फा. सं. CEA-PS-13-17(42)/1/2021-PSPM Division-Part (14).—जबकि मैसर्स मसाया सोलर एनर्जी प्राइवेट लिमिटेड, जिसका पंजीकृ त कार्यालय कार्यालय यूनिट नंबर 305, तीसरी मंजिल, टॉवर बी, पायनियर अर्बन स्क्वायर, सेक्टर-62, गोल्फ कोर्स एक्सटेंशन रोड, गुरुग्राम-122005 है, ने पारेषण योजना "खंडवा, एमपी में मसाया सोलर एनर्जी प्राइवेट लिमिटेड सोलर 300MW प्रोजेक्ट से बिजली की निकासी" के तहत बिजली की तारें बिछाने के लिए विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत प्राधिकृ त करने हेतु आवेदन किया है।
और जबकि के .वि.प्रा, विद्युत मंत्रालय, भारत सरकार ने अपने पत्र सं CEA-PS-11-23(20)/1/2018-PSPA-I Division दिनांक 23.03.2022. के द्वारा पारेषण योजना के अंतर्गत ने विद्युत अधिनियम, 2003 की धारा 68(1) के तहत "खंडवा, एमपी में मसाया सोलर एनर्जी प्राइवेट लिमिटेड सोलर 300MW प्रोजेक्ट से बिजली की निकासी" के अंतर्गत आने वाली शिरोपरि लाइनों को विद्युत अधिनियम की धारा 68(1) के अंतर्गत पूर्व अनुमोदन प्रदान किया था।
मैसर्स मसाया सोलर एनर्जी प्राइवेट लिमिटेड ने दिनांक 15.04.2022 को हिदी स्थानीय समाचार पत्रों (ध्रुव वाणी, पीपुल्समाचार), दिनांक 27.07.2022 को अंग्रेज़ी समाचार पत्र (फ्री प्रेस) तथा भारत का राजपत्र साप्ताहिक दिनांक 20.08.2022 से 26.08.2022 में पारेषण योजना के लिए प्रस्तावित पारेषण मार्ग पर प्रकाशन की तारीख से 60 दिनों के भीतर आम जनता की टिप्पणियों / अभ्यावेदन की मांग करते हुए नोटिस प्रकाशित किया था । इसके पश्चात, मेसर्स मसाया सोलर एनर्जी प्राइवेट लिमिटेड ने 20.10.2022 दिनांकित एक हलफनामा प्रस्तुत किया, जिसमें घोषणा की गई कि समाचार पत्रों / भारत का राजपत्र में उपरोक्त पारेषण योजना के लिए सार्वजनिक सूचना के प्रकाशन के 60 दिनों के भीतर जनता से कोई आपत्ति प्राप्त नहीं की गई ।

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] और अब आवेदक ने विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत पारेषण योजना के "खंडवा, एमपी में मसाया सोलर एनर्जी प्राइवेट लिमिटेड सोलर 300MW प्रोजेक्ट से बिजली की निकासी" के तहत विद्युत लाइन बिछाने के लिए उसे वे सभी शक्तियां प्रदान करने का अनुरोध किया है, जो टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित टेलीग्राफ लाइनों और खंबों या उनके रख-रखाव के लिए या स्थापित होने वाली टेलीग्राफ लाइनों और खंबों या उनके रख- रखाव के लिए भारतीय टेलीग्राफ अधिनियम, 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास है। पारेषण योजना के अंतर्गत निम्नलिखित शिरोपरि लाईन हैं:
1. एमएसईपीएल सौर ऊर्जा परियोजना (भवसिहपुरा गांव में उत्पादन स्विचयार्ड) - खंडवा (पीजी) 220 के वी एस/सी लाइन
उपयु र्क्त योजना के तहत कवर की गई ट्रांसमिशन लाइन मध्य प्रदेश के निम्नलिखित गांवों, कस्बों और शहरों के बीच से होकर गुजरेगी:

अब, सावधानीपूर्वक विचार करने के पश्चात, कें द्रीय विद्युत प्राधिकरण, विद्युत मंत्रालय, भारत सरकार, मसाया सोलर एनर्जी प्राइवेट लिमिटेड को उपरोक्त शिरोपरि लाइनों को लगाने के लिए वे सभी शक्तियां निम्नलिखित निबंधनों एवं शर्तों के साथ प्रदान करता है, जो टेलीग्राफ के उद्देश्य के लिए सरकार द्वारा स्थापित टेलीग्राफ लाइनों और खंबों या उनके रख-रखाव के लिए या स्थापित होने वाली टेलीग्राफ लाइनों और खंबों या उनके रख-रखाव के लिए भारतीय टेलीग्राफ अधिनियम, 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास है:
(i) यह अनुमोदन 25 वर्षों के लिए प्रदान किया जाता है।
(ii) आवेदक को प्रस्तावित लाइनों की स्थापना से पूर्व संबंधित प्राधिकारियों अर्थात् स्थानीय निकायों, रेलवे, राष्ट्रीय राजमार्ग, राज्य राजमार्ग आदि की सहमति प्राप्त करनी होगी।
(iii) आवेदक को विद्युत अधिनियम, 2003 के तहत समुचित आयोग के द्वारा तैयार किए गए पारेषण, ओ एंड एम, ओपन एक्सेस आदि के विनियमों/संहिताओं का पालन करना होगा।
(iv) आवेदक कें द्र सरकार के विद्युत निरीक्षक/मुख्य विद्युत निरीक्षक के अनुमोदन के पश्चात ही लाइनों का प्रचालन करेगा। (v) यह अनुमोदन आवेदक द्वारा विद्युत अधिनियम, 2003 के प्रावधानों और उसके तहत बनाए गए नियमों की अपेक्षाओं का अनुपालन किए जाने के अध्यधीन है।
(vi) मसाया सोलर एनर्जी प्राइवेट लिमिटेड को विद्युत निरीक्षण के समय विमानन एवं रक्षा प्राधिकरणों इत्यादि, से अपेक्षित अनुमति को प्राप्त करने के बाद, इसे कें द्रीय विद्युत प्राधिकरण को विद्युत निरीक्षण के समय प्रस्तुत करना होगा।

F. No. CEA-PS-13-17(42)/1/2021-PSPM Division-Part(14).—Whereas M/s Masaya Solar Energy Private Limited, the applicant with its registered office at Unit No.305, Third Floor, Tower B, Pioneer Urban Square, Sec-62, Golf Course Extension Road, Gurugram-122005 has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of electric line under the transmission scheme "Evacuation of power from Masaya Solar Energy Private Limited solar 300MW project at Khandwa, MP".

And whereas, CEA, Ministry of Power, Government of India vide its letter no. CEA-PS-11-23(20)/1/2018- PSPA-I Division dated 23.03.2022 had granted prior approval under section 68(1) of the Electricity Act, 2003 to M/s Masaya Solar Energy Private Limited for the overhead lines covered under the transmission scheme "Evacuation of power from Masaya Solar Energy Private Limited solar 300MW project at Khandwa, MP".
M/s Masaya Solar Energy Private Limited has published notice for transmission scheme in Hindi local newspapers dated 15.04.2022 (Dhruv Vani , Peoplessamachar) , in English newspaper dated 27.07.2022 (Free Press) and Weekly Gazette of India dated 20.08.2022 for the general public to make observations/representations on the proposed transmission route within 60 days from the date of publication. Subsequently, M/s Masaya Solar Energy Private Limited has submitted an affidavit dated 20.10.2022 declaring that no objection has been received from public within 60 days of publication of Public Notice in newspapers / Gazette of India.
And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under the transmission scheme "Evacuation of power from Masaya Solar Energy Private Limited solar 300MW project at Khandwa, MP". The following overhead line is covered under this transmission scheme:
1. MSEPL Solar Power Project (Generation switchyard at Bhavsinghpura village) - Khandwa (PG) 220kV S/C line The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns, and cities of Madhya Pradesh:

Now, after careful consideration, Central Electricity Authority, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Masaya Solar Energy Private Limited for laying above overhead lines, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned lines, namely:
(i) The approval is granted for 25 years.
(ii) The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed lines.
(iii) The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003.
(iv) The Applicant shall operate the lines after approval of Electrical Inspector / Chief Electrical Inspector of Central Government.
(v) The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant.
(vi) M/s Masaya Solar Energy Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection.
