का.आ. 257(अ).—जबकि, के न्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का. आ. 379(अ), दिनांक 24 जनवरी,2019 तथा का. आ. 361(अ), दिनांक 21जनवरी, 2019द्वारा 'पंजाब राज्य में भारतमाला योजना के तहत क्रमशः रामदास से गुरदासपुर पेव्ड शोल्डर सहित दो लेन/चार लेन और करतारपुर कॉरिडोर तक के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् "प्राधिकरण" कहा जाए) को सौंपा है;

अतः अब के न्द्र सरकार, राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम, 2008 (जिसे इसके पश्चात "नियम'' कहा जाए) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पंजाब राज्य में एनएच संख्या 354बी के किमी. 0.000 से किमी. 3.600 तक भारतमाला योजना के तहत करतारपुर कॉरिडोर और एनएच संख्या 354 के 140.000 किमी से 187.492 किमी तक दो लेन/चार लेन पेव्ड शोल्डर सहित रामदास से गुरदासपुर तक के लिए सारणी 1 के स्तम्भ (2) में दिए यांत्रिक वाहनोपर विनिदिष्ट सडक खंड की निवल लंबाई 44.779 कि.मी. हेतु तथा0.830 कि.मी (जिनकी लबाई 0.083 कि.मी है) लंबाई की समकक्ष संरचना (जिनकी लम्बाई 60 मीटर से अधिक है)पेव्ड शोल्डर सहित दो लेन के उपयोग के लिए आधार दर के 60% पर तथा सारणी 1 के स्तम्भ (2) में दिए यांत्रिक वाहनोपर विनिदिष्ट सडक खंड की निवल लंबाई 6.130 कि.मी. हेतु तथा1.000 कि.मी (जिनकी लबाई 0.100 कि.मी है) लंबाई की समकक्ष संरचना (जिनकी लम्बाई 60 मीटर से अधिक है) चार लेन के उपयोग के लिए आधार दर के 100% पर सारणी 1 के स्तम्भ (1) में विनिदिष्ट वाहनों पर शुल्क की वसूली करती है एवं प्राधिकरण 348 GI/2023

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] को अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क को संग्रहीत करने के लिए प्राधिकृ त करती है, अर्थात् :

1. नीचे उद्ग्रहीत एवं संग्रहीत शुल्क, निम्नलिखित शुल्क प्लाजा पर, ऐसे शुल्क प्लाजा (प्लाजाओं) के लिए विनिदिष्ट सड़क की

2. उपयु र्क्त के अतिरिक्त, ऊपर तालिका 1 में उल्लिखित आधार दर पर निम्नलिखित संरचनाओं, जिनकी लम्बाई 60 मीटर से अधिक है, के उपयोग के लिए ऐसी संरचनाओं की लम्बाई को समकरण गुणक 10 से गुणा कर के राजमार्ग की

^संरचना का विवरण निम्नानुसार है;

3. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त हुआ हो और वह शुल्क प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता/रहती हो, उसके लिए वर्ष 2022-23 के लिए मासिक पास की दर 315.00/- रूपए (तीन सौ पंद्रह रूपए मात्र) होगी और उक्त नियमों के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा। 4. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किए जाएंगे, अर्थात्ः

5. जिस जिले में शुल्क प्लाजा स्थित है, उसमें पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के लिए वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सविस सड़क अथवा वैकल्पिक सड़क उपलब्ध न हो।

6. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक अथवा मालिक अथवा प्रभारी व्यक्ति को ऐसे अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संग्रहण एजेंसी को राष्ट्रीय राजमार्ग शुल्क नियमावली के नियम 10 के उप नियम 1ए में उल्लिखित शुल्क के बराबर शुल्क का भुगतान करना होगा और उसे राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए।

7. यांत्रिक वाहनों की श्रेणी, उनके लिए अनुज्ञेय भार, छू ट-प्राप्त वाहनों की श्रेणी, सविस सड़क, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिदिष्ट परिभाषाओं के अनुसार होंगी।

8. उक्त नियमों के नियम 12 के अनुसार उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरें प्रदशित की जाएंगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 9. ऊपर सारणी-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंड की पूर्ण हुई लम्बाई के आधार पर की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वाषिक तौर पर संशोधन किया जाएगा तथा इसे तदनुसार अंग्रेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।

10. इस परियोजना की अनुमानित पू ंजीगत लागत 382.55 करोड़ रुपए है। [पू ंजी लागत में परिवर्तन हो सकता है क्योंकि भूमि अर्जन, जन-उपयोगिता सेवाओं का स्थान बदलने, पेड़ों की कटाई आदि जैसे क्रियाकलाप अभी पूरे किए जाने शेष हैं तथा अंतिम पू ंजीगत लागत को अलग से अधिसूचित किया जाएगा]। प्राधिकरण द्वारा प्रयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पू ंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पू ंजीगत लागत की वसूली हो जाने के पश्चात, लगाए जाने वाले शुल्क की दरों को घटाकर 40%कर दिया जाएगा और उक्त नियमों के अनुसार इस में वाषिक तौर पर संशोधन किया जाएगा।

NOTIFICATION

New Delhi, the 13th January, 2023

S.O. 257(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 379(E) dated 24th January 2019 & S.O. 361(E) dated 21st January 2019 issued under Section 11 of the National Highways Authority of India Act 1988 (68 of 1988), the Central Government has entrusted the stretch „Ramdas to Gurdaspur Two lane with paved shoulder/ Four Lane and Kartarpur Corridor under Bharatmala scheme respectively in the state of Punjab" to the National Highway Authority of India (hereinafter referred to as the "Authority")

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at 60% of the Base Rate specified in column (2) of the Table 1 for net road section length of 44.779 km and equivalent length of structure (having more than 60m length) of 0.830 Km (having total length of 0.083 Km) for the use of two lane with paved shoulders and at 100% of the base rate specified in columns (2) of the Table 1 for net road section length of 6.130 km and equivalent length of structure (having more than 60m length) of 1.000 Km (having total length of 0.100 Km) for the use of four lane or more, on the type of vehicles specified in column (1) of the Table 1 below, of Ramdas to Gurdaspur Two lane with paved shoulder/ Four Lane from Km 140.000 to Km 187.492 of NH No. 354 and Kartarpur Corridor under Bharatmala scheme from Km 0.000 to Km. 3.600 of NH No. 354B in the State of Punjab and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified for such Fee Plaza(s), namely: -

2. In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs. 315.000 (Rupees Three Hundred Fifteen only) for the year 2022-23 and is subject to revision every year as per the provisions of the said rules.

4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: -

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.

8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.

9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.

10. The estimated capital cost of the project is Rupees 382.55 Crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
