का.आ. 268(अ).—जबकि, के न्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का. आ. 3836 (अ), दिनांक 02 अगस्त, 2018 द्वारा तेलंगाना राज्य में राष्ट्रीय राजमार्ग 363 के मनचेरियल से तेलंगाना/महाराष्ट्र सीमा तक के खंड (94.602 किलोमीटर की लंबाई के लिए) को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् "प्राधिकरण" कहा जाए) को सौंपा है;

अतः अब के न्र सरकार, राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम, 2008 (जिसे इसके पश्चात "नियम'' कहा जाए) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तेलंगाना राज्य में राष्ट्रीय राजमार्ग संख्या 363 के रेपेलवाड़ा से तेलंगाना/महाराष्ट्र सीमा खंड के डिजाइन किलोमीटर 42.000 से किलोमीटर 94.602 (मौजूदा कि.मी. 288.510 से कि.मी. 342.000) तक के लिए सारणी 1 के स्तम्भ (2) में दिए यांत्रिक वाहनो पर विर्निर्दष्ट सडक खंड की निवल लंबाई 48.554 कि.मी. और 6.88 कि.मी. (जिनकी लबाई 0.668 कि.मी. है) लंबाई की समकक्ष संरचना (जिनकी लम्बाई 60 मीटर से अधिक है) तथा बाईपास जिनकी लंबाई 3.360 कि.मी. (प्रत्येक की कीमत दस करोड़ से अधिक है), चार या अधिक अके ले खंड के उपयोग हेतु आधार दर के डेढ़ गुणा की दर से सारणी 1 के स्तम्भ (1) में विर्निर्दष्ट वाहनों पर शुल्क की वसूली करती है एवं 372 GI/2023

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क को संग्रहीत करने के लिए प्राधिकृ त करती है, अर्थात्:

1. नीचे उद्ग्रहीत एवं संग्रहीत शुल्क, निम्नलिखित शुल्क प्लाजा पर, ऐसे शुल्क प्लाजा (प्लाजाओं) के लिए विर्निर्दष्ट सड़क

2. उपरोक्त के अलावा, 10 करोड़ रुपये से अधिक की लागत वाले बाईपास के उपयोग हेतु ऐसे शुल्क प्लाज़ा(ओं) के लिए उल्लिखित बाईपास की निवल लंबाई के लिए निम्नलिखित शुल्क प्लाज़ा पर निम्नलिखित शुल्क देय तथा

3. उपयु र्क्त के अतिरिक्त, निम्नलिखित बुनियादी ढांचाओं, जिनकी लम्बाई 60 मीटर से अधिक है, के उपयोग के लिए ऐसी बुनियादी ढांचाओं की लम्बाई को समकरण गुणक 10 से गुणा करके राजमार्ग की समकक्ष लम्बाई में परिवर्तन करते हुए, निम्नलिखित शुल्क प्लाजाओं पर निम्नलिखित शुल्क भी देय और भुगतान योग्य होगाः

नोट: एओपी परियोजना राजमार्ग लंबाई के रैखिक हिस्से में नहीं है।

4. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त हुआ हो और वह शुल्क प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता/रहती हो, उसके लिए वर्ष 2022-23 के लिए मासिक पास की दर 315.00/- रूपए (तीन सौ पंरह रूपए मात्र) होगी और उक्त नियमों के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा। 5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किए जाएंगे, अर्थात्ः

6. जिस जिले में शुल्क प्लाजा स्थित है, उसमें पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के लिए वाहन के लिए निर्धारित शुल्क का 50% होगा बशते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई र्सर्वस सड़क अथवा वैकल्पिक सड़क उपलब्ध न हो।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 7. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक अथवा मालिक अथवा प्रभारी व्यक्ति को ऐसे अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संग्रहण एजेंसी को राष्ट्रीय राजमार्ग शुल्क नियमावली के नियम 10 के उप नियम 1ए में उल्लिखित शुल्क के बराबर शुल्क का भुगतान करना होगा और उसे राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए।

8. यांत्रिक वाहनों की श्रेणी, उनके लिए अनुज्ञेय भार, छू ट-प्राप्त वाहनों की श्रेणी, र्सर्वस सड़क, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विर्निर्दष्ट परिभाषाओं के अनुसार होंगी।

9. उक्त नियमों के नियम 12 के अनुसार उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरें प्रर्दर्शत की जाएंगी। 10.ऊपर सारणी-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंड की पूर्ण हुई लम्बाई के आधार पर की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार र्वार्षक तौर पर संशोधन किया जाएगा तथा इसे तदनुसार अंग्रेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।

11.इस परियोजना की अनुमानित पू ंजीगत लागत 1363.51 करोड़ रुपए है। [पू ंजी लागत में परिवर्तन हो सकता है क्योंकि भूमि अर्जन, जन-उपयोगिता सेवाओं का स्थान बदलने, पेड़ों की कटाई आदि जैसे क्रियाकलाप अभी पूरे किए जाने शेष हैं तथा अंतिम पू ंजीगत लागत को अलग से अधिसूचित किया जाएगा]। प्राधिकरण द्वारा प्रयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पू ंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पू ंजीगत लागत की वसूली हो जाने के पश्चात, लगाए जाने वाले शुल्क की दरों को घटाकर 40%कर दिया जाएगा और उक्त नियमों के अनुसार इस में र्वार्षक तौर पर संशोधन किया जाएगा।

NOTIFICATION

New Delhi, the 16th January, 2023

S.O. 268(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 3836 (E) dated 2nd August, 2018, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from Mancherial to Telangana/Maharashtra Border Section (for a length of 94.602 kilometres) of National Highway number 363 in the State of Telangana to National Highways Authority of India (hereinafter referred to as "Authority");

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length of 48.554 km for the use of four and more alone section and for equivalent structure length (having length more than 60 m) of 6.88 Km. (having length of 0.688 Km.) and at one and half times of the base rate for bypasses having length of 3.360 Km. (each costing more than ten crores) on the type of vehicles specified in column (1) of the Table 1 below of Repellewada to Telangana/Maharashtra Border to Section from Design kilometre 42.000 to kilometre 94.602 (existing Km. 288.510 to Km. 342.000 of National Highway number 363 in the State of Telangana and authorises the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified for such Fee Plaza(s), namely: -

2. In addition to above, the following fee shall also be due and payable for the use of the bypass costing Rs. 10 crore or more at the following Fee Plaza for net bypass length specified for such Fee Plaza(s): -

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalisation factor of 10:

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 315 (Rupees: Three Hundred and Fifteen Only) for the year 2022-23 and is subject to revision every year as per the provisions of the said rules.

5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle, provided no service road or alternative road is available for use of such commercial vehicles.

7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in Sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.

9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said Rules.

10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed length of the section and revised annually in accordance with the Rule 5 of the said rules and the same shall be published in at least one newspaper, in English and vernacular language.

11. The estimated capital cost of the project is Rupees 1363.51 Crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed and the final capital cost will be notified separately]. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
