताह की निर्दिष्ट अवधि के भीतर, समय विस्तार के लिए अभ्यर्थी से अनुरोध प्राप्त होता है और गृह मंत्रालय से उचित विचार के बाद, उन्हें चार सप्ताह के अतिरिक्त अधिकतम दो सप्ताह की अवधि के लिए विस्तार दिया जा सकता है, यदि तथ्य और परिस्थितियाँ ऐसा करना आवश्यक समझती हैं और जो अभ्यर्थी छह सप्ताह की अवधि के भीतर शामिल होते हैं, उनकी ज्येष्ठता खंड (ग) के अनुसार तय की जाएगी;
(iii) खंड (ii) में बताए अनुसार दो सप्ताह के विस्तार के दिए जाने के बाद, यदि कोई अभ्यर्थी नियत समय के भीतर रिपोर्ट करने में विफल रहता है, (जो छह सप्ताह की अवधि से अधिक नहीं होगी), तो नियुक्ति का प्रस्ताव स्वतः समाप्त हो जाएगा;
(iv) नियुक्ति का प्रस्ताव जो समाप्त हो गया है, सामान्यत: पुनर्जीवित नहीं किया जाएगा, सिवाय असाधारण परिस्थितियों के और जनहित के आधार पर लिखित रूप में दर्ज किया जाएगा, और के वल गृह मंत्रालय का अनुमोदन अभिप्राप्त करने के बाद;
(v) जहां खंड (iv) के अनुसार नियुक्ति के प्रस्ताव को पुनर्जीवित किया जाता है , संबंधित अभ्यर्थियों की ज्येष्ठता अगली चयन परीक्षा के अभ्यर्थियों से ऊपर तय की जाएगी, लेकिन, यदि ऐसा अभ्यर्थी अगले चयन परीक्षा के किसी भी अभ्यर्थी के बाद शामिल होता है, तो उसे ऐसे अंतिम अभ्यर्थी से नीचे रखा जाएगा;
(च) प्रशिक्षण के लिए रिपोर्ट करने में देरी के मामले में ज्येष्ठता खंड (ङ) के मद (i), (ii) और (iii) के उपबंधों के अनुसार तय की जाएगी।
4. किसी विशेष रैंक में पुनर्नियोजित अधिकारियों की ज्येष्ठता उस रैंक में उनके पुनर्नियुक्ति की तारीख से अवधारित की जाएगी।
8. चिकित्सा दृष्टया योग्यता.- (1) इन नियमों में अन्तर्विष्ट किसी बात के होते हुए भी, के वल ऐसे व्यक्ति, जो चिकित्सा प्रवर्ग शेप- I में हैं, इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे।
(2) शेप-I से निम्नानुसार परिभाषित चिकित्सा प्रवर्ग अभिप्रेत है-
(क) कोड अक्षर SHAPE द्वारा उपदर्शित कारकों के अधीन अधिकारी की उपयुक्तता निर्धारण करने के बाद चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरण निम्नलिखित को दर्शाता है: - S - मनोवैञेयानिक
H - श्रवण क्षमता
A - एपेंडेजेज
P - शारीरिक क्षमता
E - दृष्टि क्षमता4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) एक अधिकारी की कार्यात्मक क्षमता को प्रेत्यक कारक के अधीन प्रत्येक कोड अक्षर के सामने अंक 1 से 5 तक दर्शाया जाएगा, जो घटती कार्यात्मक क्षमता को दर्शाता है और अंकों को कोड अक्षर के आगे लिखा जाएगा, सिवाय उस स्थिति में जहां सभी कारकों में कोई अधिकारी ग्रेड- I में है, तो उसकी श्रेणी को S 1 H 1 A 1 P 1 E 1 लिखने के बजाय SHAPE-I लिखकर दर्शाया जा सकता है । इन अंकों का सामान्य मूल्यांकन इस प्रकार है,-
(i) कहीं भी सभी ड्यूटी के लिए योग्य;
(ii) सभी ड्यूटी के लिए योग्य, किन्तु ड्यूटी के खास प्रकार तथा नियोजनीयता के क्षेत्र में, वह इस तथ्य पर निर्भर करेगा कि ड्यूटी पर अत्यधिक तनाव या दोनों आंख और कान का दिक् शक्ति या श्रवण शक्ति का अत्यधिक उपयोग क्षमता अंतवर्णित है, तो निर्बंधन हो सकती हैं;
(iii) "एस" कारक को छोड़कर, नियमित या स्थिर ड्यूटी के लिए योग्य, किन्तु उच्च ऊं चाई (2,700 मीटर से ऊपर) अत्यधिक ठंडे क्षेत्रों या पहाड़ी क्षेत्रों और लंबे समय तक कार्य करने के लिए नियोजन निर्बंधन हो सकती हैं;
(iv) अस्पताल में भर्ती होने या बीमारी की छु ट्टी के कारण ड्यूटी के लिए अस्थायी रूप से अयोग्य। (v) ड्यूटी के लिए स्थायी रूप से अयोग्य।
9. वर्दी और बुनियादी प्रशिक्षण- इन नियमों के उपबंधों के अधीन नियुक्त व्यक्तियों को सीमा सुरक्षा बल नियमावली खंड-VII में निर्दिष्ट वर्दी पहननी होगी और सिविल पदों या बार से नियुक्त व्यक्तियों को उनकी प्रारंभिक नियुक्ति पर विधि, ऑफिस प्रोसीजर, लेखा और ऐसे अन्य विषयों का बुनियादी प्रशिक्षण चौबीस सप्ताह में सफलतापूर्वक पूरा करना होगा, जो महानिदेशक सीमा सुरक्षा बल द्वारा अवधारित की जाए।
10. विदेशियों की अपात्रता- कोई भी व्यक्ति, जो भारत का नागरिक नहीं है, के न्द्रीय सरकार की लिखित रूप में पूर्व अनुमति के बिना, इन नियमों के अधीन नियुक्त नहीं किया जाएगा :
परंतु इस नियम में अंतर्विष्ट कोई बात, बल में नेपाल या भूटान के प्रजा की नियुक्ति या रोजगार को वर्जित नहीं करेगी।
11. शिथिल करने की शक्ति.- जहां कें द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण है उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बावत, आदेश द्वारा शिथिल कर सके गी।
12. व्यावृत्ति - इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका कें द्रीय सरकार द्वारा इस संबंध में जारी किए गए आदेशों के अनुसार अनुसूचित जातियां, अनुसूचित जनजातियां, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

| I. प्रोन्नति द्वारा : - ऐसे अपर मुख्य विधि अधिकारी/उप महानिरीक्षक जिन्होंने वेतन मैट्रिक्स में स्तर 13ए (131100- 216600 रुपये ) में दो वर्ष की नियमित सेवा सहित समूह 'क' में कु ल चौबीस वर्ष सेवा की हो। ि टप्पण: जहां ऐसे कनिष्ठों व् यक्तियों के संबंध में, जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा है, वहां उनसे ज् येष् ठ व् यक्तियों के संबंध में भी विचार किया जाएगा, परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन् होंने अपने ऐसे कनिष् ठ व् यक्तियों सहित, जिन् होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है, अगली उच् चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा अवधि सफलतापूर्वक पूरी कर ली हो। I।. प्रतिनियुक्ति द्वारा : कें द्रीय सरकार या राज्य सरकार या संघ राज्यक्षेत्रों के ऐसे अधिकारी जिन्होंने वेतन मैट्रिक्स में स्तर 13ए (131100-216600 रुपये) में दो वर्ष की नियमित सेवा सहित समूह 'क ' में कु ल चौबीस वर्ष सेवा की है: (क) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए है; या (ख ) (i) संघ के सशस्त्र बलों में न् यायाधीश महाधिवक् ता विभाग में मेजर जनरल या समतुल्य रैंक के ऐसे अधिकारी जिन्होंने समूह "क" में न्यूनतम चौबीस वर्ष सेवा की हो या जिसके पास सशस्त्र बलों संबंधी विशेष विधि के अधीन विचारण के अतिरिक्त संबद्ध न्यायालय मामलों के निपटान में बीस वर्ष का विधिक अनुभव हो; या (ii) ऐसे विधि स्नातक जिनके पास सशस्त्र बलों संबंधी विशेष विधि के अधीन विचारण के अतिरिक्त संबद्ध न्यायालय |
मामलों के निपटान में बीस वर्ष से अन्पून अवधि के लिए राज्य न्यायिक सेवा के सदस्य के रूप में विधिक अनुभव हो और जो जिला न्यायाधीश या समतुल्य पदधारण किए हुए हों ;
या
(iii) कें द्रीय सरकार या राज्य सरकार अथवा संघ राज्यक्षेत्र के ऐसे अधिकारी जिनके पास विधि में डिग्री हो और सशस्त्र बलों संबंधी विशेष विधि के अधीन विचारण के अतिरिक्त संबद्ध न्यायालय मामलों के निपटान में बीस वर्ष से अन्पून का विधिक अनुभव हो और जो आठ वर्ष से अन्पून अवधि तक अपर विधि सलाहकार या समतुल्य पद धारण किए हुए हों। टिप्पण -1: पोषक श्रेणी के विभागीय अभ्यर्थी जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।
टिप्पण-2: प्रतिनियुक्ति की अवधि, जिसके अंतर्गत के न्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य संवर्ग-बाह्य पद पर प्रतिनियुक्ति की अवधि सहित, साधारणतया पांच वर्ष से अधिक नहीं होगी।
टिप्पण -3: प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को अट्ठावन वर्ष से अधिक नहीं होगी।
भूतपूर्व सैनिकों के लिए:
III. पुनर्नियोजन: - (i) सशस्त्र बल के मेजर जनरल या समतुल्य रैंक के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले है और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं है, ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बलों से निमु र्क्त किया जाना है; उसके बाद उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है;

या
(ख) (i) संघ के सशस्त्र बलों में न्यायाधीश महाधिवक्ता के विभाग में ब्रिगेडियर या समतुल्य रैंक के ऐसे अधिकारी जिन्होंने सशस्त्र बलों से संबंधित विशेष विधि, साथ ही साथ संबंधित न्यायालय मामलों के अधीन विचारण से संबंधित अठारह वर्ष के विधिक कार्यो में विधिक अनुभव के साथ कम से कम बीस वर्ष की अवधि के लिए समूह "क" सेवा की हो ;
या
(ii) राज्य न्यायिक सेवा के ऐसे सदस्य जिन्होंने सशस्त्र बलों से संबंधित विशेष विधि, साथ ही साथ संबंधित न्यायालय मामलों के अधीन विचारण से संबंधित अठारह वर्ष के विधिक अनुभव के साथ कम से कम बीस वर्ष की अवधि के लिए समूह "क" सेवा की हो और जो जिला न्यायाधीश या समतुल्य पद धारण किए हुए हो ;
या
(iii) कें द्रीय सरकार या राज्य सरकार या संघ राज्यक्षेत्र के ऐसे अधिकारी जिनके पास विधि में डिग्री है और जिन्होंने सशस्त्र बलों से संबंधित विशेष विधि, साथ ही साथ संबंधित न्यायालय मामलो के अधीन विचारण से संबंधित अठारह वर्ष के विधिक अनुभव के साथ कम से कम बीस वर्ष की अवधि के लिए समूह "क" सेवा की हो और जो कम से कम आठ वर्ष की अवधि से अपर विधि सलाहकार या समतुल्य पद धारण किए हुए हो।
टिप्पण -1: पोषक श्रेणी के विभागीय अभ्यर्थी जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।
टिप्पण-2: प्रतिनियुक्ति की अवधि, जिसके अंतर्गत के न्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य संवर्ग-बाह्य पद पर प्रतिनियुक्ति की अवधि सहित, साधारणतया पांच वर्ष से अधिक नहीं होगी।
टिप्पण-3: प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु -सीमा आवेदन प्राप्त करने की अंतिम तारीख को छप्पन वर्ष से अधिक नहीं होगी।

(iv) ऐसा राज्य न्यायिक सेवा का सदस्य जिसने पंद्रह वर्ष की नियमित सेवा पूर्ण की हो और जिसे सशस्त्र बलों से संबंधित विशेष विधि के अधीन विचारण के साथ-साथ संबंधित न्यायालय मामलों में दस वर्ष का विधिक अनुभव हो। टिप्पण-1: पोषक श्रेणी के ऐसे विभागीय अभ्यर्थी जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

G.S.R. 20(E).—In exercise of the powers conferred by clause (n) of sub-section (2) of section 141 of the Border Security Force Act, 1968 (47 of 1968) and in supersession of the Border Security Force, Chief Law Officers and Law Officers Recruitment and Conditions of Service Rules, 1999, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Chief Law Officer, Additional Chief Law Officer and Law Officer in the Border Security Force, namely :-
1. Short title and commencement.- (1) These rules may be called the Border Security Force, Chief Law Officer, Additional Chief Law Officer and Law Officer Recruitment and Conditions of Service Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application.- These rules shall apply to the posts specified in Column (1) of the Schedule annexed to these rules.
3. Number of posts, classification and level in the pay matrix. – The number of posts, their classification and the level in the pay matrix attached thereto shall be as specified in Columns (2) to (4) of the said Schedule.
13 [भाग II—खण्ड 3(i)] भारत का राजपत्र : असाधारण4. Method of recruitment, age- limit and qualifications, etc. .- The method of recruitment to the said posts, age-limit, qualifications and other matter relating thereto, shall be as specified in Columns (5) to (13) of the said Schedule.
5. Disqualification.– No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to the person and to other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.
6. Superannuation.- The age of superannuation of the Chief Law Officers and Law Officers shall be sixty years and shall retire from service on the afternoon of the last day of the month in which they attain the age of sixty years:
7. Seniority.- The Seniority of Law Officers shall be determined in accordance with the following rules, namely:-
(1) All officers holding a higher rank shall be senior to the officers holding a lower rank.
(2) In a particular rank, seniority of officers appointed to any post shall be determined in accordance with the order of selection for appointment to that post.
(3) Subject to the provisions of sub-rule (2), Inter-se-seniority amongst officers holding the same rank shall be as follows:-
(a) Seniority of officers promoted on the same day shall be determined in the order in which they are selected for promotion to that rank;
(b) Inter-se-seniority of direct recruits shall be arranged in the order of 'combined' merit which shall be determined after adding together the marks obtained by them in the competitive examination conducted by Border Security Force and the Basic Professional Course of the Border Security Force in the ratio of 50:50;
(c) In the case of direct recruits, the date of appointment shall be the date of joining the venue as mentioned in the offer of appointment;
(d) If two or more officers have secured equal marks in the combined merit, then, their order of merit shall be considered as per the order of their dates of birth;
(e) The seniority in cases of delay in reporting for training after selection shall be as under:-
(i) an offer of appointment issued by the Ministry or Department shall be valid for a period of four weeks from the date for joining mentioned in the offer of appointment after which the offer would lapse automatically;
(ii) if, however, within the specified period of four weeks, a request is received from the candidate for extension of time and after due consideration by the Ministry of Home Affairs, he may be granted extension for a maximum period of two weeks in addition to the four weeks if facts and circumstances deem it necessary to do so and the candidates who join within a period of six weeks shall have their seniority fixed as per clause (c);
(iii) after the grant of extension of two weeks as stated in clause(ii), if a candidate fails to report within the stipulated time,(which shall not exceed a period of six weeks), the offer of appointment shall lapse automatically;
(iv) an offer of appointment which has lapsed, shall not ordinarily be revived, except in exceptional circumstances and on grounds of public interest to be recorded in writing, and only after obtaining the approval of the Ministry of Home Affairs;
(v) where the offer of appointment is revived under clause (iv), the seniority of candidates concerned shall be fixed above the candidates of the next selection examination, but, in case, such candidate joins after any of the candidate of the next selection examination has joined, he shall be placed below the last of such candidate;
(f) The seniority in case of delay in reporting for training shall be fixed in accordance with the provisions of items (i), (ii) and (iii) of clause (e).

8. Medical fitness.- (1) Notwithstanding anything contained in these rules, the persons who are in medical category SHAPE-I, shall be eligible for appointment under the provisions of these rules.
(2) SHAPE-I means Medical Category defined as under.-
(a) Medical classification done by Medical Officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE, which represent the following function:-
S - Psychological
H - Hearing
A - Appendages
P - Physical Capacity
E - Eye-Sight
(b) Functional capacity of an officer under each factor shall be denoted by numeral 1 to 5 against each code letter, indicating declining functional efficiency and the numerals will be written next to the code letter, except that where an officer is in Grade-I in all factors, his category may be denoted by writing SHAPE-I instead of writing S1H1A1P1E1. General evaluation of these numerals is as under,-
(i) fit for all duties anywhere;
(ii) fit for all duties but may have limitations as to type of duties and areas of employability depending on whether the duties involve severe stress or demand acuity of hearing or vision of both ears and eyes;
(iii) excepting "S" factor, fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2,700 meters) extreme cold areas or hilly terrain and for long assignments;
(iv) temporarily unfit for duties on account of hospitalization or sick leave.
(v) permanently unfit for duties.
9. Uniform and basic training.- Persons appointed under the provisions of these rules shall have to wear the uniform as specified in the Border Security Force Manual Volume-VII and the persons appointed from civil posts or Bar shall have to successfully complete twenty four weeks of basic training on their initial appointment in the field of law, office procedure, accounts and such other subjects as may be determined by the Director General Border Security Force.
10. Ineligibility of aliens.- No person who is not a citizen of India shall, except with the prior permission of the Central Government in writing be appointed or employed under these rules:
Provided that nothing contained in this rule shall bar the appointment or employment of a subject of Nepal or Bhutan in the Force.
11. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
12. Saving.– Nothing in these rules shall effect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government.

| I. By promotion:- Serving Additional Chief Law Officer/ Deputy Inspector General with two years of regular service in the level 13A (Rs.131100-216600/-) in the pay matrix with total twenty four years Group 'A' service. N ote: Where juniors who have completed their qualifying or eligibility service are considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service for more than half of such qualifying or eligibility service or two years, whichever is lesser, and have successfully completed their probation period for promotion to the next grade along with their juniors who have already completed such qualifying or eligibility service. II. By deputation : Officers of the Central Government or State Government or Union territories with two years of regular service in the level13A (Rs. 131100-216600/-) in the pay matrix with total twenty four years Group 'A' service: (a) holding analogous post on a regular basis in the parent cadre or department; or (b) (i) an officer of the rank of Major General or equivalent in the Department of Judge Advocate General in the Armed Forces of the Union, with minimum twenty four years of Group 'A' Service or Commissioned Service with twenty years of legal experience in dealing with trials under special law relating to Armed Forces as well as related court cases; or (ii) a Law graduate, who is a member of the State Judicial Services for a period of not less than twenty years of legal experience in dealing with trials under special law relating to Armed Forces as well as related court cases and holding the post of District Judge or an equivalent post; or (iii) a Central Government or State Government or Union territory officer having degree in Law and possessing a legal experience in dealing with trial under special law relating to Armed Forces as well as related court cases of not less than twenty years and holding the post of Additional Legal Advisor or equivalent for a period of not less than eight years. N ote 1: The Departmental candidates in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. N ote 2: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation or Department of the Central Government shall not ordinarily exceed five years. N ote 3: The upper age-limit for appointment by deputation shall not be exceeding fifty-eight years as on the closing date of receipt of application. |
For Ex-servicemen : III. Re-employment:- (i) The Armed Forces Personnel in the rank of Major General or equivalent due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered. Such persons would be given deputation terms up to the date on which they are due for release from the Armed Forces; thereafter they may be continued on re- employment;

By deputation:- Officers of the Central Government or State Government or Union territories: (a) holding analogous post on a regular basis in the parent cadre or department; or (b)(i) a law graduate holding the post of Commandant or Second-in-Command with five years regular service in Central Armed Police Forces including Border Security Force with fifteen years of Group 'A' service and having at least ten years legal experience in dealing with trials under special laws relating to Armed Forces as well as related court cases ; or ( ii) from suitable serving officers of Army, Navy, Air Force or any other Armed Force of the Union following an identical disciplinary Code, holding an analogous post of Colonel or Lieutenant Colonel or equivalent in the Department of Judge Advocate General with minimum fifteen years Commissioned or Group 'A' service and an experience of not less than ten years of legal experience in dealing with trials under special laws relating to Armed Forces as well as related court cases; or ( iii) from suitable serving civilian officers of Central Government or State Government or Union territory holding an analogous post with not less than fifteen years Group 'A' service and not less than ten years legal experience in dealing with trials under special Law relating to Armed Forces as well as related Courts. The officers with five years regular service in the level-12 (Rs.78800-209200/-) in the pay matrix, possessing a degree in law, at least ten years of legal experience in dealing with trials under special Law relating to Armed Forces as well as related Court cases and fifteen years Group 'A' service are eligible in this category; or (iv) A member of the State Judicial Service having fifteen years regular service with ten years of legal experience in dealing with trials under special laws relating to Armed Forces as well as related court cases.
