का.आ. 305(अ).—यतः, के न्द्रीय सरकार ने, राष्ट्रीय राजमार्ग अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 197(अ), दिनांक 12 जनवरी 2013 द्वारा मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या-75 (नया रारा -39) के 2.800 किमी से 83.400 किमी (रीवा-सिद्धि खंड) भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसके पश्चात् 'प्राधिकरण' कहा जाए) को सौंपा है;
अतः, अब, के न्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008, (जिसे इसके पश्चात "नियम'' कहा जाए), के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा अधिसूचना संख्या का.आ.1627(अ), दिनांक 19.05.2017 के अधिक्रमण में, मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या-75 ई(नया एनएच -39) के डिजाइन किमी 0.000 से 30.300 (मौजूदा किमी. 2.800 से 33.200) और डिजाइन किमी 45.650 से किमी 73.150 (मौजूदा किमी. 55.400 से 83.400) तक रीवा- सिद्धि (चुरहट बाईपास को छोड़कर) खंड के दो लेन पेव्ड शोल्डर के उपयोग के लिए सड़क खंड की निवल लंबाई 42.592 कि.मी. और 6.080 कि.मी (जिनकी लंबाई 0.608 किमी है) लंबाई की समकक्ष संरचना (जिनकी लम्बाई 60 मीटर से अधिक है) के लिए यांत्रिक वाहनो पर सारणी 1 के स्तम्भ (2) में विनिदिष्ट दरों के 60% पर और बाईपास जिनकी लंबाई 14.600 किमी है, और लागत दस करोड़ या उससे अधिक है, के उपयोग हेतु सारणी 1 के स्तम्भ (1) में विनिदिष्ट वाहनों पर 90% की आधार दर से तथा राष्ट्रीय राजमार्ग संख्या-75 ई(नया एनएच -39) के डिजाइन किमी 30.300 से 45.650 (मौजूदा किमी. 33.200 किमी. 55.400) तक चुरहट बाईपास खंड के चार लेन खंड के उपयोग हेतु सारणी 1 के स्तम्भ (1) में विनिदिष्ट वाहनों पर 24.320 कि.मी (जिनकी लंबाई 2.432 किमी है) लंबाई की समकक्ष संरचना (जिनकी लम्बाई 60 मीटर से अधिक है) हेतु सारणी 1 के स्तम्भ (2) में विनिदिष्ट दरों के 100% पर और बाईपास जिनकी लंबाई 12.918 किमी है, और लागत दस करोड़ या उससे अधिक है, डेढ़ गुना की दर से शुल्क उद्ग्रहीत करती है एवं प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क को संग्रहीत करने के लिए प्राधिकृ त करती है, अर्थात्ः-

3. उपयु र्क्त के अतिरिक्त,निम्नलिखित बुनियादी ढांचाओं,जिनकी लम्बाई 60 मीटर से अधिक है,के उपयोग के लिए ऐसी बुनियादी ढांचाओं की लम्बाई को समकरण गुणक 15 से गुणा करके राजमार्ग की समकक्ष लम्बाई में परिवर्तन करते हुए,निम्नलिखित शुल्क प्लाजाओं पर निम्नलिखित शुल्क भी देय और भुगतान योग्य होगाः

4. जिस व्यक्ति का अपना यांत्रिक वाहन,गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त हुआ हो और वह शुल्क प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता/रहती हो,उसके लिए वर्ष 2022-23 के लिए मासिक पास की दर 315.00/- रूपए (तीन सौ पंद्रह रूपए मात्र) होगी और उक्त नियमों के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा। 5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किए जाएंगे, अर्थात्ः

6. जिस जिले में शुल्क प्लाजा स्थित है, उसमें पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के लिए वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सविस सड़क अथवा वैकल्पिक सड़क उपलब्ध न हो।
7. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक अथवा मालिक अथवा प्रभारी व्यक्ति को ऐसे अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संग्रहण एजेंसी को राष्ट्रीय राजमार्ग शुल्क नियमावली के नियम 15 के उप नियम 1ए में उल्लिखित शुल्क के बराबर शुल्क का भुगतान करना होगा और उसे राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए।
8. यांत्रिक वाहनों की श्रेणी,उनके लिए अनुज्ञेय भार, छू ट-प्राप्त वाहनों की श्रेणी,सविस सड़क, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं उक्त नियमों में विनिदिष्ट परिभाषाओं के अनुसार होंगी।
9. उक्त नियमों के नियम 12 के अनुसार उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरें प्रदशित की जाएंगी। 10. ऊपर सारणी-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंड की पूर्ण हुई लम्बाई के आधार पर की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वाषिक तौर पर संशोधन किया जाएगा तथा इसे तदनुसार अंग्रेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।
ंजी लागत 1876.680 करोड़ रुपये है। [पू
11. परियोजना की अनुमानित पू ंजी लागत में परिवर्तन हो सकता है क्योंकि भूमि अर्जन, जन-उपयोगिता सेवाओं का स्थान बदलने, पेड़ों की कटाई आदि जैसे क्रियाकलाप अभी पूरे किए जाने शेष हैं। ंजीगत लागत को अलग से अधिसूचित किया जाएगा]। प्राधिकरण द्वारा प्रयोगकर्ताओं से वसूल किए गए शुल्क के अंतिम पू जरिए पू ंजीगत लागत की वसूली हो जाने के पश्चात, लगाए जाने ंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पू वाले शुल्क की दरों को घटाकर 40% कर दिया जाएगा और उक्त नियमों के अनुसार इस में वाषिक तौर पर संशोधन किया जाएगा।

New Delhi, the 17th January, 2023
S.O. 305(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O.197(E) dated 12th January 2013 issued under Section 11 of the National Highway Authority of India Act 1988 ( 68 to 1988) , the Central Government has entrusted from km 2.800 to km 83.400 (Rewa-Sidhi Section) of National Highway Number 75 (New NH-39) in the state of Madhya Pradesh to the National Highways Authority of India (hereinafter referred to as the "Authority");
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules") and in supersession of S.O. 1627 (E) dated 19.05.2017, the Central Government hereby levies the fee on mechanical vehicles at 60% of the rate specified in column (2) of the Table 1 for net road5 [भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण section length of 42.592 km and for equivalent structure length (having length more than 60m) of 6.080 km (having length of 0.608 km) and at 90% of the base rate for bypasses having length of 14.600 km costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below for the use of two lane with paved shoulder of Rewa-Sidhi (except Churhat By-pass) section from Design km 0.000 to 30.300 (existing Km. 2.800 to 33.200) and from Design km 45.650 to 73.150 (existing Km. 55.400 to 83.400) of NH-75 E(New NH-39) and at 100% of the rate specified in column (2) of the Table 1 for equivalent structure length (having length more than 60m) of 24.320 km (having length of 2.432 km) and at one and one half times for bypasses having length of 12.918 km costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below for the use of Four lane section of Churhat By-pass section from Design km 30.300 to 45.650 (existing Km. 33.200 Km. 55.400 ) of NH-75E (New NH- 39) in the State of Madhya Pradesh and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs 315.000 (Three Hundred and Fifteen Only) for the year 2022-23 and is subject to revision every year as per the provisions of the said rules.
5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: -

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.
9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.
11. The estimated capital cost of the project is Rupees 1876.680 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
